Eskom's eTendering system is a web-based platform that replaces the physical lodging of tender documents at Eskom tender offices. Suppliers upload their bid documents electronically instead of delivering them by hand.

Registration and access

Non-Disclosure Agreement (Eskom template 240-63152171 Rev 5)

• Bidders must sign Eskom's confidentiality agreement before any project information is disclosed.
• Confidential information may only be used for the project and must not be shared with third parties without Eskom's prior written consent; disclosure to employees, advisers and affiliates is allowed on a need-to-know basis provided they are bound by the same terms.
• The receiving party must protect the information to at least a reasonable standard of care and indemnify Eskom against losses caused by unauthorised use or disclosure.
• On Eskom's request, all material containing confidential information must be returned or destroyed and a written statement from a director or senior officer confirming this must be provided within 7 business days.
• The agreement runs for 3 years after the relationship between the parties ends.
• Breach that is not remedied within 7 business days of written notice entitles Eskom to pursue all legal remedies, including urgent proceedings and damages.
• The agreement is governed by South African law; neither party may assign rights without the other's written consent, and no public statements may be made without prior written consent.

Evidence may include a plant register, proof of ownership, lease or plant-hire agreements, hire quotations with a letter of intent, or other verifiable proof. Scoring 5 / 4 / 2 / 0.
• Method statement: detailed statement covering scope understanding, construction methodology, inspection and defect identification, concrete repair, structural steel repair and fabrication, building, roofing, plumbing, drainage, roads and stormwater works, excavation and demolition, sequencing, resource allocation, quality control and hold points, safety and permits, environmental controls, supervision, emergency response in a live plant, shutdown programme, and testing, commissioning and handover. Scoring 5 / 4 / 2 / 0.
• Relevant company experience: at least two similar contracts completed in the last five years, with project name, client, description, project cost, start and end dates, signed appointment letter and reference person's details. Scoring: two qualifying contracts 5; one qualifying contract 4; relevant work without appointment letter or details 2; none or irrelevant 0.
• Quality management and control: quality policy or plan, project-specific QC methodology, ITPs or QCPs, inspection and testing procedures, material control and traceability, non-conformance management, welding procedures and welder qualifications, concrete testing procedures, and quality personnel details. Scoring 5 / 4 / 2 / 0.
• SAQCC Fire registration and experience: valid registration with 5 or more years' experience scores 5; 2 to 4 years scores 4; under 2 years or no experience scores 2; no submission scores 0.

Minimum qualifying score

• Functionality threshold: 70%. Bidders below the threshold are disqualified.

Price

• Scored out of 80 or 90 points, inclusive of VAT, corrected for arithmetic errors, excluding contingencies in bills of quantities or activity schedules, and adjusted for acceptable variations.
• Net present value comparison of adjusted tenders based on the tendered programme and prices, price adjustment factors, exchange rate movements and other risk parameters.
• Unconditional discounts count for evaluation; conditional discounts do not, but apply at payment.

Specific goals

• Scored out of 20 or 10 points under the PPPFA. No evidence of a claim means zero points for that goal, not disqualification.

Ranking

• Price and specific goal scores are added and bidders ranked highest to lowest under the 90/10 or 80/20 system. Where the applicable system is uncertain, the lowest acceptable tender determines it.

• Eskom may award to a bidder other than the highest scorer where objective criteria justify it. Skills development objective criteria apply: CIDB compulsory training and a Construction Skills Development Goal (CSDG) target of 0.25%.

• Provision of civil maintenance services at Kendal Power Station for a period of 5 (five) years.

• A detailed method statement is required covering scope understanding, construction methodology, inspection and defect identification, concrete repair, structural steel work, building, roofing, plumbing, drainage, roads and stormwater, excavation and demolition, sequencing, resource allocation, quality control and hold points, safety and permits, environmental controls and housekeeping, supervision and coordination, emergency response and operational interface in a live plant, shutdown or critical-work programme, and testing, commissioning, close-out, handover and reinstatement.

Cataloguing

• The successful bidder may have to provide cataloguing information per item after award and must label all materials to Eskom's labelling specification. Where cataloguing applies, the Pricing Schedule must include a line item for it; Eskom pays for cataloguing.

