ESKOM is establishing a national panel of suppliers for the treatment, testing and supply of wood poles and cross-arms on an as-and-when-required basis over a five-year contract period. The panel will operate through mini tenders, and bidders must commit to specific sdl&i obligations, including b-bbee improvement, local procurement content, and skills development. The most consequential consideration is that b-bbee status directly determines preference points (up to 10 or 20 points) and a valid b-bbee certificate or sworn affidavit is a condition for contract award.
B-BBEE evidence: Submit a valid B-BBEE certificate (SANAS-accredited), sworn affidavit (EMEs with revenue ≤ R10m), or CIPC-issued certificate for EMEs; joint ventures need a certificate in the JV's name. This is a condition for contract award.
Preference points: Points are awarded per B-BBEE level under the 90/10 or 80/20 system (e.g., Level 1: 10/20 points, Level 2: 9/18, Level 3: 6/14, Level 4: 5/12). Missing documentation means 0 points for specific goals.
B-BBEE improvement plan: Submit a B-BBEE improvement or retention plan within 30 days of contract signing. Level 4 bidders must reach Level 3 by end of year one; Levels 5-8 must reach Level 4 by year one and improve one level annually thereafter.
SDL&I obligations: Commit to local procurement content (100% target), procurement from designated groups (Black-owned 4%, Black women-owned 3%, Black youth-owned 2%, Black persons with disability 1%), and local-to-site spend of 70% of local content. These become contractual obligations.
Skills development: Propose skills development for unemployed candidates (e.g., Wood Preservation NQF4, Chainsaw Operator, Code 14 Driver Training) at mini tender stage; Eskom will not fund these costs.
SDL&I security and penalties: Eskom retains 2.5% of each invoice (excluding VAT) as security for SDL&I obligations, and a 2.5% penalty applies for non-compliance. Retained amounts are released only after compliance reports are approved.
Subcontracting: At mini tenders above R30m, mandatory subcontracting of at least 30% to designated groups may apply; submit a letter of intent at tender stage and full subcontracting returnables at mini tender stage. Subcontracting to entities with lower B-BBEE levels is capped at 25% unless they are capable EMEs.
