Scope: Provision of Maintenance and Repair Services for ELIDZ Pump Stations.

Key requirements:

• Work must comply with SABS 1200 Standardised Specifications for Civil Engineering Construction.
• Measurement and payment will follow SABS 1200-A (General) for Preliminary and General items.
• No allowance is made for waste unless otherwise specified.
• Quantities in the Bills of Quantities are approximate; actual certified quantities will determine payments.
• All maintenance and repair work required to ensure the operational efficiency of the pump stations within the East London Industrial Development Zone is included.

Pricing instructions:

• Measurement and payment must comply with SABS 1200 Standardised Specifications for Civil Engineering Construction.
• Units of measurement are metric (e.g., %, h, kg, km, m, m², m³, kW, kPa).
• Items are measured net as per drawings; no allowance for waste unless specified.
• Prices and rates in the Bills of Quantities are fully inclusive, covering all costs, risks, liabilities, overheads, and profit.
• Prices will serve as the basis for assessing additional work.
• Quantities in the Bills of Quantities are approximate; payments are based on actual certified quantities.
• Reasonable compensation may be claimed for work not covered by existing pay items.

• Prices must account for all Acts, Ordinances, Regulations, By-laws, and Standards published 28 days before the closing date.

Bill of Quantities (C2.2):

• Submit rates for all listed items. Items without prices will be deemed covered by other rates.
• Grouped items will be priced as a single lump sum.

Pricing format:

• Submit fully inclusive prices for all items in the Bills of Quantities (C2.2).
• Prices must cover all costs, risks, liabilities, overheads, and profit as per the Scope of Work and Contract Data.
• Unit rates and lump sums must account for all work described, including detailed drawings, designs, or additional information required.
• Quantities in the Bills of Quantities are approximate; payments will be based on actual certified quantities.
• Reasonable compensation may be claimed for work not covered by existing pay items.
• Prices must account for all Acts, Ordinances, Regulations, By-laws, and Standards published 28 days before the closing date.
• Items without prices will be deemed covered by other rates. Grouped items will be priced as a single lump sum.

Guarantees:

• Provide a performance guarantee of 5% of the Contract Sum (excl. VAT) within 21 days of bid acceptance. Options include:
• Cash deposit
• Bank guarantee (issued by a bank registered under the Banks Act, 1990)
• Insurance guarantee (issued by an insurer registered under the Short-Term Insurance Act, 1998)
• Guarantees must use the pro-forma provided in Section C1.3 without alterations.

Payment terms:

• Interim Payment Certificates, Final Payment Certificate, and Certificate of Completion of Works will be issued by the Employer’s Agent.
• Payments will be processed based on certified quantities and compliance with contract terms.

Legal and authorization:

• Submit a Resolution or Power of Attorney signed by all Directors/Members/Partners, authorizing the representative to sign the offer.
• Provide legal entity details (company/close corporation/natural person/partnership) and tax reference number.

Guarantees and bonds:

• Performance guarantee of 5% of the Contract Sum (excl. VAT) must be submitted within 21 days of bid acceptance.
• Guarantees must be issued by a registered bank or insurer as per South African law.

Contractual obligations:

• Acceptance of the offer forms a binding contract upon signing by the Employer and Tenderer.
• Failure to deliver bonds, guarantees, proof of insurance, or other required documentation within the stipulated time constitutes repudiation of the agreement.
• All deviations or amendments must be documented in the Schedule of Deviations; no other changes are valid.
• The contract is binding unless the Tenderer (now Contractor) rejects it in writing within 7 working days of receipt.
• Delivery of the contract document is considered effective if hand-delivered on the day of delivery or delivered by courier within two working days, with the Employer notifying the Tenderer of the tracking number within 24 hours.

Contract execution:

• The contract is formed when the Employer signs and returns the Form of Offer and Acceptance to the Tenderer.
• The Tenderer becomes the Contractor upon acceptance.
• The contract includes all documents referenced in the tender data, addenda, and the Schedule of Deviations.
• Amendments or deviations are only valid if included in the Schedule of Deviations.
• The Contractor must deliver bonds, guarantees, proof of insurance, and other required documentation within two weeks of receiving the signed agreement.
• The contract is binding unless the Tenderer (now Contractor) rejects it in writing within 7 working days of receipt.
• Delivery of the contract document is considered effective if:
• Hand-delivered on the day of delivery.
• Delivered by courier within two working days, with the Employer notifying the Tenderer of the tracking number within 24 hours.

Performance Guarantee:

• Must be provided for 5% of the Contract Sum (excl. VAT) within 21 days of bid acceptance.
• Options: cash deposit, bank guarantee, or insurance guarantee.
• Guarantees must use the pro-forma in Section C1.3 without alterations.