A detailed method statement is required, showing understanding of the full scope and the approach to executing the works safely and effectively in an operating power station.

• At least two similar-scope contracts completed successfully in the last five years, supported by traceable references.
• Each reference must give the project name, client, description of work performed, project cost for the scope performed, project start and end dates, a signed appointment letter, and the name, designation and contact number of a reference person.
• Scoring: two qualifying contracts 5; one qualifying contract 4; relevant contracts without appointment letter or work details 2; no relevant experience 0.

SAQCC Fire

• Valid SAQCC Fire registration and experience in fire-related works within the scope, where required.

Quality Category 1 requirements

• A valid ISO 9001:2015 certificate (latest applicable revision).
• Latest internal and external management system audit reports, including any non-conformities and the resulting corrective actions.
• A draft contract quality plan specific to the scope, meeting ISO 10005 minimum requirements.
• A draft or example Inspection and Test Plan (ITP) or Quality Control Plan (QCP) from similar or previous work.
• Documented information for control of externally provided processes, products and services.

• Financial analysis is compulsory as a contractual requirement for CIDB-related transactions from R30 000 excluding VAT.
• Latest approved annual financial statements of the tendering company (not the parent or ultimate holding company) are required, including the director's report, auditor's/reviewer's/compiler's report, statement of financial position, statement of comprehensive income, statement of changes in equity, statement of cash flows and notes. Draft statements and management accounts are not accepted.
• South African entities that are not audited must also submit a signed public interest score showing the actual score, whether the company is owner managed, and whether the statements were externally prepared, plus ITA34C copies for the current and previous years of assessment.
• Each partner in an unincorporated JV or SPV must submit its own annual financial statements with the same items.

Contract skills development

• A Construction Skills Development Goal (CSDG) of 0.25% applies to the CE class of works and is carried in the pricing schedule.

Eligibility

• Open Invitation to Tender; the tender is for the whole of the contract.
• Bidders, or any of their principals, must not be restricted from doing business with Eskom or other state-owned companies.
• Bidders may not have the nationality of a country on any international sanctions list; this also applies to proposed subcontractors and suppliers.
• A bidder may not submit more than one tender, individually or as a JV/consortium partner.
• A JV or consortium agreement must state that the parties are jointly and severally liable for the contract.
• Bidders with a conflict of interest are disqualified, including a controlling partner or majority shareholder in common, or a relationship giving access to information about, or influence over, another bidder's tender or Eskom's decisions.
• Tenders signed by unauthorised persons are rejected.
• Bidders restricted by National Treasury, on the Tender Defaulters list, or restricted by Eskom (including directors) are ineligible.
• Subcontracting 100% of the scope of work is not permitted.

CIDB

• Minimum grading: CIDB 7CE or higher.
• Joint ventures: every member must be registered with the CIDB; the lead partner must hold a CE class grading, or not lower than one level below the required grading, with the required recognition status; and the combined grading must meet or exceed the designation for the sum tendered.
• Bidders must be registered with the CIDB, or capable of registration within 21 working days of the closing date, in the stipulated grading.

CSD and tax

• CSD registration is a mandatory contractual requirement.
• A certified tax clearance certificate is required from foreign bidders with a South African footprint that are not on CSD and have no SARS pin, and from local bidders without a SARS e-filing PIN or CSD profile/number. Foreign suppliers with no South African footprint complete SBD 1 but need no tax compliance proof.

B-bbee

• Preference points are claimed on SBD 6.1 under the PPPFA 2022 regulations, scored out of 20 or 10 points.
• Proof of B-BBEE status is a certificate from an authorised body, a sworn affidavit under the B-BBEE Codes of Good Practice, or another prescribed requirement.
• Failure to submit proof of a specific goal claim does not disqualify the bid but scores zero for that goal.

Employment equity

• Designated employers must provide proof of compliance with the Employment Equity Act, including proof of submission of the Employment Equity report to the Department of Labour (South African bidders only).

