Functionality criteria (Stage 2):

• Relevant experience in chilled-water AHU or comparable HVAC projects.
• Qualifications and experience of key personnel.
• Technical proposal and preliminary AHU information.
• Project methodology and implementation programme.
• Project resources and execution capacity.

Price and special goals (Stage 3): evaluated under the PPPFA and Preferential Procurement Regulations 2022, including B-BBEE preference points claimed on MBD 6.1.

JCT may call short-listed bidders for presentations before final selection.

Scope: replacement of three (3) existing chilled-water air-handling units (AHUs) at the Joburg Theatre, including detailed verification, engineering design, supply, delivery, removal of existing equipment, installation, connection, testing, commissioning and handover of complete, fully operational systems.

Existing equipment: AHUs manufactured in 1992; original design information (rated airflow, cooling capacity, fan duty, coil selection) is not available. Preliminary airflow and capacity estimates were developed from measured face areas of existing primary G4 filters and stated engineering assumptions. The successful bidder must verify all site conditions and perform detailed engineering and final equipment selection.

Replacement AHUs must:

• Incorporate mixing-box arrangements for controlled mixing of fresh air and return air.
• Be compatible with existing chilled-water, ductwork, electrical, control and building-services infrastructure.
• Include insulated, rigid, corrosion-resistant casings; fresh-air, return-air and mixed-air sections; control dampers and actuators; accessible filtration sections; chilled-water cooling coils; electric heating where required; condensate drain pans; high-efficiency fans and motors; variable-speed drives where required; vibration isolation; flexible connections; control valves, sensors and panels; safety devices; access doors and inspection panels.

Site inspection and verification: the contractor must verify physical dimensions and condition of existing AHUs; access, delivery, lifting and removal routes; ductwork sizes and connections; chilled-water pipe sizes, flow rates and differential pressure; electrical supply and capacity; control systems and BMS interfaces; structural supports and floor-loading capacity; maintenance access clearances; and any condition affecting design, installation, programme or cost.

Detailed engineering design: verify supply-air, return-air and fresh-air quantities; static pressures; duct pressure losses; cooling loads; sensible and latent capacities; design conditions; supply-air temperature and humidity; fresh-air/return-air proportions; chilled-water temperatures and flow; select coils, fans, motors, filters, dampers and controls; confirm compatibility; submit final design and equipment selection to the Employer for approval before procurement.

Removal and disposal: coordinate shutdowns and isolations with the Employer; safely isolate and remove existing AHUs and redundant equipment; protect building structure and theatre equipment; dispose of waste at approved facilities; make good any damage.

Performance requirements: new, energy-efficient, reliable equipment; achieve verified supply-air quantities and cooling performance; improve reliability, maintainability and operational performance; minimise disruption to theatre operations, performances, rehearsals and events; comply with applicable legislation, regulations and standards; provide complete testing, commissioning, operating documentation, warranties, maintenance information and training.

Contract period: 36 months from appointment, subject to satisfactory performance, annual reviews and budget availability. Work is commissioned on an as-and-when-required basis via purchase orders.

Bidders must demonstrate that their proposed approach and solutions fit JCT's requirements. The scope of work includes detailed verification, engineering design, equipment selection, supply, delivery, removal of existing AHUs, installation, connection, testing, commissioning and handover. Bidders must provide a technical proposal, project methodology and implementation programme, and project resources and execution capacity. The appointed service provider will be monitored on timeliness of service delivery, quality of service, and compliance with clearly stated specifications.

Bidders must demonstrate relevant experience in chilled-water AHU or comparable HVAC projects, and provide qualifications and experience of key personnel. Bidders must provide examples or references of similar works performed, and proof of successful completion of a minimum of 5 projects of similar size and nature. Failure to substantiate this will result in disqualification.

The specification defines minimum technical, functional, quality, performance, installation, testing and commissioning requirements for the replacement AHUs. The contractor must provide complete, fully operational and integrated systems, including all associated mechanical, chilled-water, ductwork, electrical, control, structural and ancillary works. All equipment must be new, unused, fit for purpose, and selected in accordance with verified site conditions and approved technical submissions. The contractor must submit final design and equipment-selection information to the Employer for review and approval before procurement or manufacture. The Employer reserves the right to verify the authenticity of all documents submitted and to request originals for inspection; false declarations or fraudulent documentation may result in disqualification and cancellation of award.

