• Scope: Appointment of a service provider for servicing, maintenance, testing, and repair of diesel-powered standby generators.
• Contract period: From date of appointment until 30 June 2029.
• Deliverables must conform to standards specified in the bidding documents.
• The supplier must allow inspections, tests, and analyses of goods/services at any reasonable time.
• All pre-bidding testing costs are borne by the bidder.
• The purchaser may conduct inspections; costs will be borne by the purchaser if goods comply, otherwise by the supplier.
• Non-compliant goods/services may be rejected.
• Variation orders: Changes up to 15% of original contract value may be instructed without price escalation.

• Goods/services must conform to standards specified in bidding documents.
• Inspections, tests, and analyses may be conducted at any reasonable time.
• Pre-bidding testing costs borne by bidder.
• Non-compliant goods/services may be rejected.
• Supplier must maintain confidentiality of contract documents and information.

• All prices must be in South African Rand and include VAT.
• Tax compliance and clearance of municipal accounts are mandatory.

• Bidders must be registered for VAT if contract value exceeds R1 million.
• Invoices must clearly show VAT amount and include municipality’s VAT registration number (4000 846 172) for supplies over R3,000.
• Payment terms: Payments will be made within 30 days after submission of a valid invoice with delivery note.
• No contract will be awarded to bidders with outstanding municipal rates, taxes, or service charges.
• The municipality may deduct amounts from payments to settle any debts owed by the successful bidder.
• Prices quoted in the bid are fixed unless price adjustments are authorised.

• Mandatory registration on National Treasury’s Central Supplier Database (CSD). Submit CSD number (starting with MAAA) with bid.
• Submit a valid Tax Compliance Status (TCS) Pin or CSD registration number. Failure to do so invalidates the bid.
• B-BBEE compliance: Submit a certified B-BBEE certificate or sworn affidavit (for EMEs/QSEs) to claim preference points.
• No bids accepted from persons in the service of the state; declarations of interest (MBD 4) required.
• Joint ventures/consortia must submit a joint venture agreement showing percentage contributions.
• Valid Letter of Good Standing from the Compensation Commissioner required for Occupational Health and Safety (OHSA).
• Bidders must declare all municipal account numbers in the Bergrivier area for the enterprise and its principals.

• Occupational Health and Safety (OHSA) form must be completed and signed.

• Warranty: Goods supplied must be new, unused, and defect-free. Warranty valid for 12 months after delivery or 18 months after shipment.
• Payment: Within 30 days after invoice submission with delivery note.
• Prices are fixed unless authorised adjustments.
• Variation orders: Changes up to 15% of contract value may be instructed without price escalation.
• Assignment and subcontracting require prior written consent from purchaser.
• Penalties for delays: Deductions based on prime interest rate per day.
• Termination for default, corrupt practices, or insolvency.
• Force majeure provisions apply.
• Dispute resolution: Mutual consultation, mediation, then South African courts.
• Governing law: South African law; contract in English.
• Tax compliance and municipal account clearance required.

• Evaluation follows the 80/20 preference points system: 80 points for price, 10 for specific participation goals, 10 for B-BBEE.