Safety and quality

• COIDA letter of good standing (original certificate or proof of application) from the Compensation Fund or a licensed insurer (South African bidders only).
• Occupational health and safety documents as required by the scope; the scope is classified high risk and is evaluated against Annexure C1 (7 criteria).
• SHE returnables include the SHE Plan, SHE costing, baseline risk assessment, letter of good standing, SHE policy and SHE competencies. Work may only start once the SHE file is approved.
• Quality Category 1 applies: a valid ISO 9001:2015 certificate, latest internal and external audit reports, a draft contract quality plan meeting ISO 10005, an example ITP or QCP, documented control of externally provided processes, roles and responsibilities documentation, and management review records.
• Environmental returnables: ISO 14001:2015 environmental policy, a signed site-specific Environmental Management Plan, an emergency preparedness plan and a waste management plan.

Other

• Main contractors are discouraged from subcontracting to their own subsidiaries; any such subcontract must be declared in the tender.
• Contractual requirements are assessed after evaluation and ranking; proof must be submitted before award, and failure to meet them by the deadline may render the bid non-responsive.

Specific goals are scored out of 20 or 10 points under the PPPFA, within the 90/10 or 80/20 preference point system.

Proof of B-BBEE status level means a B-BBEE status level certificate issued by an authorised body or person, a sworn affidavit under the B-BBEE Codes of Good Practice, or another requirement prescribed under the Broad-Based Black Economic Empowerment Act.

Failure to submit proof of a specific goal claim does not disqualify the bid but scores zero for that goal.

Main contractors and suppliers are discouraged from subcontracting to their own subsidiaries, as this may be treated as subcontracting with themselves or as fronting. Any subcontract to a subsidiary must be declared in the tender. A list of potential subcontractors can be drawn from www.csd.gov.za.

The scope is classified high risk and compliance is evaluated against Annexure C1 (7 criteria).

Contract form: NEC3 TSC3.

• Contract Participation Goals are not applicable.

• Where CSDG applies, the recommended supplier must submit the Targeted Enterprise Declaration Affidavit, Project Interim Report, Project Completion Report and Declaration after award, as required by the Standard for Indirect Targeting for Enterprise Development through Construction Works Contract (GN 1779, Government Gazette, April 2023).
• Where a performance bond or demand guarantee is required, the bidder must nominate at least two Eskom-approved financial institutions.
• Payment: within 30 days of undisputed invoices; within 60 days for contracts above R50 000 000 including VAT.
• Eskom may negotiate with preferred bidders if tendered prices are not market-related.
• Bidders with the nationality of a sanctioned country are ineligible; this extends to proposed subcontractors and suppliers.

Eligibility

• Open to a single company or an incorporated or unincorporated joint venture or consortium meeting the eligibility criteria in the Tender Data.

Basic compliance

• Meet the eligibility criteria.
• Submit a complete tender with commercial, financial and technical information.
• Submit the mandatory commercial returnables by the stipulated deadlines.
• For e-tendering, failure to upload the tender documents renders the tender non-responsive.

Contractual requirements

• Mandatory: CSD registration.
• May also apply: SHEQ requirements; financial viability with submission of financial statements, compulsory for CIDB-related transactions from R30 000 excluding VAT; and any other requirement stipulated.

Functionality applies, with five criteria each weighted 20%: plant and equipment availability; a detailed method statement; relevant company experience; quality management and control; and SAQCC Fire registration and experience. The functionality threshold is 70%; bidders below it are disqualified.

Price is scored out of 80 or 90 points, inclusive of VAT, corrected for arithmetic errors, excluding contingencies, and adjusted for acceptable variations. Net present value comparison applies, based on the tendered programme and prices, price adjustment factors, exchange rate movements and other risk parameters. Unconditional discounts count for evaluation; conditional discounts do not, but apply at payment.

Specific goals are scored out of 20 or 10 points under the PPPFA. Missing evidence of a claim scores zero for that goal without disqualification.

Ranking adds price and specific goal scores and orders bidders highest to lowest under the 90/10 or 80/20 system; where the applicable system is uncertain, the lowest acceptable tender determines it. Objective criteria apply, allowing Eskom to award to a bidder other than the highest scorer. Skills development objective criteria are CIDB compulsory training and a CSDG target of 0.25%. Reverse e-auction is not applicable, alternative tenders are not allowed, there is no public opening and prices are not read out.