All prices must be quoted in South African Rand and be VAT inclusive. Prices must be net with all discounts deducted, and include cost of supply, transport, delivery, off-loading, labour, equipment and materials. The tender price must remain valid for at least 120 days after closing date. Only firm prices will be accepted; no price escalation. A detailed quotation on company letterhead must be submitted. The pricing schedule (MBD 3.1) must be fully completed; failure to price all items will invalidate the bid.

Pricing format: all prices in South African Rand, VAT inclusive, net of all discounts. Prices must include cost of supply, transport, delivery, off-loading, labour, equipment and materials, with no extra charges to JCT.

Firm prices only: no price escalation or variation will be considered; tender rates are firm for the contract duration.

Validity: bid prices must remain valid for at least 120 calendar days after the closing date. Shorter validity may render the bid non-responsive.

Pricing schedule: MBD 3.1 must be fully completed; failure to price all items will invalidate the bid. A separate pricing schedule is required for each delivery point if applicable.

Payment: invoices accompanied by delivery notes; payment within 30 days of statement submission.

Financial capacity evidence: current audited annual financial statements (if legally required) or most recent AFS with Public Interest Score calculation; municipal rates and taxes invoice or lease agreement with utility bill (not in arrears more than 90 days) for the bidder's premises and for each director's premises where applicable.

CSD registration: bidders must be registered on the National Treasury Centralised Supplier Database at the time of submission; provide a CSD summary report not older than 30 days.

Tax compliance: valid SARS Tax PIN and VAT registration certificate (rationale if not VAT registered). Foreign suppliers must complete the pre-award questionnaire in MBD 1 Part B:3.

B-BBEE: valid certified B-BBEE certificate or sworn affidavit for EMEs/QSEs on the DTI template; failure to submit results in zero preference points.

CIDB: bidders must hold a CIDB contractor grading designation of 3ME or higher.

CIPC: proof of entity registration with date of incorporation, list of directors/partners/members, and share certificates.

COIDA: letter of good standing from the Compensation Fund or licensed compensation insurer.

Identity: certified copies of South African ID documents or valid passports of members, directors or owner (certified by Commissioner of Oaths, not older than 3 months).

Local office: bidders must have an office within the Johannesburg Municipality; the address must be provided and will serve as domicilium citandi et executandi.

Joint ventures: each party must submit separate tax clearance/CSD; a Joint Venture Agreement showing percentage contribution of each partner must be attached.

State employees: no bids will be considered from persons in the service of the state.

Good standing: bidders must be in good standing to do business with the public sector in terms of Regulation 38 of the SCM Regulations.

The contractor must comply with the Occupational Health and Safety Act and all relevant regulations, including for all employees and other contractors on site. A suitable health and safety plan appropriate for the contract must be provided. The contractor must comply with all laws relating to wages and conditions of employment. Prior to commencement, the contractor must give written proof of registration as an employer under the Compensation for Occupational Injuries and Diseases Act, and remain registered for the contract duration; failure to comply results in disqualification. The contractor indemnifies JCT from the provisions of the OHSA.

Contract duration: 36 months from appointment, subject to satisfactory performance, annual reviews, continued compliance and budget availability. Work is commissioned as-and-when-required via purchase orders; no minimum value guaranteed.

Warranty: supplier warrants goods are new, unused, current models, free from defects in design, materials and workmanship. A 5-year manufacturer's warranty covers defects excluding normal wear and tear. JCT must notify in writing; supplier must repair or replace at no cost; if not remedied, JCT may take remedial action at supplier's risk and expense.

Contract amendments: only by written amendment signed by both parties.

Rates: firm, no price variation or escalation.

Assignment: not permitted without JCT's prior written consent.

Delays: supplier must notify JCT in writing of any delay, its duration and cause. JCT may extend time with or without penalties. Penalties for late delivery or performance are calculated on the delivered price of delayed goods or unperformed services using the current prime interest rate per day of delay. JCT may also terminate the contract.

Indemnity: contractor uses JCT premises at own risk and indemnifies JCT against all loss, damage, injury or death arising from use of premises, except for JCT's wilful acts or gross negligence.

Insurance: contractor must maintain public liability insurance covering JCT and contractor, and insure its own equipment. JCT must be notified immediately of any claim; all insurance must remain in force for the contract duration.

Compliance: contractor must comply with the Occupational Health and Safety Act and all relevant regulations, provide a suitable health and safety plan, and comply with all labour laws. Contractor must be registered as an employer under the Compensation for Occupational Injuries and Diseases Act and provide written proof before commencing work.

Termination: JCT may terminate the contract for delays or other breaches; if terminated for reasons not attributable to the contractor, the contractor is remunerated for work completed up to the total fee bid for that phase.
