Evaluation stages:

• Stage 1: Administrative compliance — bids must meet all mandatory requirements and satisfactorily address any administrative non-compliance within the period specified by the Employer.
• Stage 2: Functionality — minimum threshold of 80 points out of 100. Functionality criteria include company experience, production and branding capacity, delivery capacity and fleet, food safety, quality management and carbon emissions action plan, and samples.
• Stage 3: Price and special goals (preference points under the PPPFA 2022 regulations).

Functionality scoring:

• Company Experience (20 points): points awarded based on the number of similar projects supplying branded water to hotels, hospitality venues, large-scale casinos, large-scale banqueting departments and high-end restaurants. No similar projects = 0; one project = 5; two to three projects = 10; four projects = 15; five or more projects = 20. For each project, both an appointment document (letter, contract, purchase order on client's letterhead) and a corresponding completion certificate or client reference letter must be submitted; points are only awarded where both documents correspond to the same project.
• Samples (40 points): samples of the branded bottled water must be submitted.
• Production and branding capacity, delivery capacity and fleet, food safety, quality management and carbon emissions action plan: assessed as part of functionality.

Preference points: B-BBEE points claimed under the PPPFA 2022 regulations via MBD 6.1. Failure to submit a valid B-BBEE certificate results in zero preference points.

General:

• Bidders must be a single legal entity; the bidding entity must be the same entity that will execute the bid. Fronting is disqualified immediately.
• Bidders must have a local office within the Johannesburg Municipality.
• Bidders must not be in the service of the state.
• JCT reserves the right to call for presentations from short-listed bidders before final selection.

Scope: supply and delivery of branded bottled water for official meetings, conferences, workshops, public participation programmes, marketing events and other organisational activities on an as-and-when-required basis.

Product range (PET bottles):

• Branded still water – 330 ml, 500 ml, 1 litre
• Branded sparkling water – 330 ml, 500 ml, 1 litre

Product range (glass bottles – return, recycle, refill):

• Branded still water – 250 ml, 440 ml
• Branded sparkling water – 250 ml, 440 ml

Minimum specifications:

• BPA-free PET bottles.
• Tamper-proof safety seals.
• Black customised branding printed directly on clear bottles (no sticky labels).
• Shelf life of not less than 12 months from delivery.
• Food-grade packaging materials.
• Local water source.
• Glass bottles must be returnable with branding on the bottle, not sticky labels.

Branding requirements:

• Print branding on bottles from artwork supplied by the Employer.
• Submit electronic proof before production and obtain written approval prior to printing.
• Ensure colour consistency and that the print is waterproof and resistant to scratches.
• Maintain branding quality throughout the contract period.

Delivery requirements:

• Delivery within 1–2 working days from receipt of an official order.
• Urgent orders to be accommodated within 24 hours where reasonably possible.
• Delivery during normal business hours to all designated sites, with off-loading at the delivery point.
• Replace damaged goods within 48 hours.

Quality requirements:

• Water must be safe for human consumption, bottled under hygienic conditions, and comply with all applicable South African food safety legislation and standards.
• Provide a data sheet on the latest water test.
• Products must be free from contamination, have clearly marked production and expiry dates, and have batch numbers for traceability.

Packaging: products must be packaged in recyclable packaging to prevent damage during transportation.

Stock: maintain adequate stock to meet urgent orders.

Replacement: replace damaged or defective products at no additional cost.

Samples: samples of the branded water must be submitted for evaluation.

Monitoring: the appointed service provider will be monitored on timeliness of service delivery, quality of service, and compliance with clearly stated specifications.

The service provider must demonstrate a proposed approach and solutions that fit JCT's requirements. The bidder must complete all categories as stipulated in the document. Bidders must provide examples or references of similar works performed. Functionality evaluation includes company experience, production and branding capacity, delivery capacity and fleet, food safety, quality management and carbon emissions action plan. Experience points are awarded based on the number of similar projects supplied to hotels, hospitality venues, large-scale casinos, large-scale banqueting departments and high-end restaurants: no similar projects = 0; one project = 5; two to three projects = 10; four projects = 15; five or more projects = 20.

Quality requirements: water supplied must be safe for human consumption, bottled under hygienic conditions, and comply with all applicable South African food safety legislation and standards. The bidder must provide a data sheet on the latest water test. Products must be free from contamination, have clearly marked production and expiry dates, and have batch numbers for traceability. The bidder must replace damaged or defective products at no cost to the Employer. The Employer reserves the right to verify the authenticity of all documents submitted and to request originals for inspection at any stage of the procurement process.

