Bidders are required to submit:

• One original

Submissions must be hand-delivered to:

The envelope must be endorsed with:

• Bid number: EWSETA/RFP/002/2026-27
• Title of the bid
• Name of the bidder/Company.

Proposals must be submitted in two (2) sealed envelopes:

Envelope 1: Technical Proposal (Clearly marked with bidder's name, contact details, company address, closing date, and titled 'Technical Proposal for EWSETA Tender No.: EWSETA/RFP/002/2026-27').

Envelope 2: Price Proposal (Clearly marked with bidder's name, contact details, company address, closing date, and titled 'Price Proposal for EWSETA Tender No.: EWSETA/RFP/002/2026-27').

Late bids will not be considered.

Bids must be submitted on the official forms provided or in the manner prescribed in the bid document.

Risks:

• Failure to submit mandatory requirements will result in disqualification.
• Late bids will not be considered.
• Plagiarism will result in disqualification and potential legal ramifications.
• Failure to provide requested clarification within 48 hours may lead to disqualification.
• Failure to comply with tax obligations at the time of award will result in disqualification.

The tender will be evaluated in four (4) stages:

STAGE 1: Mandatory Requirements

• Proof of registration with the Property Practitioners Regulatory Authority (PPRA).
• Valid relevant professional accreditation/registration as an auctioneer.
• Valid proof of professional indemnity (R10 million) and public liability insurance (R5 million).
• Proof of compliance with applicable Consumer Protection Act (CPA) obligations.

Failure to submit these documents will result in disqualification.

STAGE 2: Pre-Qualification Criteria / Returnable Administrative Documents

• Company Registration Documents (CIPC).
• Declaration that the company or its directors are not listed on the National Treasury Database of Restricted Suppliers or Register of Tender Defaulters.
• CSD (Central Supplier Database) Report / Number.
• Joint Venture Agreement, if applicable.
• Valid B-BBEE Certificate (SANAS accredited) or B-BBEE Affidavit (EME's/QSE's). For JVs, a consolidated certificate/affidavit is required.
• Completed and signed Standard Bidding Documents (SBD): SBD 1, SBD 3.3, SBD 6.1, SBD 4.
• Annexure 5 - General Conditions of Purchase (fully signed and initialled).
• Annexure 6 - POPI Consent forms (signed by all parties in case of JV).
• Tax Pin issued by SARS (Tax Clearance Certificate). For JVs, tax pins for each member are required.

Note: Failure to attach administrative documents at this stage will not lead to disqualification, but they will be required prior to award. If a bidder is a Consortium, Joint Venture, or Prime Contractor with Subcontractor(s), all administrative documents must be submitted for each party.

STAGE 3: Technical/Functionality Evaluation

• Minimum qualifying score for functionality is 70 points out of 100.
• Evaluation Criteria:
• Reference letters for Commercial Property Auction conducted (Weighted: 30 points)
• Company Profile Experience (10+ years in Property Auctions: 10 points; 5-9 years: 8 points; <5 years: 6 points; No experience: 0 points) (Weighted: 10 points)
• Qualified and Experienced Auctioneer with Adequate Support Team (Highly experienced with proven track record, qualified team: 20 points; Experienced with competent team: 10 points; No evidence: 0 points) (Weighted: 20 points)
• Auction Methodology (Pre-Auction Preparation, Bidders Management, Project Plan Auction Executions, Post Auction Process) (Weighted: 40 points)

STAGE 4: Price and Specific Goals

• Price: 80 points
• Specific Goals (B-BBEE Status Level Contribution): 20 points

B-BBEE Status Level Contribution Points (80/20 system):

• Level 1: 20 points
• Level 2: 18 points
• Level 3: 14 points
• Level 4: 12 points
• Level 5: 8 points
• Level 6: 6 points
• Level 7: 4 points
• Level 8: 2 points
• Non-compliant contributor: 0 points

Bidders must submit valid B-BBEE certificates/affidavits. Failure to submit proof will result in 0 points for B-BBEE. For JVs, a consolidated certificate is required. Sub-contracting more than 25% to an enterprise not qualifying for equal or higher points may affect B-BBEE points.

