• Not listed on the Register of Tender Defaulters or prohibited from public sector business.
• No abuse of UMEDA’s Supply Chain Management System.
• No prior contract terminations due to non-performance.
• Municipal accounts not in arrears (>90 days or >30 days if tender price exceeds R10M).
• Submission of all required forms and declarations (MBD 4, MBD 8, MBD 9, etc.).
• Proof of good standing with municipal accounts.

Preference points (80/20 system):

• Price: 80 points.
• Specific Goals (Locality): 20 points.
• Office based in uMgungundlovu District: 20 points.
• Office based in KwaZulu-Natal (outside uMgungundlovu): 10 points.
• Office based outside KwaZulu-Natal: 5 points.
• Proof required: Municipal account or councillor’s letter.

Exclusions:

• Persons in the service of the state (as defined in MSCM Regulations).
• Bidders with directors/shareholders in the service of the state.
• Foreign suppliers not complying with pre-award questionnaire (if applicable).

Building requirements:

• Minimum 500 sqm gross lettable area.
• Must include: Function/Board Room with kitchenette, utility area, toilets, storeroom (for stakeholder sessions), Management Boardroom (for staff/executive meetings), open-plan office areas, meeting rooms, reception area, kitchen facilities, storage/archive facilities, ablution facilities, Server/IT room, executive office accommodation, and boardroom for 20+ persons.
• Additional requirements:
• Presentable and well-maintained (provide recent interior/exterior images).
• Within 2km of City Hall.
• Secure parking for 15+ vehicles.
• Paraplegic access and lavatory.
• Solar-powered system with inverter and battery backup.
• Controlled access gates.
• CCTV infrastructure.
• Perimeter fencing/walling.
• Appropriately zoned for office/business/mixed-use.
• Structurally sound.
• Compliant with municipal building regulations.
• In good condition with limited capital expenditure required.
• Valid occupation approvals.
• Municipal accounts in good standing.
• Suitable for immediate occupation or minor alterations only.

Quality standards:

• Goods/services must conform to bidding document specifications.
• Inspection rights: Purchaser may inspect supplier’s premises/records at reasonable hours.
• Testing: Pre-bidding testing costs borne by bidder. If contract requires inspections/tests, non-compliance costs are borne by the supplier.
• Rejected goods must be removed/replaced at supplier’s cost and risk.
• Supplier must indemnify purchaser against third-party claims for patent/trademark infringement.
• Intellectual property rights for supplier-developed documents vest with UMEDA.

Pricing data must be submitted as part of the tender (Part 2 of contract).

• Total bid price must be stated in Rand (words and figures).
• VAT inclusive.
• Bid must include all applicable taxes and discounts.
• For income-generating contracts, the highest acceptable tender determines the 80/20 or 90/10 preference point system.
