• Submit both technical (Envelope A) and financial (Envelope B) proposals online via https://tenderportal.elidz.co.za; only PDF files, max 30 MB each.
• Deadline: 12:00 noon on 6 April 2026. Late, emailed, faxed or incomplete submissions will be rejected.
• Envelope A must contain all required supporting documents (company profile, CSD registration, CIPC registration, certified ID copies, share certificate, proof of office, SARS tax clearance, Fidelity Fund certificates, Legal Practice Council letter of good standing, professional indemnity insurance ≥ R5 million, original cancelled cheque/trust‑account letter, B‑BBEE certificate or sworn affidavit, reference letters, track‑record form, project‑team organogram and CVs, completed ELIDZ Procurement Handbook).
• Envelope B must contain only the price schedule and cost proposal; any price information in Envelope A results in disqualification.
• All forms must be signed by an authorised signatory (board resolution copy required for companies). Non‑signed Form of Offer in Envelope B leads to disqualification.
• Separate technical and financial proposals; do not mix price details in Envelope A.
• Ensure all required documents are original or certified copies as specified.

• Functional evaluation matrix (total 100 points) – minimum 70 points required to proceed:

• Years in existence: >5 years = 30 pts; 2‑5 years = 20 pts; <2 years = 5 pts.
• References: up to 10 pts per reference (minimum 3 references) – max 30 pts.
• Labour‑law track record: 10‑40 relevant projects – max 40 pts.

• Price competitiveness accounts for 80 % of the overall score (price points calculated using the ELIDZ 80/20 formula).
• Specific transformation goals provide up to 20 % additional points (preference for Black‑owned, women‑owned, disability‑owned, SMME, Eastern Cape‑based, youth‑owned firms, etc.).
• B‑BBEE certificate or sworn affidavit is mandatory; failure results in zero preference points.
• Total score = price points (max 80) + specific‑goal points (max 20); highest total wins, provided the 70‑point functional threshold is met.

Scope of Services:

• Interpretation of labour‑law legislation.
• Representation at competent forums.
• Advice on collective labour‑law matters.
• Prosecution of internal disciplinary proceedings.
• Advice on disciplinary and performance issues.
• General and strategic labour‑law advice.
• Drafting, reviewing, negotiating contracts.
• Dispute‑resolution and litigation services (on‑demand).

Exclusions: chairing disciplinary hearings and any labour‑law services not listed.

Deliverables & Reporting:

• Standard monthly management report by the 25th of each month.
• Ad‑hoc reports as required.
• On‑demand legal opinions, advice, reviews, contracts, dispute resolution.

Resources:

• Firm must be an established attorney practice with qualified, experienced labour‑law lawyers.
• Project‑team organogram and CVs required; key‑person substitution subject to ELIDZ approval.

Location:

• Services to be performed at ELIDZ offices, Lower Chester Road, Sunnyridge, East London, or any other site directed by ELIDZ.

Performance:

• Failure to perform on‑demand services constitutes material breach and may lead to termination.
• Service Level Agreement (Section C) will define detailed service levels, quality standards (ISO 14001, ISO 45001), penalties (1/14 % of contract value per day for late completion), and key‑person obligations.

• Pricing to be submitted in Envelope B only; all prices inclusive of VAT.
• Monthly payment milestones over the three‑year contract, as detailed in the Service Level Agreement.
• Price validity: 120 days from the closing date.
• Invoice must be original, VAT‑compliant, and submitted by the 25th of the month; payment made within 30 days of receipt.
• Penalty for late delivery: deduction of 1/14 % of contract value per day after the agreed completion date.
• No price revisions without mutual written agreement.
• No bonds or guarantees are explicitly required in the document.

• Central Supplier Database (CSD) registration and MAAA number required.
• Certified copy of CIPC registration.
• Certified copies of directors’ IDs and share certificate.
• Proof of office location (lease, municipal statement, or council clearance).
• Valid SARS Tax Clearance Certificate (or PIN code for online verification).
• Fidelity Fund certificates for all directors.
• Letter of good standing from the Legal Practice Council.
• Professional Indemnity Insurance – minimum R5 million cover.
• Original cancelled cheque / bank‑stamped letter (including trust‑account letter).
• B‑BBEE certificate (accredited) for generic suppliers; for EMEs/QSEs, sworn affidavit confirming ownership and turnover.
• Minimum B‑BBEE contributor level 4 for firms with turnover < R10 million (higher level if >50 % black ownership).
• All above documents must be included in Envelope A.
