Prices must be fixed for the contract duration unless otherwise stated in the Invitation to Tender. Submit prices in South African Rand unless instructed otherwise; exchange rates and base dates are specified in the Tender Data. Alternative tenders are only accepted if a main tender is submitted and permitted by the Invitation to Tender. Corrections to pricing must be initialed by all signatories; do not use correction fluid or tape. Eskom may request clarification or correction of prices during evaluation, but mandatory returnables cannot be submitted after the closing date. Arithmetical errors may be corrected by Eskom with the tenderer’s concurrence. Insurance coverage must be verified independently, as Eskom’s insurance may not cover all contract requirements.

Tenderers must comply with all eligibility criteria in the Tender Data and not be restricted from doing business with Eskom or State-Owned Companies. Sub-contracting 100% of the scope of work is prohibited and results in disqualification. Proof of authority to act as an agent must be submitted if applicable. Compliance with relevant legislation is mandatory, including National Treasury Instruction Notes, CIDB Regulations, PPPFA Regulations, Amended B-BBEE Codes, COIDA, OHS Act, and Eskom’s SHEQ requirements. Proof of SHEQ systems, policies, and capabilities must be provided by the closing date and time. CIDB registration (or proof of application) is mandatory if stipulated in the Tender Data; actual proof must be submitted by contract award if only an application was provided initially. Contract Skills Development Goals (CSDG) and Contract Participation Goals (CPG) apply as per CIDB standards for contracts meeting duration, value, or grading thresholds. B-BBEE certificates/affidavits must be valid and submitted by the closing date if used as a pre-qualification criterion; fraudulent or expired documents result in disqualification. For PPPFA scoring, missing or invalid B-BBEE documentation results in zero points. Designated materials and thresholds information must be submitted by contract award. SDL&I Undertaking must be completed and submitted by contract award. Misrepresentation or falsification of documents leads to disqualification and potential legal consequences.

Tenderers must comply with the OHS Act and Eskom’s SHEQ requirements. Proof of SHEQ systems, policies, and capabilities must be submitted by the closing date and time for tender submission and/or contract award. All SHEQ-related costs and personnel must be included in the tender pricing. CIDB registration (or proof of application) is mandatory if required by the Tender Data; actual proof must be submitted by contract award if only an application was provided initially. Contract Skills Development Goals (CSDG) and Contract Participation Goals (CPG) apply as per CIDB standards for eligible contracts.

Eskom will respond to clarification requests received before the closing date and publish responses on the same platform as the Invitation to Tender. Tenderers must check the Eskom Tender Bulletin and NT e-Tender Portal regularly for updates.
