• Joint ventures must submit a notarially certified copy of the joint venture agreement and authorization certificates.
• Sign the bid with proof of authority (e.g., company resolution for companies, or power of attorney for individuals).

Disqualification risks:

• Failure to submit required forms (SBD 1, SBD 3.1, SBD 4, SBD 6.1).
• Missing or incomplete information in bid documents.
• Late submission.
• Bids from persons in the service of the state, or entities with directors/members in the service of the state, will not be considered.

Evaluation is conducted in four phases:

Phase 1: Mandatory Requirements

• Failure to submit any required document/information in Table 1 (e.g., active CIDB Contractor’s Listing for CE level 2 or higher) will disqualify your bid.

Phase 2: Administrative Compliance

• Must comply with all criteria in Table 2, including:
• Registration on National Treasury’s Central Supplier Database (CSD) with a submitted CSD report.
• Tax compliance with SARS (valid TCS PIN or printed TCS certificate).
• Active CIPC registration (copy of CIPC/CIPRO certificate required).
• Valid B-BBEE Status Level Verification Certificate (or sworn affidavit for QSE/EME). Failure to submit this forfeits preferential points.
• Valid Letter of Good Standing with the Compensation Commissioner or third-party insurance registered with the FSCA.
• Compliance with DTIC’s minimum local content threshold for the geomembrane (complete Annexure C).
• Submission of SBD 1, SBD 3.1, SBD 4, SBD 6.1, and Technical Datasheet for the geomembrane.
• Proof of authority for the signatory (e.g., company resolution).

Phase 3: Technical Evaluation and Specification Compliance

• Only bidders passing Phase 1 and 2 are evaluated here.
• Must comply with technical specifications in Technical Information Section 3.2.14.
• Submit Technical Datasheet/Brochure for the geomembrane (Ref SBD 3.1).
• Failure to meet technical specifications will render the bid non-responsive.

Phase 4: Preference Points System (80/20)

• Maximum 80 points for price (lowest acceptable bid scores highest).
• Maximum 20 points for specific goals:
• Women Ownership: 5 points (pro-rata based on ownership percentage).
• Disability Ownership: 5 points (pro-rata based on ownership percentage).
• Youth Ownership: 5 points (pro-rata based on ownership percentage).
• Location of Enterprise in Northern Cape: 2 points (local = province of project).
• B-BBEE Status Level Contribution (Level 1 to 2 for QSE/EME): 3 points.
• Proof documents for specific goals (e.g., full CSD report, valid B-BBEE certificate) must be submitted. Failure to submit proof means no points are awarded for that goal.

Note: Bids not complying with mandatory or administrative requirements may be rejected without further evaluation.

Scope: Supply and installation of 0.9mm reinforced polypropylene geomembrane at the Namakwa Bulk Water Supply Project in the Northern Cape for Construction South.

Eligibility:

• Only bidders with a CIDB grading of 2CE or higher are eligible.

Requirements:

• Comply with technical specifications outlined in Technical Information Section 3.2.14.
• Submit a Technical Datasheet/Brochure for the 0.9mm Reinforced Polypropylene Geomembrane (Ref SBD 3.1). Clearly indicate the specific item if multiple items are listed.
• Ensure the geomembrane meets the minimum threshold percentage for local production and content as stipulated by the Department of Trade and Industry (dti).
• Complete Annexure C (Local Content Declaration - Summary Schedule).
• All bids must allow for all labour, materials, machinery, and everything necessary for execution and completion of the contract.

Pricing and payment:

• Complete Section 4 of the bid document and the Pricing Schedule. Failure to do so will invalidate your bid.
• All payments will be made via Electronic Fund Transfer (EFT).
• Include all costs for labour, materials, machinery, and any other requirements for execution and completion of the contract in your bid.
• The Department will not be liable for any expenses incurred in preparing and submitting bids.

Note: Pricing must align with the official forms and schedules provided. No alterations to the Pricing Schedule are permitted.

Mandatory compliance requirements:

• CIDB Grading: Must be 2CE or higher. Submit a printed copy of your active CIDB Contractor’s Listing from www.cidb.org.za. If registration expires within 21 days after the tender closing date, attach proof of re-registration application.
• Central Supplier Database (CSD): Must be registered. Submit a CSD report and CSD number.
• Tax Compliance: Must be tax compliant with SARS. Submit a Tax Compliance Status (TCS) PIN or a printed TCS certificate. Apply for a TCS PIN via e-filing at www.sars.gov.za if not already obtained. For consortia, joint ventures, or sub-contractors, each party must submit a separate TCS certificate, PIN, or CSD number.
• CIPC Registration: Must be actively registered with the Companies and Intellectual Property Commission (CIPC). Submit a copy of your CIPC/CIPRO certificate.
• B-BBEE: Submit an original or certified copy of your B-BBEE Status Level Verification Certificate. Failure to submit this will forfeit preferential points.
• Compensation Commissioner: Submit a valid Letter of Good Standing with the Compensation Commissioner or proof of third-party insurance registered with the Financial Sector Conduct Authority (FSCA).
• Local Content: Comply with the minimum threshold percentage for local production and content for the 0.9mm Reinforced Polypropylene Geomembrane as stipulated by the Department of Trade and Industry (dti). Complete Annexure C (Local Content Declaration).
• Declaration of Interest: Complete and submit SBD 4 (Declaration of Interest). Ensure no conflicts of interest with state employees or related enterprises.
• Preference Points: Complete and submit SBD 6.1 (Preference Points Claim Form) to claim points for specific goals.

Disqualification:

• Bids from persons in the service of the state, companies with directors in the service of the state, or close corporations with members in the service of the state will not be considered.
• Failure to comply with any of the above requirements may render your bid invalid.
• Bidders listed on the Register for Tender Defaulters or the List of Restricted Suppliers will be automatically disqualified.

Contract governance:

• Governed by the National Treasury General Conditions of Contract (NTGCC), attached to the bid document. Special Conditions of Contract (SCC) may supplement or override the NTGCC where applicable.

Key terms:

• Contract price: Price payable for full and proper performance of contractual obligations.
• Delivery: Must comply with contract conditions. Supplier bears all risks and charges until delivery and a valid receipt is obtained.
• Payment: All payments via Electronic Fund Transfer (EFT).
• Force Majeure: Events beyond supplier’s control (e.g., wars, floods, epidemics) may excuse performance delays.
• Termination: Contract may be terminated for default, insolvency, or force majeure. Penalties may apply for delays.
• Dispute Resolution: Follows procedures outlined in the NTGCC.
• Liability: Purchaser’s liability is limited as per the NTGCC.
• Applicable Law: Governed by the laws of the Republic of South Africa.

Prohibitions:

• Corrupt practices (e.g., offering or soliciting anything of value to influence procurement or contract execution) are strictly prohibited.
• Fraudulent practices (e.g., misrepresentation of facts) will result in disqualification and potential legal action.
• Restrictive practices (e.g., collusive bidding) are prohibited and may be reported to the Competition Commission.
• Dumping and countervailing duties are addressed in the contract terms.

Additional obligations:

• Supplier must use contract documents and information solely for the contract purpose.
• Supplier must maintain required insurance.
• Subcontracting is allowed only with purchaser’s approval and must comply with contract terms.
