16.1. Mandatory Returnable Documents

Evaluation is in three stages:

• Stage 1A (Mandatory): Failure to submit these results in automatic disqualification.

• Fill and sign the correct submission register.
• Complete all RFQ documentation, including all declarations and the pricing schedule.
• Have an active CIDB grading of 3SO or higher.
• Submit a joint venture/consortium agreement if applicable.

• Stage 1B (Other Mandatory): If not submitted, PRASA may request them within 5 working days; failure leads to disqualification.

• Valid Tax Clearance Certificate or SARS PIN (valid on closing date).
• CSD supplier registration number.
• Valid B-BBEE certificate from a SANAS-accredited agency, DTI/CIPC certificate, or sworn affidavit.
• Copies of directors' ID documents.
• Proof of bank account.
• Company registration certificate (CK1 or incorporation).
• Letter of Good Standing (COIDA).

• Stage 2 (Technical/Functional): Minimum threshold is 60% per criterion. Scoring is based on:

• Company Experience (30%): Score based on value of successfully completed plumbing maintenance projects (≥R1.5M) in the last 5 years. Provide appointment letter/contract and reference/completion certificate.
• Experience of Key Personnel (50%): Five key plumbers each require NQF Level 2 or higher, a trade test certificate, and a PIRB CoC. Points awarded for years of experience (1-5 years) with relevant certification.
• Health and Safety (20%): Submit a safety plan per OHS Act 1993 and PRASA specifications. Must include: operational structure with minimum 3 maintenance crews, a certified first aider, a plumbing-specific risk assessment, and a valid letter of good standing.

• Stage 3 (Price and Specific Goals):

• Price: 80 points awarded using the 80/20 preference point formula.
• Specific Goals: 20 points total.
• B-BBEE Level 1: 10 points (submit sworn affidavit or SANAS-accredited B-BBEE certificate).
• EME/QSE with at least 51% black ownership: 10 points (submit certified copies of owners' IDs).

• Scope: Appointment of two contractors for plumbing maintenance on an 'as and when required' basis.

• Key Personnel Requirements:

• Five key plumbers must be provided.
• Each must have NQF Level 2 or higher, a trade test certificate, and a valid Plumbing Industry Registration Board (PIRB) Certificate of Compliance (CoC).
• Points are awarded based on years of experience (1-5 years) with the relevant trade certification.

• Company Experience Requirement:

• Must demonstrate experience in plumbing maintenance projects within the last 5 years.
• Only projects with a minimum value of R1,500,000 will be considered.
• Submit an appointment letter/contract and a corresponding reference/completion certificate confirming work completion and value.

• Health and Safety Plan:

• Must comply with the OHS Act 1993 and PRASA's Health and Safety specifications.
• Plan must include: an operational structure with a minimum of three maintenance crews (each with a skilled person and assistant), a certified first aider, a plumbing maintenance-specific risk assessment, and a valid letter of good standing.

• Company Experience: Must have successfully completed plumbing maintenance projects worth at least R1,500,000 in the last 5 years. Submit an appointment letter/contract and a corresponding reference/completion certificate as proof.
• Key Personnel Qualifications: Five key plumbers are required.

• Each must have an NQF Level 2 or higher qualification, a trade test certificate, and a valid PIRB Certificate of Compliance (CoC).
• Points are awarded per plumber based on years of experience (1-5 years) with the relevant certification.
• Submit CVs and certified copies of qualifications for each.

• Complete the attached pricing schedule (Section 4). Do not deviate from the provided format.
• Prices must be in South African Rand (ZAR), inclusive of all taxes, and offered on a firm basis.
• Provide a cost breakdown and indicate the price escalation basis and formula.
• Discounted prices will only be considered in the final evaluation, unconditionally.
• If the highest-scoring bidder's price is not market-related, PRASA may negotiate with them, then sequentially with the second and third highest bidders.
• State your earliest delivery period in working days from the date of order.

