If inspections reveal non-compliance, the supplier bears the cost of inspections and must replace or repair defective goods. Purchaser may reject non-compliant supplies, with supplier responsible for removal and substitution. Supplier must permit purchaser to audit performance-related records.

The bidder must indicate a complete list of similar contracts awarded over the last five (5) years, including the current contract (if any). This information shall be deemed material to the award of this bid. Provide company name, nature of work, value of work, contact person and contact number, and duration of the project (start and end date).

For consortia/joint ventures/sub-contractors, each party must submit a separate TCS certificate/PIN/CSD number. Bidders must submit a B-BBEE Status Level Verification Certificate or sworn affidavit (for EMEs & QSEs) to qualify for preference points. Proof of authority to sign (e.g., company resolution) must be submitted. No bids will be considered from persons in the service of the state or entities with directors/members in the service of the state. Completed and signed SBD forms (SBD1, SBD3.1, SBD4, SBD6.1) must be submitted. Contract terms include: Payment within 30 days of invoice submission. Prices must not vary from quoted bid prices unless authorized. Contract amendments require written agreement. Supplier may not assign obligations without purchaser’s consent. Subcontracts must be notified in writing. Delays may incur penalties calculated using the current prime interest rate. Purchaser may terminate the contract for default, with supplier liable for excess costs. Force majeure events are recognized. Supplier must indemnify purchaser against third-party claims of patent or trademark infringement. Goods must be insured against loss or damage. Warranty period is 12 months post-delivery or 18 months post-shipment, whichever is earlier. Supplier must repair or replace defective goods at no cost to purchaser.

B-BBEE STATUS LEVEL VERIFICATION CERTIFICATE/ SWORN AFFIDAVIT (FOR EMES & QSEs) MUST BE SUBMITTED IN ORDER TO QUALIFY FOR PREFERENCE POINTS FOR B-BBEE.

The General Conditions of Contract (GCC) form part of all bid documents and may not be amended. Special Conditions of Contract (SCC) relevant to a specific bid should be compiled separately and will supplement the GCC; in case of conflict, SCC prevails. Key clauses include: packing to prevent damage during transit, insurance of goods, payment within 30 days of invoice, prices not varying from bid prices, contract amendments in writing, no assignment without consent, delays may incur penalties, termination for default may lead to restriction from doing business with the public sector for up to 10 years, and supplier must be given 14 days to respond to intended restriction.
