Scope: Purchase, collect, and removal of scrap ferrous material at Hendrina Power Station under a 6-month contract.

Key Requirements:

• Strict adherence to Eskom’s Life-Saving Rules, including: electrical safety (OPEN, ISOLATE, TEST, EARTH, BOND, INSULATE BEFORE TOUCH), working at heights (HOOK UP AT HEIGHTS), seatbelt use (BUCKLE UP), sobriety (BE SOBER), and permit-to-work (PTW) compliance.
• Zero tolerance for violations; disciplinary action applies to contractors and their employees.
• Contractors must ensure employees are trained, medically fit (where applicable), and use approved PPE and safety systems.
• Pre-task risk assessments and permits are mandatory for high-risk activities.
• Contractors must investigate violations within 5 working days and provide Eskom with disciplinary outcomes.

Mandatory Compliance:

• Adherence to Eskom’s Safety, Health, Environment, and Quality (SHEQ) policies and standards.
• Compliance with Occupational Health and Safety Act and other referenced legislation (e.g., National Road Traffic Act, Plant Safety Regulations).
• Contractors and all employees must sign acknowledgment of Life-Saving Rules.
• Disciplinary procedures must align with Eskom’s Disciplinary Code and Procedure for violations.
• Contractors must immediately suspend and remove employees violating Life-Saving Rules from site.

• Closing date and time: As specified in the Tender Data (South African Standard Time, GMT+2).
• Compulsory site visit/clarification meeting: Date, time, and venue are stated in the Tender Data. Attendance is mandatory; failure to attend results in disqualification.
• Addenda/extensions: Check the Eskom Tender Bulletin and NT e-Tender Portal regularly for updates, clarifications, or extensions to the closing date.

• Eligibility: Tenderer must comply with criteria stated in the Tender Data and not be restricted from doing business with Eskom or State-Owned Companies.
• Automatic disqualification: Subcontracting 100% of the scope of work, late submission, missing mandatory returnables, or failure to attend compulsory site visits/clarification meetings.
• Pre-qualification: Must meet basic compliance (e.g., original and copy tender submission) and mandatory tender returnables. No double-dipping of criteria across evaluation phases.
• Functionality: If applicable, must meet the minimum threshold stated in the Tender Data to proceed to further evaluation.

• Price Evaluation: Evaluated per Tender Data criteria. Factors include CPA, FOREX, commodity exposure, discounts, technical adjustments, PV, and forecasted invoicing rates.
• Arithmetical Errors: Eskom will correct errors (e.g., decimal misplacement, addition errors). Tenderer must confirm or accept corrections; failure to do so may lead to rejection.
• Ranking: Tenders are ranked by combining Price and Specific Goals scores (PPPFA 90/10 or 80/20 system).
• Objective Criteria: Contracts may be awarded to non-highest scorers only if stipulated in the Invitation to Tender (per PPPFA Section 2(1)(f)). Functionality and B-BBEE cannot be used as Objective Criteria.

• Pricing: Include all duties, taxes (including VAT), and levies applicable 14 days prior to the closing date in your rates and prices.
• Fixed Prices: Rates and prices must be fixed for the contract duration unless otherwise stated in the Invitation to Tender.
• Currency: State rates and prices in South African Rand (ZAR) unless instructed otherwise. Exchange rates must align with the base date stipulated in the Invitation to Tender.
• Performance Security: If required, indicate at least two (2) financial institutions you may approach for security. Eskom reserves the right to reject unsuitable institutions.

Evaluation will assess: 1. Understanding and capability to comply with Eskom’s OHS requirements and relevant South African legislation. 2. Processes for selecting and managing competent subcontractors. 3. Resources to ensure all personnel undergo Eskom induction. 4. Track record of similar work (Eskom may request testimonials/references). 5. Authorized company representative to sign the OHS acknowledgement.

Main supplier responsibilities: 1. Demonstrate to Eskom the process and selection criteria for appointing contractors/suppliers. 2. Notify Eskom prior to appointing any contractors/suppliers. 3. Ensure contractors/suppliers have adequate resources and competencies. 4. Manage contractors/suppliers to ensure compliance with legal and Eskom requirements. 5. Monitor contractors/suppliers via OHS audits and assessments during work execution. 6. Provide grounds for terminating work by contractors/suppliers. 7. Handle all non-conformances by contractors/suppliers directly. 8. Eskom may verify capabilities and request testimonials/references for similar work.

Mandatory compliance: 1. Eskom contractor Health and Safety requirements standards 32-136. 2. OHS specifications/requirements provided by Eskom. 3. Occupational Health and Safety Act. 4. Compensation for Occupational Diseases and Illnesses Act. Post-award: Align company processes to Eskom’s OHS policies, procedures, and standards. Penalties apply for non-conformance. All employees (including contractors/suppliers) must undergo Eskom induction. Signed 'Annexure B' acknowledgement form is mandatory.

