• Submit a complete original tender plus one (1) complete hard copy in English, completed in ink (not pencil). Failure to provide the hard copy will result in disqualification.
• Submit to the address and tender box specified in the Tender Data. Proof of posting or courier delivery is not accepted as proof of delivery.
• Ensure Eskom receives the tender by the deadline (10:00 SAST, GMT+2). Late tenders will not be accepted. Time is strictly verified using the Telkom time signal.
• Seal the original and copy as separate packages marked 'ORIGINAL' and 'COPY'. Place these in an outer package marked 'CONFIDENTIAL' with only the Eskom address and Invitation to Tender number on the outside.
• Include all mandatory tender returnables by the submission deadline. Missing mandatory documents will render the tender non-responsive.
• Complete and submit the Acknowledgement Form, clearly stating if the tender is for the whole or part of the works.
• Where an agent submits on behalf of a principal, provide an authenticated copy of the authority to act as agent.
• Tenders may not be submitted telephonically or by email unless explicitly stated in the Tender Data.
• Eskom employees are not permitted to deposit tenders on behalf of a tenderer.
• Tenders must be held valid for acceptance by Eskom for the specified validity period. Extensions may be requested but cannot modify the tender.
• No alterations or additions to tender documents are permitted except to correct errors or comply with Eskom Representative instructions. All corrections must be initialed by all signatories.

• Eligibility: Tenderer must comply with criteria in the Tender Data and not be restricted from doing business with Eskom/State-Owned Companies.
• Subcontracting: Cannot subcontract 100% of the Scope of Work (SOW). Such tenders will be disqualified.
• Mandatory Documents: Submit all mandatory tender returnables by the deadline. Missing documents render the tender non-responsive.
• Basic Compliance: Failure to meet basic compliance (e.g., missing hard copy, incorrect sealing) results in disqualification.
• Pre-Qualification: If applicable, tenderers must meet pre-qualification criteria. No 'double dipping' (measuring the same criterion twice in different phases).

• Designated Materials: Meet the specified percentage (gatekeeper) for local procurement of designated materials (per dti). Failure renders the tender non-responsive.
• Ranking: Tenders are ranked by combining Price and B-BBEE scores (PPPFA). Higher points rank higher.
• Objective Criteria: Contracts may be awarded to non-highest scorers only if objective criteria (per PPPFA Section 2(1)(f)) are stipulated in the tender documents. Functionality and B-BBEE scorecard elements cannot be used as objective criteria.
• Reverse e-Auction: If applicable, Eskom may use a reverse e-auction system. Tenderers must submit a complete tender without prices. Including prices will result in them being disregarded.

• Review all specification and/or works information provided by Eskom in the enquiry documents.
• Compulsory Site Visit: Attend the site visit and/or clarification meeting (if cited in Tender Data) to familiarise with the location, proposed work, and requirements. Failure to attend disqualifies the tender.
• SHEQ Requirements: Provide reasonable proof of Safety, Health, Environment, and Quality (SHEQ) systems, policies, and capabilities at contract award. All associated costs and personnel must be included in the tender.
• Standardised Specifications: Obtain the latest revision of any standardised specifications or documents referenced in the enquiry but not attached.

• Currency: Prices must be in South African Rand unless otherwise instructed in the Tender Data. Exchange rates and base dates are stipulated in the Invitation to Tender if other currencies are permitted.
• Inclusions: All duties, taxes (including VAT), and other levies applicable 14 days prior to the tender submission deadline must be included in the rates, prices, and tendered total.
• Fixed Pricing: Rates and prices must be fixed for the contract duration, with adjustments only as provided in the Enquiry.
• Performance Security: If required, indicate at least two (2) financial institutions likely to provide the required form of security. Eskom reserves the right to reject unsuitable institutions.
• Cost Responsibility: Eskom will not compensate tenderers for any costs incurred in tender preparation, submission, negotiation, or testing to demonstrate compliance with evaluation criteria.
• Arithmetical Corrections: Eskom may correct arithmetical errors (e.g., decimal misplacement, line item totals, summation errors). Tenderers may confirm or accept corrections, but failure to do so may lead to rejection.

