• Scope: Finalisation of Majakaneng township establishment (Phase 1 and Phase 2) on the remaining portions of Portion 25 (Farm Wolhuterskop) and Portion 28 & 37 (Farm Groenkloof 464 JQ) – total area approx. 34.81 ha for Phase 2.\n- Deliverables:\n 1. Inception & Data Collection (10 % of contract value) – Inception report, Project Implementation Plan with timelines & methodology, locality map, title deed, site inspection report, conveyancer certificate, land‑surveyor certificate.\n 2. Registration Copies (20 %) – Consolidation/subdivision SG diagrams, original General Plan, original title deeds (or replaced deeds), original Act letters.\n 3. Township Register (40 %) – Proof of township register opened with the Deeds Office.\n 4. Proclamation & Close‑out (30 %) – Proclamation notice in the Provincial Gazette.\n- Housing targets: Phase 1 – approx. 704 mixed‑type units (BNG & FHFS); Phase 2 – approx. 458 mixed‑type units (BNG & FHFS).\n- All applications must comply with municipal by‑law requirements and obtain necessary consents from the municipality, NW DHS and other relevant authorities.

• Proposal delivery: proposals must be delivered to the address stated above; no electronic submissions are accepted.\n- Late or incomplete proposals: will be rejected.\n- Pricing schedule (as per Scope of Work):\n 1. Inception & Data Collection – deliver inception report, implementation plan, methodology, data collection documents, conveyancer and land‑surveyor certificates.\n 2. Registration Copies – obtain and submit consolidation/subdivision diagrams, original General Plan, title deeds and Act letters.\n 3. Township Register – provide proof of registration opened with the Deeds Office.\n- Method statements: each deliverable must be accompanied by a detailed method statement outlining the approach, resources, timelines and quality controls.

• All contract documents, specifications and related information are the property of the purchaser.\n- The supplier may disclose such information only to its own personnel who need it to perform the contract and must keep it confidential.\n- No use of the documents is permitted without prior written consent of the purchaser, except for performance of the contract.\n- Upon completion of the contract, all copies of the documents must be returned to the purchaser if requested.\n- The purchaser may audit the supplier’s records relating to contract performance.

Proclamation & Close‑out – 30 % (total 100 %).\n- Payment terms: payment within 30 days of receipt of a correct tax invoice after the works are completed.\n- Validity: quotation must remain valid for up to 90 days (earlier validity periods are permitted but may lead to rejection).\n- Price evaluation: points scored for price calculated using the formula PS = 80 × (1 – (Pt‑Pmin)/Pmin).

• Tax compliance: supplier must provide a valid Tax Compliance Status (TCS) PIN (obtained via SARS e‑filing) or, if no PIN, a Central Supplier Database (CSD) number.\n- Standard bidding documents: complete SBD1, SBD4 and SBD6.1.\n- CSD registration: include CSD supplier registration number for verification.\n- Joint venture/consortium: where applicable, submit the JV/Consortium agreement or Trust Deed.\n- Public‑sector employment restriction: no bids from persons in the service of the state or companies with directors who are state employees.\n- Failure to provide any of the above documents renders the bid non‑compliant and may lead to automatic disqualification.

• Preference‑point system: 80/20 (price 80 pts, specific goals 20 pts).\n- Points for specific goals: Black Women‑Owned (max 4 pts), Youth (max 7 pts), Disabled People (max 5 pts), Military Veterans (2 pts), HDSA (2 pts).\n- Documentation: CSD number or sworn affidavit required for each claim.\n- Failure to provide documentation: interpreted as no claim – 0 pts for specific goals.

• The supplier must comply with all applicable health, safety and environmental legislation while performing the works.\n- All personnel on site must be trained and equipped in accordance with OHS regulations.\n- The supplier shall develop and submit a site‑specific safety plan for approval prior to commencement of any activity.\n- Any incident or accident must be reported immediately to the purchaser and investigated in line with OHS requirements.

• Payment: payable within 30 days of receipt of a correct tax invoice after completion of the works.\n- Prices: fixed as per the pricing schedule; no variation allowed except as authorised in the SCC or by a formal bid‑validity extension.\n- Contract amendments: only by written amendment signed by both parties.\n- Assignment: supplier may not assign any part of the contract without prior written consent of the purchaser.\n- Sub‑contracts: supplier must notify the purchaser of all sub‑contracts; notification does not relieve the supplier of liability.\n- Delays: supplier must notify the purchaser in writing of any delay, its cause and expected duration. The purchaser may grant an extension with or without penalties.\n- Penalties: for each day of delay, a penalty equal to the delayed amount multiplied by the current prime interest rate may be deducted from the contract price.\n- Termination for default: purchaser may terminate if the supplier fails to deliver, perform obligations, or engages in corrupt/fraudulent practices.\n- Dumping & counter‑vailing duties: supplier bears any duties; the state is not liable for provisional payments.\n- Force majeure: supplier not liable for delays caused by events beyond its control; must notify purchaser and continue performance as far as practicable.\n- Termination for insolvency: purchaser may terminate without compensation if the supplier becomes insolvent.\n- Dispute settlement: parties must first attempt amicable resolution; if unsuccessful after 30 days, mediation may be initiated, otherwise the dispute may be referred to South African courts.\n- Limitation of liability: supplier not liable for indirect or consequential loss; total liability limited to the contract price, except for penalties or warranty obligations.\n- Governing language: English.\n- Applicable law: South African law.\n- Notices: must be sent by registered or certified mail to the address provided in the bid; deemed served on posting.\n- Taxes & duties: local supplier responsible for all taxes and duties up to delivery; foreign supplier responsible for taxes outside South Africa.\n- National Industrial Participation Programme (NIPP): applicable as per the Department of Trade and Industry.

• Tax compliance: supplier must be a resident or have a permanent establishment in South Africa, be liable for South African taxes and provide a valid TCS PIN (or CSD number if no PIN).\n- Entity status: if the entity is not a South African resident, a branch, permanent establishment or source of income in RSA, registration for a tax compliance status system is not required.

• Stage 1 – Compliance: verification of mandatory documents (standard bidding forms, CSD/TCS details, JV/Consortium agreements).\n- Stage 2 – Functionality: bidder must meet the functional threshold set out in the TOR; failure results in loss of functionality points.\n- Stage 3 – Price & Specific Goals: weighting – Specific Goals 20 pts, Price 80 pts.\n- Price scoring: PS = 80 × (1 – (Pt‑Pmin)/Pmin).\n- Specific Goals: points awarded as per the B‑B‑BEE preference table (Black Women‑Owned, Youth, Disabled People, Military Veterans, HDSA).