Mandatory returnable: Submit the fully completed E-Tendering Training Acknowledgement Form to Eskom within the prescribed period. Failure to submit or incomplete submission will disqualify the tenderer. General requirements:

• Must be a registered legal entity (supplier, vendor, contractor, or consultant).
• Provide proof of valid tax clearance certificate and CIPC registration (for South African entities).
• Demonstrate experience in scrap ferrous material handling/removal (preferably in power stations or industrial sites).
• Show financial and technical capacity to execute the contract (e.g., equipment, workforce, logistics).

SHE Compliance:

• No prior major SHE non-compliance with Eskom or regulatory bodies.
• Provide evidence of past SHE performance (e.g., incident rates, audit reports).
• Appoint competent health and safety officers (as per OHS Act and MHS Act).
• Comply with Eskom’s SHE Requirements for Commercial Processes (32-726).

Technical:

• Access to appropriate equipment (e.g., cranes, transport vehicles, cutting tools) for scrap removal.
• Ability to segregate, handle, and transport ferrous scrap safely and efficiently.
• Knowledge of Eskom’s site-specific hazards (e.g., electrical, chemical, or structural risks at Hendrina Power Station).

Scope and Responsibilities:

• Contractors must execute work safely on site, preventing injury to employees, the public, and environmental damage.
• Contractors must comply with all applicable occupational health and safety legislative requirements and Eskom policies/procedures.

SHE Requirements:

• Develop and implement a SHE management system appropriate to the service provided and legal requirements.
• Ensure employees and subcontractors comply with SHE statutory requirements.
• Use correct procedures, safe systems of work, and provide adequate instruction, training, and supervision.

Hazard Management:

• Conduct risk assessments for all work, including high-risk tasks, and maintain written safe work procedures.
• Identify and control hazards specific to scrap ferrous material handling (e.g., sharp edges, heavy loads, site-specific risks at Hendrina Power Station).
• Maintain updated risk assessments and review them periodically or when changes occur.

Equipment and Standards:

• Ensure all machinery, tools, equipment, and PPE meet legislative and SANS standards.
• Use equipment conforming to manufacturer safety requirements, even if reclaimed.

SHE Documentation:

• Prepare and submit a project-specific SHE plan and SHE file for approval before work commences.
• Keep SHE files for the project duration and hand them over to Eskom for archiving upon completion.

Training and Communication:

• Provide induction and site-specific training for all employees.
• Appoint health and safety representatives where required.
• Conduct toolbox talks to ensure common understanding of tasks, risks, and control measures.

Emergency and Health:

• Have emergency preparedness plans, including fire safety and first-aid.
• Manage occupational health hazards (e.g., noise, dust, asbestos, thermal conditions).
• Comply with Eskom’s Life-Saving Rules: Open, Isolate, Test, Earth, Bond/Insulate before Touch; Hook up at Heights; Buckle Up; Be Sober; Ensure Permit to Work.

Record Keeping:

• Maintain records for auditing or inspection purposes, including incident reports, risk assessments, and training records.

Legislative Compliance:

• Comply with the Occupational Health and Safety Act, 1993 (OHS Act) and its regulations.
• Comply with all relevant South African legislation at national, provincial, and municipal levels (e.g., Mine Health and Safety Act, National Environmental Management Act).
• Adhere to Eskom’s Safety, Health, Environment and Quality Policy.

Professional and Statutory Registrations:

• Ensure professional registrations (e.g., SACPCMP) for construction project management, construction management, and construction health and safety where required.
• Appoint competent health and safety officers as per OHS Act (Construction Regulation 8(5)) and MHS Act, registered with a statutory body approved by the Chief Inspector.

SHE Management:

• Implement a SHE management system demonstrating compliance with legal and Eskom requirements.
• Maintain SHE files and records for auditing by Eskom or regulatory bodies.

Reporting:

• Report OHS statistics monthly to Eskom, including incidents, near-misses, and manpower data.
• Cooperate with Eskom’s health and safety departments and allow inspections/audits.

Appointments and Agreements:

• Make statutory and non-statutory appointments as required by Eskom standards (e.g., 32-296 for SHE roles).
• Sign a Section 37(2) agreement of the OHS Act if working in a joint venture or multi-contractor environment.

Disciplinary and Enforcement:

Key requirements: (1) Each load must be weighed at Hendrina Power Station weighbridge or nearest acceptable facility, witnessed and signed by an Eskom representative. (2) Purchaser must provide weighbridge documentation copy to Eskom Investment Recovery Officer. (3) Maintain collection registers for reconciliation with Eskom. (4) Payment based on Monthly ITAC Metal Bulletin price as per offer percentage. (5) Buyer must inspect scrap condition before tendering; disputes post-closing not accepted. (6) Collection of non-ferrous material is prohibited. (7) All ferrous scrap identified by Eskom representative. (8) Contract may be terminated anytime within the 6-month period.
