Bids must be submitted in a sealed envelope marked with the tender number and description, and the bidder's name and address, deposited in the Tender Box at the Reception Area, 1st Floor, Joburg Theatre, 163 Civic Boulevard, Braamfontein, before 12:00 on the closing date. Bids will be evaluated in three stages: Stage 1 – Administrative Requirements, Stage 2 – Functionality, Stage 3 – Price and special goals. Functionality criteria include: company experience in supplying frozen foods, dry goods, consumables, and cleaning supplies to hotels, hospitality venues, large-scale casinos, banqueting departments, and high-end restaurants; compliance with food safety legislation and quality management systems; delivery capacity and fleet; human resources (qualified management, warehouse, drivers, logistics staff); and a detailed implementation and delivery plan. Bidders must provide examples or references of similar work. The bid is subject to the Preferential Procurement Policy Framework Act and the Preferential Procurement Regulations 2022. Bidders must be a single legal entity, not a front for another entity, and must be registered on the CSD. They must have a local office within the Johannesburg Municipality.

The scope of work is the supply and delivery of frozen foods, dry goods, consumables, and cleaning supplies to all designated Joburg City Theatres sites on an as-and-when-required basis for a period of 36 months. Products must comply with South African legislation, food safety standards, and relevant SANS specifications. The supplier must maintain cold-chain management for frozen and chilled products, supply products that are new, fresh, free from defects, and within acceptable shelf-life, and replace damaged, expired, contaminated, or incorrect products at no additional cost. The supplier must maintain sufficient stock levels, provide emergency deliveries, submit delivery notes and invoices with each delivery, and comply with all occupational health and safety, food hygiene, environmental, and municipal regulations. The supplier must provide dedicated customer support for order management, queries, complaints, and after-sales service. Delivery costs are deemed included in the bid price. Deliveries must be made within the turnaround time stipulated in the purchase order, and the supplier must notify JCT in writing of any delays. All products must be properly packaged, labelled, transported, and handled. Frozen and chilled products must be transported in temperature-controlled vehicles. Deliveries must be accompanied by a delivery note indicating purchase order number, product descriptions, quantities, batch numbers, and expiry dates. JCT reserves the right to inspect and reject non-compliant products.

Bidders must submit a detailed implementation and delivery plan demonstrating their ability to effectively manage the supply, distribution, and customer support requirements of the contract. The plan should cover supply chain management, delivery logistics, and customer support.

Bidders must demonstrate experience in supplying frozen foods, dry goods, consumables, and cleaning supplies to hotels, hospitality venues, large scale casinos, large scale banqueting departments, and high-end restaurants. They must also demonstrate compliance with food safety legislation and implementation of quality management systems, adequate delivery capacity and fleet, and a qualified management team, warehouse personnel, drivers, and logistics staff. Examples or references of similar works performed must be provided.

The employer reserves the right to verify the authenticity of all documents submitted and to request originals for inspection at any stage. Any false declaration or fraudulent documentation may result in disqualification, cancellation of any award, and other legal action. Bidders must demonstrate compliance with food safety legislation and implementation of quality management systems.

The pricing schedule lists the range of items that may be required, including categories such as Calamari, Cheese, Chicken, Chips, and Cold Meats. Bidders must cost for all items as required; failure to do so will result in rejection as non-responsive. Prices must be quoted in South African currency, VAT inclusive, and remain firm for the contract duration. Delivery costs are deemed included in the bid price.

They must submit a valid Letter of Good Standing from the Compensation Fund (or affidavit if no employees), and certified copies of ID documents or passports of members/directors/owners. The contractor must ensure compliance with the Occupational Health and Safety Act and all relevant regulations, including for all employees and other contractors on site. The tenderer shall provide a suitable health and safety plan appropriate for the contract. The tenderer must provide written proof of registration as an employer under the Compensation for Occupational Injuries and Diseases Act prior to commencement of work.

The contract is valid for 36 months from the date of appointment, subject to satisfactory performance, continued compliance, annual performance reviews, and availability of budget. The appointment does not guarantee minimum work; work is commissioned on an as-and-when-required basis via purchase orders. The contractor remains responsible for completion of purchase orders issued before expiry, including warranty and defects liability. Extension of contract period requires legislative compliance and prior written approval. Bidders must have a local office within the Johannesburg Municipality, which will be the domicilium citandi et executandi. No variation or modification of the contract is allowed except by written amendment signed by both parties. The supplier shall not assign obligations without prior written consent. The contract includes provisions for delays in supplier performance, penalties for late delivery, indemnity clauses, and compliance with legislation. The supplier must notify JCT in writing of any delays and may be granted extensions. Penalties may be deducted from the contract price for delayed delivery. The contractor indemnifies JCT against loss, damage, injury, or death arising from use of premises, except for willful acts or gross negligence. The contractor must comply with the Occupational Health and Safety Act and provide a health and safety plan.
