Submission channel: sealed envelope addressed to the Municipal Manager of Nongoma Local Municipality, clearly marked with tender number and description, deposited into the Tender Box at the reception of Nongoma Local Municipality main offices (Lot 103, Main Street, Nongoma, 3950) before 12h00 on 2 September 2026. Late, faxed, emailed or incomplete bids will not be considered. Bids must be on official forms, not re-typed. Each page must be initialled or signed by the authorised signatory. Use of correcting fluid is prohibited; alterations must be initialled.

Evaluation uses responsiveness criteria first; only responsive bids proceed to the 80/20 preference point system under the PPPFA 2022 regulations. Points: 80 for price, 20 for specific goals. Pricing schedule (MBD 3.3) requires for each item (Petrol Chainsaw, quantity 38; Heavy Duty Pots, quantity 140) a unit price, monthly rate, and quote price in RSA currency including all applicable taxes. Subtotal, add 15% VAT, total tendered price. The offer must be valid for 120 days. The Form of Offer and Acceptance states the price includes VAT and that the bidder is a registered VAT vendor.

CSD registration is compulsory; failure to submit a CSD supplier registration report disqualifies the bid. Tax compliance: submit SARS PIN or TCS certificate; each party in a consortium/JV/subcontract must submit separately. Bidders must not be on the National Treasury Register of Tender Defaulters or List of Restricted Suppliers. Persons in the service of the state are excluded. Foreign suppliers must complete the Part B:3 questionnaire. B-BBEE: specific-goal points claimed via MBD 6.1 (see evaluation criteria). No minimum B-BBEE level is stated.

The successful bidder must sign a written contract (MBD 7.1) and a service level agreement. The RFP and tender response will be incorporated into the contract; the RFP prevails on conflict. The contract is subject to the General Conditions of Contract (GCC) 2015. The bidder must deliver any required guarantee per GCC clause 6.2 within the period stated in the contract data, and other bonds, guarantees, proof of insurance within 14 days of the agreement coming into effect. Failure to do so constitutes repudiation. The agreement comes into effect when the bidder receives a fully completed copy; the bidder has 5 days to notify the employer of any reason for non-acceptance. Deviations are only valid if included in the signed Schedule of Deviations.

Tender defaulters and restricted suppliers will not be awarded. The municipality is not liable for costs incurred in preparing tenders. This document prevails over any briefing information. The bidder indemnifies the municipality for costs/damages from breach. Disqualification for collusive tendering, seeking unlawful advantage, offering inducements, or past fraud convictions. Payment within 30 days of satisfactory delivery. A separate written contract and service level agreement are required.
