Evaluation stages:

1. Basic compliance: eligibility criteria, complete tender (commercial, financial, technical), mandatory returnables submitted.
2. Functionality (technical) evaluation: minimum threshold of 70% to avoid disqualification. Detailed Technical Evaluation Specification (TES) attached.
3. Price evaluation: prices inclusive of VAT, corrected for arithmetical errors, excluding contingencies, adjusted for variations, compared on Net Present Value basis. Unconditional discounts considered; conditional discounts applied at payment. Prices scored out of 80 points.
4. Specific Goals (B-BBEE) evaluation: scored out of 20 points under the 80/20 system (for tenders below R50 million). Failure to submit evidence scores zero but does not disqualify.
5. Ranking: total of price and Specific Goals scores, highest first.

Objective criteria may apply; Eskom may award to a tenderer other than the highest scoring if justified.

Contractual requirements (CSD registration, COIDA, quality, environmental) are assessed after ranking, prior to award. Failure to meet them may render the tenderer non-responsive.

Scope: Inspection and repairs of coal bunker plant during outages.

• Contract period: five (5) years.
• Work performed during plant outages.
• The tender is for the whole of the contract; alternative tenders are not allowed.
• Successful tenderer may be required to provide cataloguing information and label materials per Eskom specifications.

Quality requirements (evaluated as contractual, not scoring):

• ISO 9001 certification or documented QMS complying with ISO 9001.
• Submit: QMS Manual, Quality Policy, Quality Objectives, control of documented information, control of nonconforming outputs, corrective action procedures, internal audit documentation.
• Organisation chart and responsibility matrix.
• Procedure for control of externally provided processes (supplier/subcontractor management).
• Draft Contract Quality Plan specific to scope (ISO 10005).
• Inspection and Test Plan (ITP) or Quality Control Plan (QCP) for similar work.
• Completed Form A.
• Documented procedure for control of welding consumables (including stainless steel).

Method statement must demonstrate adequate understanding of the project and that the scope of work has been appropriately catered for. The methodology should reflect an organised system (method statements, processes, resources) to manage OHS risks during the project lifecycle.

Key personnel requirements:

• Competency: person with required training, knowledge, experience, and where applicable qualifications relevant to the work.
• First aider (if applicable).
• OHS professional (if applicable).
• Incident investigator (if applicable).
• Environmental Coordinator/Rep: at least 3 years' environmental management experience with National Diploma/Degree/BTech in Environmental Management.

Quality requirements: ISO 9001 certification or documented QMS complying with ISO 9001. Required documents: QMS Manual, Quality Policy, Quality Objectives, control of documented information, control of nonconforming outputs, nonconformity and corrective action procedures, internal audit documentation, organization chart and responsibility matrix, control of externally provided processes, draft Contract Quality Plan specific to scope, Inspection and Test Plan (ITP) or Quality Control Plan (QCP) for similar work, completed Form A, and documented procedure for control of welding consumables.

Pricing schedule must be submitted in PDF and Excel format. Prices will be evaluated inclusive of VAT, corrected for arithmetical errors, excluding contingencies, adjusted for variations, and compared on Net Present Value basis. Pricing format:

• Prices inclusive of VAT.
• Prices evaluated on Net Present Value basis, excluding contingencies.
• Unconditional discounts considered for evaluation; conditional discounts applied at payment.

Payment terms:

• Contracts below R50 million (incl. VAT): payment within 30 days of undisputed invoice.
• Contracts above R50 million (incl. VAT): payment within 60 days of undisputed invoice.

Security:

• Performance bond or demand guarantee may be required; if so, tenderer must select at least two Eskom-approved financial institutions.

Financial due diligence:

• Audited financial statements for the previous 18 months (or last year) may be requested.
• For JV/SPV, audited statements for each participant required.
• Start-up enterprises (formed within last 12 months) exempt, but must provide statements for the first year once available.

Mandatory eligibility:

• Not under restriction to do business with Eskom or State-Owned Companies.
• Not a national of a country on international sanctions lists.
• No conflict of interest.
• Not restricted by National Treasury or on the Tender Defaulters list.
• Must not subcontract 100% of the scope of work.
• JV/consortium must have agreement stating joint and several liability, operate as single business entity, and have a designated bank account.

Mandatory contractual requirements (assessed prior to award):

• Valid CSD registration (CSD number/report).
• Tax clearance: certified copy required for local tenderers not on CSD or without SARS e-filing PIN; foreign tenderers with SA footprint need certified tax clearance.
• Employment Equity compliance (for designated employers): proof of submission of EE report.
• COIDA: original certificate of good standing or proof of application (South African tenderers).

B-bbee:

• Specific Goals scored out of 20 points under 80/20 system.
• Proof of B-BBEE status level: certificate, sworn affidavit, or other requirement under the B-BBEE Act.

CIDB:

• Valid proof of required CIDB grading designation (if applicable) required at closing or within 21 working days from closing if agreed.

Other:

• Tax Evaluation Questionnaire for PAYE personal service provider determination.

Specific Goals will be scored out of 20 points under the 80/20 system in accordance with PPPFA. Proof of B-BBEE status level contributor may be a certificate, sworn affidavit, or other requirement under the B-BBEE Act. Tenderers failing to submit proof of Specific Goals score zero but are not disqualified.

Mandatory OHS returnables: Acknowledgement of Eskom's OHS rules (Annexure B), Baseline OHS Risk Assessment, Competency documentation (first aider, OHS professional, incident investigator as applicable), Health and Safety Plan, valid COIDA letter of good standing (or insurance letter for single-employee companies), OHS policy, and OHS costing breakdown. Suppliers failing to submit required OHS documents will be given one opportunity of 7 working days to respond; failure renders them non-responsive.

Environmental requirements: Environmental Coordinator/Rep with at least 3 years' experience and relevant qualification (National Diploma/Degree/BTech in Environmental Management), signed appointment letter, environmental policy, Environmental Management Plan (EMP) addressing anticipated impacts, waste management plan, Emergency Preparedness and Response Plan (EPRP), environmental aspects and impacts register, hazardous chemical substances list with SDS, proof of training, and method statement.

Contractual requirements: Proof of valid CSD registration (CSD number/report) is mandatory. Additional contractual requirements include COIDA certificate of good standing. These are assessed after evaluation and ranking; failure to meet them by stipulated deadlines may render the tenderer non-responsive and ineligible for award.
