Joburg City Theatres (JCT) is an independent municipal entity wholly owned by the City of Johannesburg Metropolitan Municipality, operating world-class theatre venues. This tender seeks to appoint a supplier for the supply and delivery of alcoholic and non-alcoholic beverages to JCT's restaurants, theatre bars, banqueting facilities, and other hospitality operations. The contract will be for a period of 36 months, on an as-and-when-required basis, with no guaranteed minimum volume. The successful bidder must ensure continuous product availability, timely deliveries, competitive pricing, and consistent quality.

Evaluation stages:

• Stage 1 – Administrative Requirements: completeness and compliance of submission.
• Stage 2 – Functionality: assessed on licence, similar projects completed with contactable references, delivery capacity and logistics, quality management and food safety, key personnel and customer support.
• Stage 3 – Price and special goals: price and preference points under the PPPFA 2022 regulations.

Bidders may be required to make presentations to short-listed bidders. The evaluation is based on information in the submission, supplemented by presentations and clarifications. The contract is awarded in accordance with SCM regulations, MFMA, PPPFA and the General Conditions of Contract.

Scope: supply and delivery of alcoholic and non-alcoholic beverages to Joburg City Theatres' restaurants, theatre bars, banqueting facilities and other hospitality operations, on an as-and-when-required basis.

Product categories (indicative, not exhaustive):

• Non-alcoholic: soft drinks, energy and sports drinks, mixers and garnishes, bottled water, fruit juices.
• Alcoholic: beer (lager, premium, craft, light, alcohol-free, imported, draught), spirits (whisky, vodka, gin, rum, brandy, cognac, tequila, liqueurs, aperitifs, premium spirits), wines (sparkling, champagne, red, white, rosé, dessert, non-alcoholic), ciders, ready-to-drink beverages.

General requirements:

• All products must be genuine branded, new, fit for human consumption, comply with South African legislation, in original manufacturer's packaging, with valid batch numbers and expiry dates.
• No counterfeit, grey market or parallel imported products.
• Products must comply with Liquor Products Act, Foodstuffs, Cosmetics and Disinfectants Act, Consumer Protection Act, National Liquor Act, Occupational Health and Safety Act, applicable SABS standards, and municipal health regulations.
• Minimum 75% remaining shelf life on delivery; no broken seals, leaking containers, damaged labels or packaging.
• Delivery in manufacturer's sealed packaging, clean cartons, undamaged pallets, secure transport packaging; glass bottles adequately protected.

Storage and traceability:

• Supplier must maintain temperature-controlled storage where applicable, hygienic warehouse, pest control, FIFO stock rotation, secure storage, and food safety compliance.
• Complete records of batch numbers, manufacturing dates, expiry dates, delivery records, supplier records, and recall procedures. Products under recall must be removed immediately at no cost to JCT.

Delivery requirements:

• Delivery locations: Joburg Theatre Hospitality Warehouse, 163 Civic Boulevard, and Metro Centre Warehouse, 158 Civic Boulevard, Braamfontein. Other locations (Roodepoort Theatre, Soweto Theatre, Joburg Zoo) may be required for large events with prior authorisation.
• Deliveries 6 days a week, 08:00–18:00, unless otherwise instructed.
• Orders placed before 08:00 delivered same day; orders after 08:00 delivered next day.

Quality assurance:

• Implement quality management procedures for consistent quality, correct products, accurate quantities, proper handling, cold chain maintenance, and immediate replacement of defective products.
• No substitutions without prior written approval; discontinued items must be replaced with equivalent or superior product for approval.

The supplier must demonstrate a proposed approach and solution that fits JCT's requirements, including logistics capacity, delivery schedules, and ability to handle emergency orders. They must provide examples/references of similar works performed.

Bidders must demonstrate sufficient experience, technical capability, logistics capacity, and financial stability. They must provide references of similar projects completed and contactable references.

The supplier must implement quality management procedures to ensure consistent product quality, correct products, accurate quantities, proper handling during transportation, cold chain maintenance where applicable, and immediate replacement of defective products. Products must meet food safety standards, have minimum 75% remaining shelf life, and be free from contamination or damage. The supplier must maintain traceability records and recall procedures.

Bidders must complete the pricing schedule (MBD 3.1) with all prices in South African Rand, VAT inclusive, net of discounts. Prices must include cost of supply, transport, delivery, off-loading, labour, equipment, and materials. No price escalation will be considered unless specifically stated. The tender price must remain firm for 120 days.