Pricing instructions: all prices must be in South African Rand and include VAT. Prices must be net with all discounts deducted. Prices must include cost of supply, transport, delivery, off-loading, labour, equipment and materials without extra charges. The tender price shall be firm for 120 days. Non-firm prices will not be considered. Failure to complete the price schedule will invalidate the tender. Delivery costs are the responsibility of the supplier and must be included in bid pricing. A separate pricing schedule must be submitted for each delivery point if different delivery points influence pricing.

Price validity:

• The tender price must remain firm for at least 120 calendar days after the closing date. Bids with a shorter validity period may be disregarded.
• Only firm prices will be accepted; non-firm prices (including those subject to exchange rate variations) will not be considered.
• No claim for price escalation will be considered unless specifically stated.

Payment:

• Payment will be made in Rand, no later than 30 days after submission of the statement by the supplier.
• The supplier must furnish an invoice accompanied by a copy of the delivery note and fulfilment of other contractual obligations.

Pricing schedule:

• All price information required in the price schedule must be supplied; failure to do so invalidates the tender.
• A separate pricing schedule must be submitted for each delivery point if different delivery points influence pricing.
• The price declaration must be signed by a duly authorised person; failure to do so invalidates the bid.

Financial documentation:

• Audited annual financial statements where legally required, or most recent annual financial statements with a Public Interest Score (PIS) calculation.

➢ The Contractor agrees that the occupational use of JCT’s premises and buildings shall be

at his own risk, and that he acknowledges the risks and dangers inherent therein.

liable or responsible for any loss, liability, damages, accident or injury, whether fatal or

otherwise, of whatsoever nature and howsoever arising, whether directly from the

permission granted by JCT to execute certain events or otherwise, including but not

limited to, the use of the premises and / or buildings, and indemnifies JCT and/or its

employees against all and any loss of / or damage to property, or injury or death, and any

claim for such loss, damage, injury or death, from any cause whatsoever and howsoever

arising, which may be suffered in this regard.

➢ The Contractor and / or its officers, employees, agents, concessionaires, suppliers,

Contractors or customers shall not have any claim of any nature against the JCT for any

loss, damage, injury or death which any of them may directly or indirectly suffer (whether

or not such loss, damage, injury or death is caused through negligence of JCT or its agents

or employees) or for:

➢ any latent or patent defect in the premises;

➢ a fire on the premises;

➢ a theft from the premises;

➢ the Premises or any part thereof being in a defective condition or state of disrepair;

➢ force majeure of causus fortuitus or any other cause either wholly or partly beyond

the JCT’s control;

➢ the use of the services offered on the premises;

➢ consequential loss howsoever caused;

➢ any loss or damage whether to persons or property caused by riots, civil commotion,

insurrection or actions taken by the Contractor or JCT to mitigate the effect of / or

prevent the aforesaid; and any other cause whatsoever.

➢ Save for any willful acts or omission or gross negligence by JCT, its officers, employees,

agents, concessionaires, suppliers and Contractors, the Contractor indemnifies JCT and

holds it harmless from and against all claims, actions, damages, liability and expense in

connection with loss of life, personal injury and / or damage to property arising from or

out of any occurrence in, upon or at the premises or the occupancy or use by the

Contractor of the premises.

Compliance with Legislature

included, shall enter into an agreement with JCT, indemnifying JCT from the provisions of

the Occupational Health and Safety Act (.

other Contractors on the site. The Tenderer shall provide a suitable health and safety

Workmen’s Compensation

The Tenderer shall, prior to commencement of any work on site in terms hereof, give written

proof that he is registered as an employer in terms of Section 80 of the Compensation for

Occupational Injuries and Diseases Act, and the Tenderer shall remain registered as

such for the duration of the contract awarded and shall pay all monies due to the

Compensations Fund in terms of Section 15 of Act . Failure to comply will result in

the Tenderer being disqualified.

The Employer intends to appoint one (1) suitably qualified and experienced service provider

to undertake the Supply And Delivery of Branded Bottled Water for Joburg City Theatres.

The Contract shall be valid for a period of thirty-six (36) months from the date of

appointment, subject to:

• satisfactory performance by the Contractor;
• continued compliance with the terms and conditions of the Contract;
• annual performance reviews conducted by Joburg City Theatres (JCT); and
• the availability of approved budget.
