• Bidders must ensure all delivered items meet the specified descriptions and quantities.

• Bidders must use the provided pricing schedule to submit their offers. The schedule includes columns for: Item description, unit of measure, amount in R, sub-total, VAT, and total.
• Failure to use the prescribed pricing schedule may result in disqualification.
• Disbursements (e.g., accommodation, telephone, reproduction costs) will be reimbursed at actual cost. Certified invoices must be provided as proof of expenses.
• All pricing must be clear and accurate to enable ACSA to compare offers effectively.

• Bidders must price their offers strictly in accordance with the provided pricing schedule. Failure to do so may result in disqualification.
• The pricing schedule requires: Item description, unit of measure, amount in R, sub-total, VAT, and total.
• Disbursements (e.g., accommodation, telephone, reproduction costs) will be reimbursed at actual cost. The successful bidder must provide proof of expenses (certified invoices) for reimbursement.
• Prices quoted must remain firm and valid for 120 business/working days from the bid closing date. Price changes will only be considered in exceptional circumstances.

• Tax Compliance: Bidders must submit a Tax Compliance Status (TCS) PIN issued by SARS. Apply via e-filing at www.sars.gov.za. A printed TCS certificate may also be submitted. For consortia/joint ventures, each party must submit a separate TCS certificate/PIN/CSD number. If no TCS PIN is available but the bidder is registered on the Central Supplier Database (CSD), a CSD number must be provided. Failure to comply may invalidate the bid.
• B-BBEE: Bidders must submit a B-BBEE Certificate and Scorecard (or BBBEE QSE/EME Affidavit). Points are awarded based on B-BBEE status levels (see evaluation criteria).
• Central Supplier Database (CSD): A CSD Report must be submitted.

• Security vetting: ACSA is a National Key Point. Bidders may be subjected to security vetting, and non-compliance will disqualify them from contracting with ACSA.

• Confidentiality: ACSA will not disclose bidder information to third parties without written approval. Bidders must also keep all bid-related information confidential and may not disclose it without ACSA’s written consent. Third parties consulted must sign confidentiality agreements.
• Security vetting: ACSA is a National Key Point. Bidders may be subjected to security vetting, and non-compliance will disqualify them.
• Intellectual Property: Bidders may not use ACSA’s intellectual property (e.g., trademarks, logos) without prior written consent. Requests must be sent to [email protected]. Non-compliance may result in a penalty of 2% of the bidder’s annual turnover.
• Duration: The confidentiality agreement remains in force for 5 years or 1 year from the last disclosure, whichever is longer.
• Governing Law: The agreement is governed by South African law, with jurisdiction in the High Court of South Africa, Witwatersrand Local Division.
• Disclaimers: ACSA reserves the right to award the bid in whole or part, split the award, negotiate with shortlisted bidders, reject the lowest bid, or cancel the bid. Any alteration to the bid document may lead to disqualification.
• Validity Period: Bids must remain valid for 120 business/working days. Prices must remain firm during this period.

• The 80/20 preference point system is used, with 80 points allocated to price and 20 points to specific goals (B-BBEE and other preferences).
• Price scoring: Ps = 80 (1 - (Pt - Pmin) / Pmin), where Pt is the tender price and Pmin is the lowest acceptable tender price.

• B-BBEE Status Levels 1 to 8: Points range from 5 (Level 1) to 0.1 (Level 8).
• Black youth majority-owned entities: 5 points.
• Black women majority-owned entities: 5 points.
• Companies majority-owned by people with disabilities: 5 points.
• Non-compliant contributors: 0 points.

• Documentary proof is required to substantiate claims for preference points. Failure to provide proof will result in no points being awarded for those goals.