Pricing format: complete MBD 3.1 (Pricing and Delivery Schedule) with all prices in South African Rand, VAT inclusive, net of discounts. Prices must include cost of supply, transport, delivery, off-loading, labour, equipment and materials. No price escalation will be considered unless specifically stated; firm prices only. The tender price must remain valid for at least 120 days after closing.

Payment terms: payment within 30 days of submission of a valid invoice accompanied by delivery note. Payment in Rand.

Financial capacity evidence: audited annual financial statements (if legally required) or most recent statements with Public Interest Score calculation. Municipal rates and taxes invoice or lease agreement (not in arrears more than 90 days) for the bidder's premises and for each director.

Mandatory registrations and documents:

• Central Supplier Database (CSD) registration at time of submission.
• Valid SARS Tax PIN and VAT registration (or rationale if not VAT registered).
• CIPC registration documentation with list of directors/partners/members and share certificates.
• B-BBEE certificate or sworn affidavit (for EMEs/QSEs) – failure results in zero preference points.
• Municipal rates and taxes invoice or lease agreement (not in arrears more than 90 days) for bidder's premises and directors.

Other compliance:

• Must have a local office within the Johannesburg Municipality.
• Must be in good standing with the public sector (SCM Regulation 38).
• Must comply with the Preferential Procurement Policy Framework Act and Regulations 2022.
• Must provide a health and safety plan and comply with the Occupational Health and Safety Act.
• Must be registered as an employer under the Compensation for Occupational Injuries and Diseases Act.
• No persons in the service of the state may bid.

Bidders must submit a valid B-BBEE certificate or sworn affidavit (for EMEs/QSEs) to qualify for preference points. Failure to submit a valid B-BBEE certificate will result in zero preference points for B-BBEE.

The supplier must comply with the Occupational Health and Safety Act and provide a suitable health and safety plan. They must be registered as an employer under the Compensation for Occupational Injuries and Diseases Act and pay all monies due to the Compensation Fund.

➢ The Contractor agrees that the occupational use of JCT’s premises and buildings shall be

at his own risk, and that he acknowledges the risks and dangers inherent therein.

➢ The Contractor furthermore acknowledges that JCT and / or its employees shall not be

liable or responsible for any loss, liability, damages, accident or injury, whether fatal or

otherwise, of whatsoever nature and howsoever arising, whether directly from the

permission granted by JCT to execute certain events or otherwise, including but not

limited to, the use of the premises and / or buildings, and indemnifies JCT and/or its

employees against all and any loss of / or damage to property, or injury or death, and any

claim for such loss, damage, injury or death, from any cause whatsoever and howsoever

arising, which may be suffered in this regard.

➢ The Contractor and / or its officers, employees, agents, concessionaires, suppliers,

Contractors or customers shall not have any claim of any nature against the JCT for any

loss, damage, injury or death which any of them may directly or indirectly suffer (whether

or not such loss, damage, injury or death is caused through negligence of JCT or its agents

or employees) or for:

➢ any latent or patent defect in the premises;

➢ a fire on the premises;

➢ a theft from the premises;

➢ the Premises or any part thereof being in a defective condition or state of disrepair;

➢ force majeure of causus fortuitus or any other cause either wholly or partly beyond

the JCT’s control;

➢ the use of the services offered on the premises;

➢ consequential loss howsoever caused;

➢ any loss or damage whether to persons or property caused by riots, civil commotion,

insurrection or actions taken by the Contractor or JCT to mitigate the effect of / or

prevent the aforesaid; and any other cause whatsoever.

➢ Save for any willful acts or omission or gross negligence by JCT, its officers, employees,

agents, concessionaires, suppliers and Contractors, the Contractor indemnifies JCT and

holds it harmless from and against all claims, actions, damages, liability and expense in

connection with loss of life, personal injury and / or damage to property arising from or

out of any occurrence in, upon or at the premises or the occupancy or use by the

Contractor of the premises.

Compliance with Legislature

Workmen’s Compensation

The Tenderer shall, prior to commencement of any work on site in terms hereof, give written

proof that he is registered as an employer in terms of Section 80 of the Compensation for

Occupational Injuries and Diseases Act, and the Tenderer shall remain registered as

such for the duration of the contract awarded and shall pay all monies due to the

Compensations Fund in terms of Section 15 of Act . Failure to comply will result in

Subject to GCC clause 3.25, if the supplier fails to deliver any or all of the goods or to perform the

services within the period(s) specified in the contract, JCT shall, without prejudice to its other

delivered price of the delayed goods or unperformed services using the current prime interest rate

calculated for each day of the delay until actual delivery or performance. JCT may also consider
