1.1 The Provincial Treasury (PT) hereby invites bids for the appointment of a service provider to conduct
a 2 (two) year research study to optimise and enhance revenue sources within the province. The
study will focus on assessing and optimising existing sources of revenue, identifying additional and
new (viable) revenue sources and updating the previous Fuel Levy study.
1.2 The purpose is to ensure that all bidders have a clear understanding of the scope of work, submission
requirements, evaluation criteria, and contractual obligations that will govern this research
assignment.
1.3 The research project seeks to generate high-quality, evidence-based insights that will inform policy,
strategy, and decision-making within the specified domain. Bidders are therefore, expected to
demonstrate proven expertise in the relevant research area, methodological rigour, and the
capacity to deliver outputs within the stipulated timelines and budget.

4.2. Bidders must be registered on the Central Supplier Database (CSD) at the time of the award. Failure
to be actively registered on the CSD by the time of award will result in the disqualification of the bid.
4.3. If you wish to apply for CSD registration, suppliers may go to www.csd.gov.za to register.
4.4. Bidders must ensure that all the documentation on the CSD is updated, complete and valid.

6.4. Potential bidders are required to send any enquiries related to the bid in writing to the
abovementioned officials. All enquiries should be sent to the Department on or before the close of
business day, 10 August 2026.
6.5. Bidders should note that all questions received will be consolidated and responses will be sent to all
the bidders via e-Tender Portal.
7.1. Provincial Treasury may communicate with bidders for, among others, where bid clarity is sought, to
obtain information or to extend the validity period. Any communication either by an electronic mail
or letter or any other form of correspondence to any department official, department or a person
acting in an advisory capacity for the Provincial Treasury in respect of this bid between the closing
date and the award of the bid by the bidder is prohibited.
8.1 All bids are subject to the General Conditions of Contract of Government (GCC).
8.2 Bid documents will only be considered if received by the Department before the closing date and
time.
8.3 Late bids will not be accepted.
8.4 Please note:
a) It is the bidder’s responsibility to ensure that all the required documents of the bid are

8.5 Only offers from bidders who bid for a complete service covered all specified requirements will be

8.6 The Western Cape Provincial Treasury (WCPT) is not bound to accept any of the proposals submitted.
8.7 All bids submitted must remain valid for 90 days from date of submission.
8.8 The WCPT further reserves the right to request the bidders to deliver presentations to obtain more
clarity on bids submitted.
8.9 Information in substantiation of the proposals can at any point in time be verified by the WCPT during
the adjudication process. Any information provided will be treated with the utmost confidentiality.
8.10 Bidders may not contact the WCPT on any matter pertaining to their bid from the bid closure date
to the time the bid is awarded. Any effort by a bidder(s) to influence the bid evaluation, bid
comparisons or bid award decisions, in any manner, will result in rejection of the bid concerned.

8.11 All educational qualifications should be from a South African accredited institution. Qualifications
from foreign institutions must either be accredited by SAQA or evidence of SAQA application must
be provided. Full SAQA accreditation must be obtained prior to contract award.
8.12 Bidders must not have been convicted of criminal offence as per the Criminal Procedure Act and its amendments, and any other relevant legislation.
8.13 If the service provider will be insourcing or subcontracting resources, this must be clearly indicated
in the bid document. Bidders must disclose such information on their WCBD 6.1 form and provide the
sub-contractors information. (Please refer to section 9 of the WCBD 6.1 form).
8.14 Proof of qualifications, CVs, B-BBEE Certificate/Sworn Affidavit and Central Supplier Database (CSD)
Report of the insourcing/subcontracting resource/s must be submitted as part of the bid documents,
along with the requirements of the main resources.
8.15 The Department and the appointed service provider will enter into a formal Service Level Agreement
(SLA), which shall form part of the contract. The SLA will:
Address binding timelines, deadlines, and quality standards for all deliverables;
Include provisions for penalties, withholding of payment, or contract termination in case of non-
performance or substandard delivery;
Specifically cover Section B, Subsections 4 and 5 (ensure references match the TOR).
8.16 Acceptance of Contractual Conditions:
a) By submitting a bid, bidders are deemed to have read and understood the Terms of
Reference (ToR) and the General Conditions of Contract (GCC), which will form part of any
contract awarded.
b) The successful bidder will formally acknowledge and accept the ToR and GCC by signing
the contract.
c) Failure by the successful bidder to sign and return the contract within the stipulated
timeframe may result in withdrawal of the award and the Department proceeding to the
next ranked bidder or re-advertising the bid.
8.17 Discretion may be applied on immaterial cases such as minor administrative omissions (i.e failing to
initial every page, omission of signature on a non-mandatory form (where authority to sign is evident
elsewhere), and an immaterial spelling and/or formatting error), where the bidder’s intention to
comply is clearly evident, may be condoned at the sole discretion of the Department, provided that
such omissions are not material to the evaluation process. An immaterial omission or error is one
which has no impact on the content of the BID documentation. While the material takes into
consideration non-compliance to mandatory requirement.
9.1 The ownership of and all rights in and to intellectual property owned by either Party prior to the
commencement of the contract shall be and remain vested with the Party who, at the
commencement of the contract, is the owner thereof.
9.2 Subject to the provisions of clause 10.15.1, the successful bidder shall retain all intellectual property
rights in any materials and the like of whatsoever nature developed by it for the Western Cape
Government while rendering the services required in terms of the Terms of Reference (ToR). The
successful bidder shall, however, grant to the Western Cape Government, a perpetual, irrevocable,

