• Driver must produce a medical certificate of fitness.
• Driver must have a valid driver’s license.
• Supplier is liable for damages due to driver negligence.
• Supplier must follow specific transportation safety requirements (e.g., samples in cooler box).

This is Annexure B: an Acknowledgement Form for Eskom OHS legal and other requirements.

• Must acknowledge and understand all OHS requirements.
• Must have capability to align company processes with Eskom OHS policies after contract award.
• Must provide testimonials or references from previous similar work, including Eskom projects, if requested.
• An authorized person (CEO/Director/Managing Director) must sign the OHS acknowledgment form.

• Supplier must understand and comply with Eskom OHS legal and other requirements.
• Compliance required with the following documents when working at or rendering a service to Eskom:

• Eskom contractor Health and Safety requirements standards 32-136.
• Provided OHS specifications/requirements.
• Occupational Health and Safety Act 85 of 1993.
• Compensation for Occupational Diseases and Illnesses Act 130 of 1993.

• After contract award, fully align the company’s processes to Eskom’s OHS requirements (policies, procedures, standards).
• Ensure all employees (contractors/suppliers) undergo relevant Eskom induction and the company’s own induction.
• The main contractor/supplier must:

• Demonstrate to Eskom the process and selection criteria used for appointing contractors and suppliers.
• Notify Eskom prior to appointing contractors or suppliers for work commencement.
• Ensure appointed contractors/suppliers have adequate resources and competencies.
• Be accountable for managing its contractors/suppliers to ensure compliance with applicable legal and Eskom requirements.
• Monitor contractors/suppliers through audits and assessments for OHS compliance during work execution.
• Provide grounds for termination of work done by contractors/suppliers.
• Deal directly with any non-conformances or non-compliance by contractors/suppliers (all tiers) through performance and penalty processes.

• Eskom reserves the right to verify compliance and may request copies of testimonials/references and client contact details for previous similar work.
• The authorised person must sign the acknowledgment form confirming understanding and acceptance of consequences of non-compliance.

• The list of services and commodities is not exhaustive; a risk assessment must be conducted for unlisted items.
• OHS requirements apply to both local and international companies.

Returnable Documents: Ensure all required documents are included in your submission. Disqualification risks include missing documents or non-compliance with OHS requirements.

Eligibility is contingent on OHS compliance. All bidders must be COID registered/compliant. Exemptions are only for employers with a Department of Labour certificate of exemption. International suppliers must submit equivalent documentation from their country of origin. Suppliers with South African offices employing citizens must submit a COID certificate. Companies without employees can submit an insurance letter covering accidental death/disability (min. R500,000). Bidders must be prepared to be registered on Eskom's vendor database post-evaluation.

• The tender covers courier services and legionella analysis services.
• Services are categorised by risk: high, medium, low.
• High-risk work includes installation, construction, demolition, excavation, blasting, scaffolding, lifting, rigging, tunnelling, civil work, and work with hazardous substances.
• Medium-risk work includes maintenance, transportation of goods (including hazardous), security, consulting on site, industrial cleaning, aviation, vegetation management, and waste disposal.
• Low-risk work includes office-based labour broking, cleaning (not at heights), gardening, supply/delivery of consumables, stationery, catering, and admin-based consulting.

• Eskom requires all service providers to be COID registered/compliant.
• Submit a letter of good standing from the Compensation Fund or a licensed insurer (e.g., Rand Mutual Assurance).
• The letter must reflect the company name.
• Exemptions only apply with a Department of Labour certificate of exemption.
• International suppliers must submit equivalent documentation from their country of origin.
• If the supplier has South African offices employing citizens, a COID certificate is required.
• Companies without employees can submit an insurance letter covering accidental death/disability (minimum R500,000).
• Proof of assessment and payment to the Compensation Commissioner is acceptable.
• All contractors/suppliers must undergo an OHS evaluation process for Eskom's Supplier Management System.