• Legislation: Comply with all relevant legislation, including National Treasury (NT) instructions (CSD), CIDB regulations for construction works, PPPFA, Amended B-BBEE Codes, COIDA, OHS Act, and Eskom’s SHEQ requirements.
• B-BBEE: Provide valid proof of B-BBEE level (CSD report, certificate, or affidavit) at tender submission. Fraudulent or expired documents will disqualify the tender. Sub-contractors’ B-BBEE status must also comply with PPPFA requirements if applicable.
• CIDB Registration: If applicable, proof of CIDB registration is mandatory at tender closing. If only an application is available at the deadline, submit it then and provide actual registration proof by contract award. Failure to comply disqualifies the tender.
• Designated Materials: Meet the specified percentage (gatekeeper) for local procurement of designated materials (per dti). Failure renders the tender non-responsive.
• SD&L Undertaking: Submit the completed Supplier Development & Localisation (SD&L) Undertaking by contract award. Failure to submit will exclude the tender from award consideration.
• Contract Skills Development Goal (CSDG): Applies to contracts exceeding R60 million with a duration of 12 months or more, or professional services contracts exceeding R5 million with a duration of 12 months or more. Must achieve the CSDG as established in the CIDB Standard.
• Contract Participation Goals (CPG): Applies to Grade 7-9 General Building (GB) and Civil Engineering (CE) contracts with a duration of 6 months or more and at least 25% subcontracting. Must achieve at least 5% engagement of targeted enterprises.
• Misrepresentation: Eskom may disqualify tenders for misrepresented or falsified information, certificates, affidavits, or documents. Fraudulent B-BBEE certificates or 'fronting' will be reported to the B-BBEE Commissioner, leading to suspension from state business for up to 10 years and potential legal action.

Evaluation is based on: Financial – Best price (80% weighting), B-BBEE (20% weighting). Tenderers must be registered on the National Treasury Central Supplier Database (CSD). Must possess a valid Second-Hand Goods Act certificate from SAPS (for scrap dealers/recyclers). Must have a valid Certificate of Good Standing (COID). Tax compliance is mandatory; a Tax Clearance Certificate must be submitted with the tender for local suppliers and foreign suppliers with a South African footprint. Bidders with existing/expired Eskom contracts who defaulted, or who have open non-conformances, will be disqualified. Only contractors who attend the mandatory site meeting may tender.

Scope: Purchase, collection, and removal of various ferrous scrap material at Lethabo Power Station on a once-off agreement. Contractor responsibilities: Provide safe collection, handling, removal, loading, and transportation. Clean the site after removal. Supply own bins, qualified labour, certified plant, machinery, equipment, and transport. An Eskom representative will witness loading to ensure correct material is loaded. Goods on sale will be identified by Eskom. Commodities include Electric Motors, Pumps, Valves, Bearings, Couplings (sold by LOT). Site and safety requirements: Adhere to Eskom site agent conditions for site access. No littering; provide facilities for waste collection. Portable fire fighting equipment must be available. Comply with the OHSA Act. Oil spills must be rehabilitated by the contractor. PPE must be worn on all Eskom sites during viewing/visits. No accommodation allowed on site. Environmental: Comply with National Environmental Management Act to prevent pollution. Warranty: Equipment sold 'Voetstoots' – no guarantee on workability or condition.

Pricing must be submitted with the Offer to Purchase form (Annexure B). Pricing is based on LOT for each commodity (Electric Motors, Pumps, Valves, Bearings, Couplings). Prices offered should be VAT exclusive. Offers are valid for 90 days from tender closing date. No specific payment terms, bonds, or guarantees are detailed in the document.

Mandatory documents (disqualifiable if missing): CSD registration proof (valid and current), B-BBEE Affidavit (on DTI Template) or Verification Certificate from accredited agency, Second-Hand Goods Act certificate from SAPS (for scrap dealers/recyclers), CIPC company registration documents, valid COID certificate of good standing, copies of ID documents of directors. General compliance: Tenderers must not be listed on the Register for Tender Defaulters or Restricted Suppliers. Tenderers with existing/expired Eskom contracts that defaulted will be disqualified.
