Supply of office furniture to maluti-a-phofung local municipality

Submit all required bidding documents as specified in the tender. Maintain confidentiality of all contract-related documents and information unless prior written consent is obtained from the purchaser. Return all copies of purchaser-provided documents upon contract completion if requested. Bids must be posted to the address furnished in the bid or notified later in writing. Closing time is the date and hour specified in the bidding documents.

Supply office furniture as per the contract. Goods must conform to the standards mentioned in the bidding documents and specifications. Supplier must provide packing sufficient to prevent damage or deterioration during transit, including exposure to extreme temperatures, salt, and precipitation. Packing must comply with special requirements in the contract. Goods must be new, unused, of the most recent models, and incorporate all recent design and material improvements. Warranty is valid for 12 months after delivery or 18 months after shipment, whichever concludes earlier. Supplier must repair or replace defective goods without cost to the purchaser upon notification.

Prices must not vary from those quoted in the bid unless authorized or due to a bid validity extension request. Payment will be made in Rand within 30 days of invoice submission, accompanied by a delivery note. Performance security of the specified amount must be furnished within 30 days of contract award notification. Acceptable forms: bank guarantee, irrevocable letter of credit, or cashier’s/certified cheque. Performance security will be discharged within 30 days of contract completion, including warranty obligations. Penalties for late delivery will be calculated using the current prime interest rate for each day of delay.

Supplier must indemnify the purchaser against third-party claims of patent, trademark, or industrial design infringement. Supplier must permit purchaser inspections and audits of performance-related records. Local content and imported content must be clearly distinguished in the bidding price. No contract will be awarded to bidders with outstanding tax matters (SARS certification required) or municipal rates/taxes in arrears. Supplier must not engage in corrupt, fraudulent, or collusive practices. Supplier must comply with South African laws and the contract must be interpreted accordingly.
