Dam safety engineering and compliance services for ESKOM peaking dams (6-Year contract)

Mandatory Compliance:

• Section 37(2) OHS Act Agreement: Must be signed between Eskom and the Main contractor before work starts. Main contractor must also compile Section 37(2) agreements with all Appointed contractors. Originals retained by contractors; copies filed with Eskom project manager and in OHS files.

Legislative Compliance:

• Constitution of the Republic of South Africa (Section 24 of the Bill of Rights).
• Occupational Health and Safety Act 1993 (and Regulations), including Construction Regulations (Sections 8, 9, 10, and Regulation 7).
• National Environmental Management Act 1998.
• Environment Conservation Act 1989.
• National Water Act 1998 (Chapter 12 and Dam Safety Regulations).
• Civil and Building Work Act.
• National Road Traffic Act.
• Compensation for Occupational Injuries and Diseases Act (COID).
• SANS Standards (applicable to the project).
• OHS Act "Regulations on Hazardous Work by Children in South Africa" (child labour prohibited).

Eskom-Specific Requirements:

• SHEQ Policy: Must be compiled (if not existing), signed by CEO or delegate, displayed prominently, and filed in OHS files/annexed to OHS Plan.
• COVID-19 Policy: Signed by senior management, displayed, and filed in OHS files.
• COID Registration: Main contractor and Appointed contractors must be registered with a Compensation Commissioner and possess a valid Letter of Good Standing (LoG). LoG must remain valid throughout the contract; copies filed in OHS files.
• Statutory Appointments: Competent personnel must be appointed per OHS Act criteria (e.g., 16(1) or 16(2) appointees).
• Eskom Life-Saving Rules: Mandatory adherence for all contractors/employees on Eskom premises. Rules include: Open/Isolate/Test/Earth, Hook Up at Heights, Buckle Up, Be Sober, Permit to Work, Ensure Safe Live Working. Non-compliance is serious misconduct.
• Substance Abuse: Zero tolerance (0% alcohol/drugs). Contractors must follow Eskom Procedure 32-37; ad-hoc testing may occur. Employees must sign the Life-Saving Rule pledge before work starts.
• Organisational Structure: Main contractor and Appointed contractors must provide organograms (signed by 16(1)/16(2)) listing roles, names, and appointments. Must be updated and filed in OHS files.
• OHS File: Must be maintained for each site, including all health/safety records, Section 37(2) agreements, and organograms.
• Risk Assessments: Baseline and pre-task risk assessments required (daily/task-specific). Must identify hazards, evaluate risks, and document controls. Method statements/safe work procedures must be submitted to Eskom for approval.
• PPE: Issue risk-based PPE as a last resort; inspect regularly and train employees on use/care.
• Medical Surveillance: Organisational programme required for the contract duration. Pre-employment/periodic medicals must align with job specifications.
• Incident Reporting: All incidents must be reported/investigated per Eskom Procedure 32-95. Main contractor must participate in Appointed contractors' investigations.
• Training: Contractor Health and Safety Officer (part-time) must have SAMTRAC, HIRA, incident investigation, legal liability training, ISO 45001 knowledge, and 2+ years experience. Weekly reports to Eskom Safety Department and monthly internal audits of subcontractors required.
• Site Supervisor: Must be trained in HIRA, incident investigation, supervisor training, authorised person/PSR, and legal liability. Responsibilities include ensuring compliance, inspecting work, monitoring OHS performance, and submitting reports.

Prohibited:

• Child labour or hazardous work by children (per Constitution and OHS Act Regulations).
