The supplier may not disclose contract documents or specifications without NRCS's prior written consent.
Any disclosed information remains NRCS's property and must be returned after contract completion.
NRCS may audit the supplier's records related to performance.
All pre-bidding testing is at the bidder's expense.
If inspection, testing, or analysis is required, the supplier must allow access; costs for compliant inspections are borne by NRCS, while costs for non-compliant inspections are borne by the supplier.
Non-conforming services may be rejected and must be replaced at the supplier's cost; NRCS may procure replacements at the supplier's expense if the supplier fails to do so.

B-BBEE: Submit a sworn affidavit or B-BBEE level verification certificate (Level 1-8) to claim preference points.
Foreign-based suppliers: Complete the questionnaire regarding RSA residency, branch presence, income source, and tax liability; attach proof where applicable.
No bids from persons in the service of the State, or companies with directors who are state employees, are accepted.
Failure to provide any required compliance documents results in immediate disqualification.
Bidders must declare no collusive arrangements, no unauthorized discussions with NRCS officials, and that all information is true. Suspicious bids may be reported to authorities and lead to a ban from public-sector contracts.
Contractual Terms

The contract duration is 24 months, subject to performance reviews and a signed Service Level Agreement.
The supplier must promptly notify NRCS in writing of any delay, its cause, and likely duration.
NRCS may extend the time for performance with or without penalties.
Penalties may be imposed for unjustified delays unless an extension is agreed without penalty.
NRCS retains the right to cancel the contract for breach of conditions.
All intellectual property rights arising from the project vest with NRCS.
The supplier must replace any assigned resource who leaves with a similarly qualified person, subject to NRCS approval.
Complete handover of accounts, assets, and documentation is required at contract end.
