• Work is classified as medium-risk.

• Mandatory OHS compliance with two options:

Option 1 (Non-certified suppliers):

• Signed Annexure B (acknowledgement of Eskom's OHS legal requirements).
• Project-specific OHS Plan addressing scope risks, aligned with health and safety specifications.
• Baseline OHS Risk Assessment (BRA) with methodology for identifying, assessing, and managing SHE risks.
• Valid Letter of Good Standing (COIDA or equivalent).
• CEO-signed OHS policy compliant with OHS Act Section 7.

Option 2 (Certified suppliers):

• Signed Annexure B.
• ISO 45001 certificate or equivalent.
• Valid Letter of Good Standing (COIDA or equivalent).

• Address project-specific OHS risks in your OHS Plan, aligned with Eskom’s health and safety specifications.
• Submit a Baseline OHS Risk Assessment (BRA) that identifies, assesses, and manages safety, health, and environmental risks related to the scope of work. Include the risk assessment methodology.
• Provide a valid Letter of Good Standing (COIDA or equivalent).
• Submit a signed Annexure B (acknowledgement of Eskom's OHS legal and other requirements).
• For suppliers with a certified auditable OHS system: Submit ISO 45001 certificate (or equivalent) instead of the OHS Plan, BRA, and policy.

Scope:

• Provision of periodical turbine and auxiliary oil analysis services at various TGS maintenance sites.
• Contract duration: 5 years, on an as-and-when-required basis.
• The tender aims to promote socio-economic transformation, empowerment of small enterprises, rural and township enterprises, designated groups, and local industrial development.

Evaluation is based on a preference point system aligned with Reconstruction and Development Programme (RDP) goals. Key points:

• Open to all suppliers capable of providing the required services.
• Suppliers must have a valid B-BBEE certificate. Non-compliant suppliers (Level 5–8 or non-compliant) must commit to achieving Level 4 within the first year and improve at least one level annually thereafter.
• Submission of a B-BBEE Improvement or Retention Plan is mandatory.
• Submission of the SDL&I implementation schedule is mandatory before contract award.
• The SDL&I Matrix (Local Content 50%, Skills Development 50%) is not an evaluation criterion but compliance is required for eligibility.

Scope of work:

• Provision of periodical turbine and auxiliary oil analysis services at various TGS maintenance sites.
• Contract duration: 5 years, on an as-and-when-required basis.
• Services must align with socio-economic transformation goals, including empowerment of small, rural, and township enterprises, designated groups, and local industrial development.

Mandatory compliance requirements:

• Valid B-BBEE certificate. Non-compliant suppliers (Level 5–8) must achieve Level 4 by the end of the first contract year and improve at least one level annually thereafter.
• Submission of a B-BBEE Improvement or Retention Plan.
• Supplier Development & Localisation (SDL&I) commitments:

• Local Content to South Africa: 100% target (50% weight).

• Skills Development: 50% weight. Must provide a bursary of R60,000 per ERI-assigned beneficiary at a registered South African university for every R4.8 million invoiced. Bursary must be ceded to a designated bank account as prescribed by ERI.

• Job Creation: Must indicate the number of jobs to be created and/or retained. At least 50% of semi-skilled and 100% of unskilled labour must be sourced from the Local Municipality where the service is consumed.

• Socio-Economic Development: Must spend 0.1% of the invoiced amount on Corporate Social Investment (CSI) initiatives for black communities as identified by ERI. Funds must be ceded to a special account as prescribed by ERI.

• Quarterly SDL&I compliance reports must be submitted using the SDL&I Data Collection Template. ERI will review reports within 60 days and notify the supplier of non-compliance. Corrective measures must be implemented before the next quarter.
• SDL&I implementation schedule must be completed and returned for acceptance before contract award.
• Penalty: 2.5% of the invoiced amount (excluding VAT) per quarter may be applied for failure to meet SDL&I obligations.

B-BBEE and SDL&I requirements:

• ERI reserves the right to award the contract to a supplier that commits to Transformation (B-BBEE Improvement or Retention Plan), Skills Development, Job Creation, and Socio-Economic Development for beneficiaries in Local Municipalities where the service is consumed.
• Supplier Development & Localisation Matrix: Local Content to South Africa (50% weight, 100% target) and Skills Development (50% weight).
• B-BBEE Retention or Improvement Plan:

• Respondents must indicate how they will maintain (if Level 1) or improve their B-BBEE status over the contract period.

• Respondents with a B-BBEE status of Level 5–8 or non-compliant must achieve Level 4 by the end of the first contract year and improve at least one level annually thereafter.

• Skills Development: Must provide a bursary of R60,000 per ERI-assigned beneficiary at a chosen South African university for every R4.8 million invoiced. Bursary funds must be ceded to a designated bank account as prescribed by ERI.

• The successful supplier must submit proposals before being eligible for award in accordance with Section 2(1)(f) of the Preferential Procurement Policy Framework Act (PPPFA).
• Respondents will be allocated points in terms of a preference point system based on specific goals.
• Specific goals relate to implementing the programmes of the Reconstruction and Development Programme (RDP).

Bidders will be evaluated on:

• Alignment of OHS management systems with Eskom requirements.
• Demonstrated experience in similar work (Eskom may request testimonials/references).
• Availability of competent resources and ability to manage subcontractors.
• Willingness to comply with all OHS legal requirements and undergo Eskom verification processes.

OHS Compliance Requirements:

• Supplier must understand and comply with Eskom OHS requirements, including Eskom contractor Health and Safety requirements standards 32-136, the Occupational Health and Safety Act, and the Compensation for Occupational Diseases and Illnesses Act.
• After contract award, supplier must fully align company processes with Eskom’s OHS policies, procedures, and standards.
• Penalties will be enforced on the main supplier for non-conformance by the supplier or its subcontractors.
• All employees (including contractors/suppliers) must undergo relevant Eskom induction.

Subcontractor Management:

• Main contractor must demonstrate selection criteria for appointing subcontractors.
• Must notify Eskom prior to appointing subcontractors for work commencement.
• Must ensure subcontractors have adequate resources and competencies.
• Main supplier is accountable for managing subcontractors to ensure compliance with legal and Eskom requirements.
• Main supplier must monitor subcontractors through audits and assessments for OHS compliance.
• Non-conformances by subcontractors will be addressed directly with the main contractor via performance and penalty processes.
• Eskom reserves the right to verify compliance and may request testimonials, references, and client contact details.

Acknowledgement Form Requirements:

• Complete the Company/Supplier Name.
• Provide the name of the Authorised Person (CEO/Director/Managing Director).
• Signature and date are required.
• Two witnesses (Witness 1 and Witness 2) must sign.
• Form confirms acknowledgement of obtaining OHS documents, full understanding, and consequences of non-compliance.