• All prices must be quoted in South African Rand (ZAR), inclusive of all applicable taxes.
• Price offer must be firm, with a clear basis.
• Complete the pricing schedule (Bill of Quantities) as provided; do not use a different format. Deviation may render the bid non-responsive.
• Provide a cost breakdown and indicate the price escalation basis and formula.
• Discounted prices will only be considered in the final evaluation on an unconditional basis.
• PRASA may negotiate a market-related price with the highest-scoring bidder(s) if the quoted price is not market-related.
• Payment Terms: PRASA will pay within 30 days of receiving a correct tax invoice.
• Delivery Period: Suppliers must state their earliest possible delivery period in working days from the date of order.

• Tax Compliance: Submit a valid Tax Clearance Certificate (valid on closing date) or a SARS-issued PIN. If a PIN is unavailable but registered on the CSD, provide your CSD number.
• Central Supplier Database (CSD): Must be registered on the National Treasury CSD (https://secure.csd.gov.za/). Business will not be awarded to unregistered bidders (foreign suppliers with no local entity are exempt).
• B-BBEE: Submit a valid B-BBEE certificate from a SANAS-accredited rating agency, a DTI/CIPC certificate, or a sworn affidavit. For consortia/joint ventures, submit a consolidated certificate.
• CIDB: Must have an active CIDB grading of 3SO or higher. For consortia/joint ventures, submit a consolidated grading verification certificate.
• Company Registration: Provide a company registration certificate (CK1 or certificate of incorporation).
• Directors' IDs: Submit copies of ID documents for all directors.
• Proof of Bank Account: Provide a letter from your bank.
• Letter of Good Standing: Submit a valid COIDA letter.
• State Employees: No bids will be considered from persons in the service of the state, companies with state-employed directors, or close corporations with state-employed members.
• Foreign Suppliers: If foreign-based, answer the questionnaire in SBD1 regarding residency, branch, establishment, income, and tax liability in RSA.

• B-BBEE Level 1 Contributor: 10 preference points (submit a sworn affidavit or a SANAS-accredited B-BBEE certificate).
• EME or QSE with at least 51% black ownership: 10 preference points (submit certified copies of the black owners' ID documents).
• For consortia/joint ventures, submit a consolidated B-BBEE certificate.

• Submit a safety plan compliant with the OHS Act 1993 and PRASA Health and Safety specifications.
• The plan must include four specific items:

1. Operational structure with a minimum of three maintenance crews (each comprising at least a skilled person and an assistant).
2. A certified first aider as part of the team.
3. A risk assessment specific to plumbing maintenance.
4. A valid letter of good standing.

• Scoring: Points are awarded based on how many of the four items are submitted (4 items = 10%, 3 items = 8%, 2 items = 6%, 1 item = 4%).

• Contract Duration: The appointment is for a period of 24 months on an 'as and when required' basis.
• General Conditions: The PRASA General Conditions of Purchase apply.
• Governing Law: The contract is governed by South African law, with parties submitting to the non-exclusive jurisdiction of South African courts.
• Warranty: Supplier warrants that items/services are fit for purpose and will be free from defects for one year from acceptance (unless another period is stated in the order).
• Indemnity: Supplier indemnifies PRASA against all claims arising from negligence, infringement of rights, breach of statutory duty, or defective design/materials/workmanship.
• Subcontracting: Requires PRASA's prior written approval. The main contractor remains liable for performance.
• Rejection: PRASA may reject non-conforming items/services, requiring replacement or re-work at the supplier's cost.
• Funding Contingency: The award is subject to PRASA securing necessary budget allocation. PRASA reserves the right to cancel the RFQ if funding is not secured and will not be liable for any claims or losses arising from non-award due to lack of funding.
• Validity Period: Bid must remain valid for 60 working days from the closing date. PRASA may request an extension.

• Funding Contingency: The award is strictly subject to PRASA securing the necessary budget allocation. PRASA reserves the right to cancel the RFQ if funding is not secured and shall not be liable for any claims arising from this.

• Foreign Suppliers: If foreign-based, must answer a questionnaire regarding residency, branch, permanent establishment, source of income, and tax liability in the Republic of South Africa.
• Tax Compliance: Bidders must ensure tax compliance and submit a SARS PIN or CSD number.
• State Employees: Bids from persons in the service of the state, or entities controlled by them, are not allowed.
