Scope: Provision of Health and Safety Spotters in accordance with the Statement of Work (SOW) requirements. Contract Duration: 5 years, on an as-and-when-required basis. Location: Matla Power Station, Mpumalanga.

• Minimum cover for employee injury/death: R500,000 per event (Compensation for Occupational Injuries and Diseases Act No. 130 of 1993).

Penalties: 10% of the task order value may be deducted for failure to action tasks as required by Eskom (Option X17: Low service damages).

B-BBEE Compliance:

• Contractor must notify Eskom within 7 days of any change in B-BBEE status due to legal, ownership, or business composition changes.

Joint Ventures/Consortia:

• Contractor must not alter the composition of a joint venture or consortium without Eskom’s written consent.

Ethics:

• Any illegal or corrupt practices (e.g., bribes, inducements) by the Contractor or its members may lead to contract termination or legal action.
• Contractor must comply with all applicable anti-corruption laws and regulations.

Confidentiality:

• Contractor must not disclose contract-related information to third parties without Eskom’s consent, except as required by law or if the information is already public.
• Contractor must ensure subcontractors also comply with confidentiality requirements.

Contractor Registrations and Legal Compliance:

• Contractor must be registered in South Africa (if applicable) and comply with all relevant laws, including the Companies Act and Value Added Tax Act.
• Contractor must provide proof of insurance, bonds, guarantees, and other required documentation as per the Contract Data.

Dispute Resolution:

Labour Resources:
