The contractor's total liability for all matters is limited to the total of losses incurred and/or repairs to damages caused, excluding certain matters (loss of or damage to employer's property, delay damages, defects liability, insurance liability, damage to third party property, death or injury, IP infringement).

Occupational Health and Safety: the contractor must sign the OHS agreement under Section 37(2) of the OHS Act and Construction Regulation 5.1(k) before any work commences. The contractor must be an employer in its own right with duties under the OHS Act and Construction Regulations. Insurance: the contractor must ensure all employees are covered under the COID Act and provide a letter confirming good standing with the Compensation Fund or licensed insurer before starting work. The contractor must maintain public liability insurance and any other cover required by the subcontract agreement. The contractor must submit safety documentation, including a copy of the written Construction Manager appointment under Construction Regulation 8, seven days before work commences. The contractor must comply with all laws relating to bribery and corruption, including the Prevention and Combating of Corrupt Activities Act. The contractor must not cede, delegate or assign any rights or obligations without the employer's written consent. If the contractor is a joint venture or consortium, members are jointly and severally liable, and the contractor must notify the project manager and employer of the key person authorised to bind it within one week of the contract date.

The contractor must sign the Occupational Health and Safety Agreement under Section 37(2) of the OHS Act and Construction Regulation 5.1(k) before any work commences. The contractor is an employer in its own right with duties under the OHS Act and Construction Regulations. Requirements include: ensuring employees are covered under the COID Act and providing a letter of good standing with the Compensation Fund or licensed insurer; maintaining public liability insurance; conducting a baseline risk assessment by a competent person before work starts; appointing competent persons trained in OHS; providing and enforcing PPE use; reporting incidents to the Provincial Director of the Department of Labour and to the client; obtaining permits for work requiring them; prohibiting alcohol and intoxicating substances on site; and submitting safety documentation, including the written Construction Manager appointment under Construction Regulation 8, seven days before work commences.
