Contract start date: Upon signing of the contract by ACSA. Completion date: 36 months from contract start date. Assessment interval for payments: Ends and starts at 12h00 on the 25th day of each successive month. Defects period: 6 months after completion of each service. Submit the following returnable documents with your offer: signed Form of Offer and Acceptance, Pricing Schedule (Part C2), Schedule of Deviations (if applicable), proof of insurance, securities, bonds, and guarantees. The Offer must be signed by a duly authorised representative. The contract is binding upon receipt of the signed agreement by the tenderer, unless rejected in writing within 5 working days. Within 2 weeks of receiving the signed agreement, deliver all required securities, bonds, guarantees, and proof of insurance to the Employer’s Agent. Failure to do so constitutes a repudiation of the agreement.

General: Must be a legally registered entity in South Africa (registration number required). Must have a valid tax clearance certificate. Must comply with all South African labour laws and regulations. Technical: Proven experience in stormwater and drainage maintenance, preferably in airport environments. Capability to manage airside and landside operations with minimal disruption to airport activities. Access to qualified personnel (e.g., engineers, OHS practitioners) and necessary equipment. Ability to develop and implement SHE plans, risk assessments, and emergency response procedures. Financial: Financial stability to fulfill contract obligations over 36 months. Ability to provide required securities, bonds, and guarantees (e.g., performance bond, advance payment guarantee). Compliance with ACSA’s insurance requirements (e.g., public liability, professional indemnity). B-BBEE: Must submit a valid B-BBEE Certificate annually; non-compliance may lead to contract termination. OHS: Must have a clean OHS record and comply with the OHS Act, Construction Regulations 2014, and COID Act. Must appoint competent OHS personnel (e.g., Section 16(2) appointees) and provide training for employees. Must have a valid Letter of Good Standing with the Compensation Fund or a licensed insurer.

Scope: Landside and airside stormwater and drain maintenance at Chief Dawid Stuurman International Airport (CDSIA) for 36 months. Key deliverables: Baseline risk assessment before commencement. Detailed emergency response procedure. Appointment of competent persons per Section 16(2) of the OHS Act. Full-time dedicated Health and Safety resource for projects with 5+ personnel. Compliance with ACSA’s SHE (Safety, Health, and Environment) requirements. Adherence to permit-to-work systems. Maintenance of hygiene, cleanliness, and PPE compliance. Subcontractors must meet all ACSA requirements and have approved SHE files. Work must not commence without a valid permit where required. Risk Register: Must include environmental safety risks, construction safety issues on airside, access to site, statutory and ACSA approvals, site constraints, and impact on operations.

Pricing: Total offered prices must be inclusive of VAT and stated in the Pricing Schedule (Part C2). Payment terms: Invoices assessed monthly (interval ends/starts at 12h00 on the 25th of each month). Payment period: 4 weeks after receipt of tax invoice. Currency: South African Rand (ZAR). Interest rate: Prime lending rate of Standard Bank at any given time. Bonds/guarantees: Proforma guarantees and securities must be provided as specified in Contract Data (Part C1.3c). Delay damages: 2% per day (max 10% of contract value) for late completion. Insurance: Public Liability Insurance and other covers as specified in the Main Contract (Part C1.3b and ACSA Insurance Clauses).

Mandatory compliance: Valid B-BBEE certificate (annual submission required; non-compliance may result in contract cancellation). Occupational Health and Safety: Written agreement per Section 37(2) of the OHS Act and Construction Regulation 5.1(k) must be concluded before work commences. COID Act compliance: Letter of Good Standing with Compensation Fund or Licensed Insurer required prior to starting work. SHE File: Submit all documentation per SHE File Index to ACSA 7 days prior to starting work. Ethics: Compliance with Prevention and Combating of Corrupt Activities Act; no cession, delegation, or assignment of rights without ACSA’s written consent. Confidentiality: All contract-related information is confidential; prior written consent required for disclosure. Intellectual Property: IP rights remain with the originator; ACSA granted a royalty-free licence for use. Substance abuse: Compliance with ACSA’s Substance Abuse Policy; testing may be conducted at entry points. PPE: Must provide and enforce use of adequate PPE per General Safety Regulation 2(1) of the OHS Act.
