Two-stage evaluation: 1) Functionality (minimum 60/100 points required to proceed): Qualification of Key Personnel (30), Registration of Key Personnel with the Legal Practice Council (20), Letters of Reference (20), Bidders' Experience in Sector Law (30). 2) 80/20 Preference Points System (2022): Location-based points - Umuziwabantu Local Municipality (20), Ugu District Municipality (10), KZN (5), Outside KZN (0). Scope: Provide legal advisory services to Umuziwabantu Municipality’s Corporate Services Department for 36 months. Services include: Town Planning (illegal land use, by-law enforcement), Contract Management, Litigation & Claims, Compliance, Debt Collection, Labour Relations, Public Law, Policy Review, Municipal By-Law Enforcement, Interdicts, Infrastructure Projects, Traffic Services. Legal fields: Commercial/Contract Law, Civil Litigation, Town Planning By-Laws, Municipal By-Laws, Labour/Employment Law, Constitutional Law, Administrative Law, Construction Law, Insurance Law, Corporate Law, Environmental Law, Debt Collection, Traffic Services. Firms must be established per Legal Practice Act, registered with the Legal Practice Council, have own office facilities/staff, and extensive local government experience. Service Level Agreement required. Contract may be terminated with 1-month notice. No guarantee of work; municipality may use non-panel firms. Firms with pending matters against the municipality are disqualified. Application must include: Hourly Rate, CVs of key personnel, Company Profile, Travel/Subsistence costs.

Pricing: Submit hourly rates for Magistrates/Regional Court and High Court/non-litigious matters (e.g., Labour Courts, Supreme Court of Appeal, Constitutional Court) as per prescribed tariffs. Travel and subsistence costs must be included. Payment terms: Invoices must be submitted with delivery notes; payment within 30 days. Contract prices are fixed unless adjusted per bid validity extension. Performance security may be required within 30 days of award. Bids must remain valid for 120 days post-closing.

Mandatory: CSD registration (proof required). Tax Compliance: Submit SARS TCS PIN or CSD number. B-BBEE: Submit B-BBEE Status Level Verification Certificate or sworn affidavit (for EMEs/QSEs) to qualify for preference points. Municipal Rates: Proof of no arrears >90 days (or valid lease agreement). CIPC registration required. Legal Practice Council registration for firms/attorneys.