The appointed auctioneer will be required to:

• Conduct a market assessment and recommend a reserve price.
• Develop and implement a comprehensive marketing and advertising strategy.
• Facilitate and manage the public auction process in accordance with legislation.
• Ensure compliance with the Consumer Protection Act (CPA) and auction regulations.
• Manage bidder registration, including FICA compliance and deposit requirements.
• Provide professional advice on optimal auction timing and conditions of sale.
• Submit a detailed post-auction report (attendance, bids received, outcome).
• Liaise with appointed conveyancers/attorneys for the transfer process.

Pricing Structure Requirements:

• Clearly disclose commission percentage on the final sale price.
• Clearly disclose any fixed costs (e.g., advertising/marketing).
• Clearly disclose any additional disbursements (if applicable).
• All fees must be stated as inclusive or exclusive of VAT.
• No hidden costs or buyer charges will be accepted unless expressly approved in writing by EWSETA.

NB: More details will be provided at the compulsory briefing/site inspection.

Financial proposals must be submitted in a separate envelope and clearly marked 'Financial Proposal'.

Bidders are required to submit financial proposals as per the table below on a company letterhead:

• Commission percentage on final sale price.
• Marketing/Advertising Costs (Incl. VAT) (R).
• Additional Approved Disbursements (R).
• TOTAL FIXED COSTS (Excluding Commissions) (R).

NB: Commission shall only be calculated on the final accepted sale price of the property.

Pricing schedule is compulsory and failure to complete it as prescribed, or with alterations, may result in disqualification.

Only firm prices will be accepted. Non-firm prices (e.g., subject to exchange rate variations) will not be considered.

For VAT-registered vendors, bids submitted without VAT may be disqualified. Bidders must declare their VAT status and provide a VAT registration number if applicable.

EWSETA will not make upfront payments.

SBD 3.3 (Pricing Schedule: Professional Services) must be completed, including:

• Ceiling price for the total estimated cost.
• Persons involved, rates, and phases of the project.
• Travel and other expenses (with proof).
• Estimated man-days for project completion.
• Confirmation if rates are firm for the full contract period.

Bidders must comply with the following:

• Tax Compliance: Prospective bidders must ensure their tax matters are in order with SARS and reflected on CSD. Tax matters must be in order at the time of award. A Tax Clearance Certificate or PIN from SARS is required. For JVs, each party must submit a separate TCS certificate/PIN/CSD number.
• CSD Registration: Bidders must be registered on the Central Supplier Database (CSD).
• B-BBEE: Submit a valid B-BBEE Status Level Verification Certificate or affidavit. (See Evaluation Criteria for details).
• Company Registration: Provide CIPC documents.
• Legal Compliance: Declare that neither the company nor its directors are listed on the National Treasury Database of Restricted Suppliers or Register of Tender Defaulters.
• Professional Registrations: Proof of registration with the Property Practitioners Regulatory Authority (PPRA) and valid professional accreditation/registration as an auctioneer.
• Insurance: Valid professional indemnity (R10 million) and public liability insurance (R5 million).
• Consumer Protection Act (CPA): Proof of compliance with CPA obligations.
• Standard Bidding Documents (SBDs): Complete and sign SBD 1, SBD 3.3, SBD 6.1, and SBD 4.
• General Conditions of Purchase: Sign Annexure 5.
• POPI Act: Complete Annexure 6 (POPI Consent forms).
• Ethical Conduct: Bidders must commit to ethical conduct and confirm they have not engaged in fronting, collusion, or corrupt practices.
• Service of the State: No bids will be considered from persons in the service of the state, companies with directors who are persons in the service of the state, or close corporations with members who are persons in the service of the state.
• Sub-contracting: If sub-contracting more than 25% of the contract value, the sub-contractor must qualify for at least the same B-BBEE points as the bidder, unless the sub-contractor is an EME with the capability to execute the sub-contract.