world-wide, non-exclusive, and non-transferable royalty-free and fee-free license to use and adapt
the intellectual property in such materials/reports and the like for the purpose of any future
programmes that the Western Cape Government may require.
9.3 Ownership of all intellectual property in any reports that was specifically developed or generated by
the successful bidder for the Provincial Treasury pursuant to these Terms of Reference shall vest in
Provincial Treasury.
9.4 The successful bidder shall not use or allow any third party to use any of the documentation and
materials specifically developed by the successful bidder for and with input from the Western Cape
Government pursuant to these Terms of Reference without the prior written consent of the Provincial
Treasury.
9.5 All information and documentation provided to the successful bidder by the Western Cape
Government officials and/or municipalities in relation to and/or during the rendering of the services
referred to in these Terms of Reference must be kept confidential by the successful bidder, may not
be disclosed by the successful bidder to any third parties, unless prior written permission has been
obtained from the Provincial Treasury and subject to any conditions stipulated by the Provincial
Treasury.
9.6 The successful bidder/s hereby indemnifies the Provincial Treasury from and against any claim that
any material used by the successful bidder/s, in the course of providing the Services to the Provincial
Treasury pursuant to these Terms of Reference, infringes any third party’s intellectual property rights.
10.1 A trust, consortium, or joint venture will qualify for points for their B-BBEE status level as a legal entity.
10.2 A trust, consortium or joint venture will qualify for points for their B-BBEE status level as an
unincorporated entity, provided that the entity submits their consolidated B-BBEE scorecard as if they
were a group structure and that such a consolidated B-BBEE scorecard is prepared for every
separate bid.
10.3 Bidders must submit concrete proof of the existence of joint ventures or consortium arrangements.
Provincial Treasury will accept signed agreements as acceptable proof of the existence of a joint
venture or consortium arrangement.
10.4 The agreements must clearly set out:
The roles and responsibilities of the Lead Partner and the other parties;
Identification of the Lead Partner, who must have the authority to bind the other party/parties
in all matters relating to the JV/consortium;
Responsibilities for contractual obligations, deliverables, and communications with the

8.14 Proof of qualifications, CVs, B-BBEE Certificate/Sworn Affidavit and Central Supplier Database (CSD)
4.1 The goods supplied shall conform to the standards mentioned in the bidding documents and
specification.
5.1 The supplier shall not, without the purchaser’s prior written consent, disclose the contract, or any
provision thereof, or any specification, plan, drawing, pattern, sample, or information furnished by or
on behalf of the purchaser in connection therewith, to any person other than a person employed
by the supplier in the performance of the contract. Disclosure to any such employed person shall be
made in confidence and shall extend only so far as may be necessary for purposes of such
performance.
5.2 The supplier shall not, without the purchaser’s prior written consent, make use of any document or
information mentioned in GCC clause 5.1 except for purposes of performing the contract.
5.3 Any document, other than the contract itself mentioned in GCC clause 5.1 shall remain the property
of the purchaser and shall be returned (all copies) to the purchaser on completion of the supplier’s

1.14 “GCC” means the General Conditions of Contract.
1.15 “Goods” means all of the equipment, machinery and/or other materials that the supplier is required
to supply to the purchaser under the contract.
1.16 “Imported content” means that portion of the bidding price represented by the cost of components,
parts or materials which have been or are still to be imported (whether by the supplier or his
subcontractors) and which costs are inclusive of the costs abroad, plus freight and other direct
importation costs such as landing costs, dock dues, import duty, sales duty or other similar tax or duty
at the South African place of entry as well as transportation and handling charges to the factory in
the Republic where the supplies covered by the bid will be manufactured.
1.17 “Local content” means that portion of the bidding price which is not included in the imported
content provided that local manufacture does take place.
1.18 “Manufacture” means the production of products in a factory using labour, materials, components
and machinery and includes other related value-adding activities.
1.19 “Order” means an official written order issued for the supply of goods or works or the rendering of a
service.
1.20 “Project site” where applicable, means the place indicated in bidding documents.
1.21 “Purchaser” means the organisation purchasing the goods.
1.22 “Republic” means the Republic of South Africa.
1.23 “SCC” means the Special Conditions of Contract.
1.24 “Services” means those functional services ancillary to the supply of the goods, such as
transportation and any other incidental services, such as installation, commissioning, provision of
