Provision of earthmoving equipment for TRANSNET eastern region shutdown (2026/27)

Returnable Documents: Signed Non-Disclosure Agreement (NDA) must accompany the bid. All Confidential Information (including copies) must be returned or destroyed within 7 days of a written demand from Transnet. A director-signed certificate confirming compliance with destruction/return requirements may be requested by Transnet.

Eligibility: Mandatory acceptance of Transnet’s NDA terms is required to participate in the bidding process. Bidder must be a legal entity acting as a principal (not as an agent or broker). No commercial or technical evaluation criteria for the earthmoving equipment tender are specified in this document.

Confidentiality: Must comply with Transnet’s NDA, including secure storage of all received information, restricted use (solely for bid discussions or contract performance), and non-disclosure to third parties without written consent. Data Protection: Must adhere to South African privacy laws (Section 14 of the Bill of Rights) and implement technical/organizational measures to prevent unauthorized data processing, loss, or damage. Liability: Bidder remains liable for actions of its agents (e.g., employees, subcontractors) that breach confidentiality.

• Contract commencement date: Finalised after award acceptance, as stipulated in the acceptance letter. Contractor must be ready to start immediately after award.
• Shutdown period: June 2026 (2026/27 annual planned shutdown for Northeast Corridor).

Evaluation will focus on the following key points:

• Certified operators must be provided for all earthmoving equipment.
• Equipment must be ≤15 years old, in good working condition, and 100% operational (wet rate) for the full contract duration.
• Contractor must demonstrate ability to commence work immediately after award.
• Compliance with all applicable safety legislation (e.g., OHS Act, TFR Safety Guidelines, E7/1 Specification) and Transnet specifications is mandatory.
• Preference must be given to local labour for unskilled positions.
• Capacity for 24-hour operations is required, including at least 2 sets of qualified operators per machine (12-hour shifts: 06:00–18:00 and 18:00–06:00).
• Performance penalties apply for late equipment delivery and breakdowns (see penalty tables in document).

• Scope: Supply, operation, and maintenance of earthmoving equipment for the Eastern Region shutdown (2-month period). Work includes track formation, rehabilitation of track structure, cuttings, embankments, service roads, and other instructed tasks.
• Locations: Northeast Corridor Depots — Nelspruit, Witbank, and Polokwane. Specific lines and areas detailed in document (e.g., Line 34, 35, 44, 65, etc.).
• Equipment Requirements: Must supply exact quantities of specified items, including:

• Plant Age: Maximum 15 years old.
• Availability: 100% operational (wet rate) for full duration, with 24-hour operation capability during shutdown. Availability calculated as: (To – Tb)/To, where To = total time, Tb = breakdown time.
• Operators: Minimum 2 sets of certified operators per machine for 24-hour shifts (12-hour rotations).
• Maintenance: Must provide maintenance manuals, spare parts lists, operator instruction manuals, machine safety/risk files, visitor registration books, and site diaries on each machine. Detailed maintenance plans and daily production reports (emailed by 08:00 next day) are required.
• Safety: Comprehensive safety plan, risk assessments, PPE, first aid boxes, safety talks (logged in site diary), and compliance with TFR E7/1, OHS Act, and other specified legislation. Contractor must conduct formal risk assessments and submit a safety case with the tender.
• Site Requirements: Contractor must provide own accommodation, security, fuel/oil, water, toilets, and refreshments for personnel. Firefighting equipment and trained personnel must be available.
• Penalties: Late delivery of equipment (48-hour notice) incurs penalties (2–10% of PO value or order cancellation). Breakdown penalties scale from 2.5% to 15% of claimed cost based on availability percentage (see document for tables).
• Additional Notes: No equipment may be brought to site without written instruction from the Service Manager. All personnel must be inducted; site access certificates are mandatory.

• Safety Compliance: Must adhere to TFR Safety Guidelines for Infrastructure, OHS Act, Compensation for Occupational Injuries and Diseases Act, TFR Specification E.4E (SHE for Contractors), Basic Conditions of Employment Act, and TFR Specification E7/1 (Work on/near railway lines and high-voltage equipment).
• Operator Certification: All operators must be certified and experienced, with up-to-date records of qualifications and safety training kept on site.
• Local Labour: Preference must be given to local labour for unskilled positions.
• Site Inductions: All contractor personnel must complete inductions before work commences; site access certificates are required.
• Equipment Compliance: All machinery must comply with applicable safety legislation and be legally compliant for use on Transnet sites.

Bidders must: - Read the Integrity Pact in full and certify compliance in the RFX Declaration Form. - Submit all required returnable documents as specified in the RFP. - Not offer gifts, favours, or benefits to Transnet employees or related parties (Zero Gifts Policy). - Disclose conflicts of interest (family, business, or social ties with Transnet employees) in the RFX Declaration Form or notify Transnet in writing if arising later. - Avoid collusion with competitors on pricing, market allocation, bid submission decisions, or contract terms. - Not disclose bid details to competitors before official opening or award. - Ensure all submitted information (e.g., B-BBEE status, local content) is accurate and verifiable. Non-compliance risks disqualification, contract cancellation, or exclusion from future bids for up to 10 years.

Evaluation will assess: - Absence from National Treasury’s List of Restricted Suppliers or Register of Tender Defaulters. - No serious legal breaches (corruption, fraud, Competition Act violations) in the last 5 years with any public/private entity. - Full compliance with the Integrity Pact’s anti-corruption and independent bidding obligations. - Capability to provide earthmoving equipment for the two-month shutdown period as per RFP specifications.

Deliverables must meet the RFP’s defined specifications for earthmoving equipment, including technical and quality requirements for the two-month shutdown period in the Eastern Region.

Mandatory compliance: - Sign and adhere to the Transnet Integrity Pact. - No bribery, corruption, or anti-competitive practices (e.g., collusion, cartels). - Accurate and verifiable B-BBEE status and local content declarations. - Disclose all subcontracting arrangements. - No prior transgressions (corruption, fraud, Competition Act violations) in the last 5 years with any public/private entity. - Not listed on National Treasury’s Register of Tender Defaulters or Database of Restricted Suppliers. - Uphold the 10 UN Global Compact principles (Human Rights, Labour, Environment, Anti-Corruption). - Submit a code of conduct addressing anti-corruption if requested by Transnet.
