• Submit two separate PDFs via the ELIDZ online portal https://tenderportal.elidz.co.za – Envelope A (Technical Proposal) and Envelope B (Financial Proposal) before 12:00 on 6 April 2026.
• All documents must be in PDF format, max 30 MB each; e‑mail, fax or hard‑copy submissions are not accepted.
• Envelope A must contain ONLY technical information – no price details. Inclusion of price in Envelope A will lead to disqualification.
• Envelope B must contain the completed “Form of Offer”, price schedule and any supporting financial documents. The Form of Offer must be signed; an unsigned form results in disqualification.
• Required technical returnables (to be included in Envelope A):
• Original cancelled cheque or bank‑stamped letter (including trust‑account cheque).
• Company profile and organogram with CVs of proposed team.
• Valid CSD registration certificate and CIPC registration copy.
• Certified copies of ID documents and share certificate.
• Valid SARS tax clearance (or PIN code for online verification).
• Valid B‑BBEE certificate (accredited) or sworn affidavit for EME/QSE as applicable.
• Proof of office location (lease, municipal statement, etc.).
• Three reference letters (Annexure 2) and completed track‑record form (Annexure 3).
• Fidelity Fund certificates of all directors.
• Letter(s) of good standing from the Legal Practice Council.
• Professional indemnity insurance cover of at least R5 million.
• JV participation documentation where applicable.
• Completed ELIDZ Procurement Handbook (Annexure 1) with all supporting documents.
• All signatures must be by an authorised person; a copy of the board resolution authorising the signatory must be attached.
• Late, incomplete or non‑conforming submissions will be rejected.
• Queries must be submitted in writing to the Project Manager only, no later than one week after the briefing (see contact information).

• Functional Evaluation Matrix (total 100 points):
• Years in existence (30 points): >5 years = 30, 2‑5 years = 20, <2 years = 5.
• References (30 points): up to 10 points per reference letter (minimum 3 letters). Highest three scores used.
• Track record in Administrative Law (40 points): 10+ relevant projects = 40, 6‑9 = 30, 3‑5 = 20.
• Minimum score to proceed to the next phase: 70/100.
• Price competitiveness accounts for 80 % of the total score (price points calculated using the ELIDZ 80/20 formula). Specific transformation goals (BBBEE, Eastern Cape, SMME, youth, women, disability, etc.) provide up to 20 % additional points as per the specific‑goals conversion table.
• Failure to submit a valid B‑BBEE certificate/affidavit may result in zero preference points.
• The highest overall point total (price + specific goals) determines the award, subject to compliance with all mandatory requirements.

Scope of Services:

• Provide administrative law advice on demand, including public procurement, PAIA, PAJA, PFMA, drafting/negotiating state agreements, litigation and dispute resolution, and general advisory services.
• Deliverables are on‑demand; no fixed quantity, but monthly management report (by the 25th of each month) and ad‑hoc reports as required.
• Services to be performed at ELIDZ head office (Lower Chester Road, Sunnyridge, East London) or any other location directed by ELIDZ.
• Required team: qualified attorneys with experience in administrative law; key persons to be identified and approved by ELIDZ.
• Substitution of key resources only with ELIDZ consent.
• Professional indemnity insurance minimum R5 million cover.
• Compliance with ISO 14001 (environment) and ISO 18001 (OHS) standards.
• Service Level Agreement will define detailed service levels, milestones and penalties (e.g., 1/14 % of contract value per day for late completion).

• Pricing must be in South African Rand, VAT‑inclusive.
• Price schedule to be submitted in Envelope B only; any price detail in Envelope A leads to disqualification.
• Monthly payment milestones for the three‑year term, as per the Service Level Agreement.
• Payment terms: invoices payable within 30 days of receipt, provided the invoice complies with the format outlined (original VAT‑compliant invoice, correct supporting letters, etc.).
• Price validity: 120 days after the closing date.
• No performance bond or guarantee is explicitly required in the document.
• Late invoice submission or non‑compliant invoices will be returned for correction; payment may be delayed.
• Penalty for delayed service delivery: 1/14 % of contract value per day after the agreed completion date.

• Central Supplier Database (CSD) registration and valid MAAA number required.
• Valid SARS tax clearance certificate (or PIN code for online verification).
• Certified copy of CIPC registration and share certificate.
• Certified copies of directors’ ID documents.
• Valid B‑BBEE certificate (accredited) for generic suppliers; sworn affidavit for EME/QSE as applicable. Minimum level 4 for firms with turnover < R10 million; higher levels for larger firms.
• Professional indemnity insurance cover of at least R5 million.
• Proof of office location (lease, municipal statement, etc.).
• Fidelity Fund certificates for all directors.
• Letter of good standing from the Legal Practice Council.
• Compliance with applicable SHE (Safety, Health & Environment) requirements as per Section 14 (risk assessments, PPE, work‑men’s compensation, etc.).
• All documents must be original or certified copies.
