Evaluation uses the 80/20 preference point system.

• Price: 80 points, scored using the formula Ps = 80(1 - (Pt - Pmin)/Pmin), where Pt is the bidder’s price and Pmin is the lowest acceptable bid. The lowest acceptable bid determines the scoring system.
• Specific Goals: 20 points, awarded for B-BBEE ownership. Companies with at least 51% Black ownership may claim 10-20 points. Verification is via CSD, B-BBEE scorecard, CIPC, or municipal databases. Failure to submit proof forfeits preference points.

Mandatory requirements (disqualification if not met):

• Registration on the Central Suppliers Database (CSD). Non-registration at bid closing disqualifies the bidder.
• Valid Tax Compliance Status (TCS) PIN or CSD number. For consortia/joint ventures, each party must submit separate TCS/CSD documentation.
• Submission of all required bid documents by the deadline.
• No state employees or their associates as directors/owners.

Scope: Provide comprehensive 'cradle-to-grave' Health Care Risk Waste Management (HCRWM) services for approximately 600 KZN Department of Health institutions (hospitals, CHCs, clinics, mortuaries, EMS bases) over 36 months.

Services required:

• Labelling, internal transportation, interim/central storage, collection, and external transportation of HCRW.
• Treatment and disposal of HCRW in compliance with all applicable legislation.
• Tracking and traceability of all waste streams.
• Provision of legally compliant containers for all HCRW generated (see Annexure B for specifications).

System requirements:

• Sustainable, cost-effective, environmentally acceptable, efficient, and uniform.
• Must comply with: National Health Act, National Environmental Management Act, Waste Act, Environmental Conservation Act, Road Traffic Act, Water Act, Waste Information System Regulations, Hazardous Substances Act, and other relevant legislation.

Additional details:

• The Department generates approximately 4,900 metric tons of HCRW annually.
• Annexures provide: list of facilities (Annexure A), container specifications (Annexure B), waste vehicle allocation (Annexure C), and indicative HCRW volumes per district/area (Annexure D).

Standards: Goods/services must conform to bidding documents and SANS/SABS/ISO standards.

• Inspections: Premises must be open for inspection at reasonable hours. Pre-bidding testing costs are the bidder’s responsibility.
• Non-compliance: If inspections reveal non-compliance, the supplier pays for tests; goods/services may be rejected. Rejected items must be removed/replaced at the supplier’s cost.
• Purchaser may procure substitutes at the supplier’s expense if delays occur.
• Supplier must permit audits of performance records.
• Packing: Must prevent damage/deterioration during transit (e.g., rough handling, extreme temperatures, precipitation).
• Marking/documentation must comply with contract/SCC requirements.

Pricing: Submit detailed pricing schedules for Area 1, Area 2, and Area 3 (refer to Annexures for specifics).

Payment terms:

• Invoices must be accompanied by delivery notes.
• Payments will be made within 30 days of invoice submission.
• Currency: South African Rand (ZAR).

Performance security:

• Successful bidder must furnish a bank guarantee, irrevocable letter of credit, or cashier’s/certified cheque within 30 days of contract award.
• Security must be denominated in ZAR or a freely convertible currency acceptable to the purchaser.
• Security will be discharged and returned 30 days after contract completion, including warranty obligations.

Penalties:

• Delayed delivery or performance incurs daily penalties calculated at the current prime interest rate on the value of the delayed goods/services.
• Persistent delays may result in contract termination.

Pricing adjustments:

• Prices are fixed per bid; adjustments only allowed via Special Conditions of Contract (SCC) or validity extensions.

Mandatory compliance:

• Central Suppliers Database (CSD) registration: Required for all bidders. Register at www.csd.gov.za. Non-registration at bid closing disqualifies the bidder.
• Tax Compliance: Submit SARS Tax Compliance Status (TCS) PIN (apply via eFiling at www.sars.gov.za). If no TCS PIN is available, provide CSD number. For consortia/joint ventures, each party must submit separate TCS/CSD documentation.
• B-BBEE: Submit B-BBEE Status Level Verification Certificate or sworn affidavit (for EMEs/QSEs) to qualify for preference points. Verification may be conducted via CSD, B-BBEE scorecard, CIPC, or municipal databases.
• Foreign suppliers: Must confirm if they are a resident of RSA, have a branch in RSA, have a permanent establishment in RSA, have any source of income in RSA, or are liable for taxation in RSA. If the answer is 'no' to all, no SARS TCS PIN is required.

Disqualification criteria:

• Bids from state employees, companies with state-employed directors, or close corporations with state-employed members are invalid.
• Submission of Bidder’s Disclosure Form (SBD4) is mandatory to declare any conflicts of interest or relationships with procuring institution staff.

National Industrial Participation Programme (NIPP):

• Applies if the contract has imported content equal to or exceeding US$10 million.

• HCRW management must ensure: proper containerization, storage, collection, transportation, treatment, and disposal.
• The system must be environmentally acceptable, with tracking/traceability for all waste streams.
• Annexure D provides indicative HCRW volumes per district/area to guide service planning.
• Non-compliance with environmental regulations may result in contract termination or legal penalties.

Contract duration: 36 months.

• Performance security: Bank guarantee, irrevocable letter of credit, or cashier’s/certified cheque due within 30 days of award. Discharged 30 days post-completion (including warranty obligations).
• Payment: Invoices must be accompanied by delivery notes; payments made within 30 days in ZAR.
• Prices: Fixed per bid; adjustments only via Special Conditions of Contract (SCC) or validity extensions.
• Penalties: Daily prime interest rate on delayed goods/services. Persistent delays may result in termination.
• Termination: For default (non-delivery, breach, corruption/fraud), insolvency, or force majeure.
• Disputes: Mediation first, then South African courts.
• Liability: Supplier liable for defects (12-18 month warranty); aggregate liability capped at contract price (excluding repair/replacement costs).
• Subcontracts: Must be notified in writing; supplier remains liable.
• Force majeure: Exempts supplier from penalties if beyond their control.
• Anti-dumping/countervailing duties: Supplier bears costs.
• Confidentiality: Contract documents/information may not be disclosed without purchaser’s consent.
