Corrupt/Fraudulent Practices: Strictly prohibited; may result in contract termination and restrictions on doing business with the public sector for up to 10 years. Patent Rights: Supplier must indemnify the purchaser against third-party claims of infringement. Local Content: Must adhere to definitions of local and imported content as per GCC. Subcontracts: Must notify purchaser in writing of all subcontracts awarded; does not relieve supplier of liability. Tax Compliance: Must submit a valid original tax clearance certificate issued by SARS prior to bid award. Restrictive Practices: Collusive bidding or bid rigging is prohibited and may result in bid invalidation, contract termination, or restrictions on doing business with the public sector.
