• Submit the completed Form of Offer and Acceptance (C1.1) with all required signatures.
• The offer may be accepted by the employer signing the acceptance part and returning one copy before the end of the validity period.
• After contract signing, the contractor must within two weeks contact the employer’s agent to arrange delivery of any bonds, guarantees, proof of insurance, and other required documentation.
• Failure to fulfil post-award obligations constitutes a repudiation of the agreement.

Contractors must be legally registered entities in South Africa with a valid VAT number. They must demonstrate relevant experience and provide CVs for proposed key personnel. Financial capability to provide required securities (though a performance bond is noted as 'not required' in one section, a pro-forma is provided) and insurance (including Professional Indemnity) is essential. Contractors must be in good standing with the Compensation Fund (COID Act). Joint ventures are permitted but members are jointly and severally liable.

• Scope: Maintenance of 83 elevators and 2 wheelchair stair lifts at O.R. Tambo International Airport for a period of eight (8) months.
• Key personnel required: Site Manager/Supervisor, Lift Mechanic (Technician), Assistant Technician, Storeman, and others as per Resource Proposal (Annex F). CVs for key people must be appended.
• Working areas are detailed in Service Information (C3).
• The contractor must comply with the Occupational Health and Safety Agreement (C1.3) and all relevant OHS Act and COID Act requirements.
• A baseline risk assessment must be performed before commencement.

• Key personnel must be provided with CVs appended to Resource Proposal (Annex F).
• Required roles: Site Manager/Supervisor, Lift Mechanic (Technician), Assistant Technician, Storeman, and others.
• Each key person must have qualifications and experience relevant to the contract.
• The contractor must have experience in elevator maintenance, particularly in airport environments.

• Pricing data is in Part C2 (Pricing data and Price List).
• The price list is a pricing document only; work instructions are in Service Information.
• Prices must be fully inclusive of all costs to provide the service, including defect correction (unless due to employer’s risk).
• No adjustment to lump sum prices for quantity changes; only compensation events can change prices.
• Contractor must link price list items to operations in their plans for cash flow purposes.

• Contract uses NEC3 Term Service Contract (April 2013) with Main Option A: Priced contract with price list.
• Pricing data is in Part C2. Prices are derived from a price list of service items (lump sums or rates).
• The total of the Prices is assumed fully inclusive of everything necessary to provide the service as described at contract signing.
• Payment assessment interval is between the 1st and 15th day of each month.
• Payment terms: Payments are made within 30 days.
• Currency: South African Rand (ZAR).
• No performance bond is required for this contract.

• The contractor must provide Professional Indemnity Insurance (details in C1.5 Insurance Schedule).
• The contractor must be in good standing with the Compensation Fund or a Licensed Insurer (COID Act compliance).
• The contractor must have Public Liability Insurance as required.
• The contractor must comply with the Occupational Health and Safety Act and Construction Regulations.
• All OHS documentation, including a written Construction Manager appointment, must be submitted 7 days before work commences.
• The contractor must adhere to anti-corruption laws, including the Prevention and Combating of Corrupt Activities Act.

• Contractor must sign an Occupational Health and Safety Agreement (C1.3) complying with OHS Act and Construction Regulations.
• Contractor is an employer in its own right with duties under OHS Act and COID Act.
• A baseline risk assessment must be conducted by a competent person before work starts.
• Contractor must appoint competent, trained personnel for OHS.
• Safe work procedures, personal protective equipment, and permit-to-work systems must be implemented.
• No alcohol or intoxicating substances allowed on site.
• All incidents/accidents must be reported to the Department of Labour and ACSA.

• Contract duration: Eight (8) months after signing by ACSA.
• Contract based on NEC3 Term Service Contract (April 2013) with specific options and amendments.
• Key options include: Option A (Priced contract), W1 (Dispute resolution), X5 (Sectional Completion), X7 (Delay damages), X13 (Performance Bond), X16 (Retention), X17 (Low service damages), X18 (Limitation of Liability), X19 (Task Order), X20 (Key Performance Indicators), and Z clauses.
• Employer may terminate if contractor fails to maintain 95% average availability for 24 continuous weeks.
• Dispute resolution: Adjudication followed by arbitration in Johannesburg under Association of Arbitrators rules.
• Confidentiality: Contractor must treat all contract information as confidential.
• Intellectual property: Contractor grants employer a royalty-free licence to use IP for service-related purposes.
• Ethics: Strict anti-corruption and bribery compliance required.
