The Contractor must submit a first programme for acceptance within 2 weeks of the contract date. The starting date is the date of contract award. The Contractor submits revised programmes at intervals no longer than 2 weeks. The Employer is not willing to take over the works before the Completion Date.

• Liability for death of or bodily injury to employees of the Contractor: amount required by applicable law.

Insurance Table B – Employer provides: Assets All Risk, Contract Works, Environmental Liability, General and Public Liability, Transportation (Marine), Motor Fleet and Mobile Plant, Terrorism, Cyber Liability, Nuclear Material Damage and Business Interruption, Nuclear Material Damage Terrorism – all per the insurance policy document.

Limitation of liability:

• Contractor's liability for indirect or consequential loss is limited to the sum of the loss arising from any negligent act by any person under the contractor's employ or direct supervision.
• For any one event, liability for loss of or damage to Employer's property is limited to the amount of the deductibles relevant to the event.
• Liability for Defects due to design not listed on the Defects Certificate is limited to the greater of the total of the Prices at the Contract Date and the amounts excluded and unrecoverable from the Employer's assets policy for correcting the Defect plus the applicable deductible.
• Total liability for all matters (other than excluded matters) is limited to the total of the Prices. Liability for additional excluded matters is not limited.

Employer's limitation of liability:

• The Contractor must submit an updated verification certificate and necessary supporting documentation confirming the change in its B-BBEE status to the Project Manager within 30 days of the notification, or as otherwise instructed by the Project Manager.
• If the Contractor's B-BBEE status has decreased since the Contract Date, the Employer may either re-negotiate the contract or terminate the Contractor's obligation to Provide the Works.

Asbestos requirements (Z15):

• The Employer ensures that the ambient air in the work area conforms to the acceptable prescribed South African standard for asbestos, as per the Asbestos Regulations under the Occupational Health and Safety Act, 1993. The occupational exposure limit (OEL) for asbestos is 0.2 regulated asbestos fibres per millilitre of air as a 4-hour TWA, and the short-term exposure limit is 0.6 regulated asbestos fibres per millilitre of air as a 10-minute TWA.
