1.1. To appoint a suitable independent service provider to conduct an assessment of Government’s
progress in meeting its undertakings and commitments under the Amended Forest Sector Code
over a period of three (3) months.
2.1 The Forestry Branch, in line with government objectives, is responsible for driving transformation
policies and strategies in the forestry sector through collaboration with the Forest Sector Charter
Council (FSCC), which oversees the effective implementation and administration of the amended
Forest Sector code and ensure the sector’s transformation and sustainable growth.
2.2 To achieve this, Government and Industry jointly implement the Amended Forest Sector Code,
which was gazetted on 21 November 2017 (Government Gazette No. 40803) in terms of Section
9(1) of the Broad-Based Black Economic Empowerment Act (BBBEE), No. , as
amended.
2.3 Part C, Clause 4 of Government Notice 40803 stipulates that Government must submit an annual
report to the Forest Sector Charter Council. As the sector leader the Department of Forestry,
Fisheries and the Environment is expected to facilitate the submission of the report. This report
is to be compiled by an independent person and is intended to assess Government’s progress
in meeting the undertakings and commitments as outlined in the Charter Code. Despite being a
legislative requirement since 2017, no such report has been submitted. It is against this
background that DFFE needs to appoint a service provider to conduct the work. The complete
report must determine a single combined completeness ratio based on Government’s
commitments; it must be aggregable to by the Forest Sector Charter Council working towards
the completeness ratio to be treated as if it is 0%.
2.4 The Amended Forest Sector Code also uses a joint scorecard that incorporates the main
government undertakings. This mechanism is intended to ensure mutual accountability between
Government and Industry in implementing the agreed commitments and to support the
successful and effective realisation of Broad-Based Black Economic Empowerment (B-BBEE) in
the forest sector.
3.1 The objective of this assignment is to appoint a suitable independent service provider to conduct
an assessment of Government Undertakings and Commitments as outlined in the Forest Sector
Code, over a period of three (3) months. The assignment will include development of a
completeness ratio framework to assess Government performance, in consultation with the
Forest Sector Charter Council (FSCC); Compilation of a consolidated report outlining key
findings, identifying implementation gaps, and providing actionable recommendations; and
eventually the presentation of the final assessment report and completeness ratio results to the
Fscc.
3.2 The report must assess Government’s progress in fulfilling its main key commitments, namely:
(e.g. through the Blended Finance Scheme);
licenses (Environmental Impact Assessment (EIA) and Water Use License), paper,
and sawmilling facilities).

4 scope and extent of work
4.1. The following is expected from the Service Provider:

its undertakings and commitments as outlined in Part C, Paragraph 2 of the Amended Forest
Sector Code (Government Gazette No. November 2017). The scope of work must
include work completed since 21 November 2017 to 31 March 2026) and will include, but will not
be limited to:

6 period / duration of project / assignment
6.1. The project must be completed within 3 months after the signing of the SLA by both parties and
the issuing of an official order by DFFE.
7 costing / comprehensive budget
7.1 A comprehensive offer must be provided inclusive of all costs, expenses, and all applicable taxes.
Note: Travelling costs and time spent or incurred between home and the office of the service provider
and the DFFE office will not be for the account of the DFFE.
7.2 A comprehensive offer must be provided in the same envelope as the technical proposal inclusive
of all disbursement costs, expenses, and VAT (Annexure A - Price Schedule /guidance: (The
Service provider must quote for all activities as included in the Pricing Schedule unless
indicated otherwise).
7.3 DFFE reserves the right to negotiate price with a recommended service provider identified in the
evaluation process without offering the same opportunity to any other bidder(s) who have not been
recommended.
7.4 The price will be valid for 120 days from the closing date of the bid. The department reserves the
right to extend the validity of the bid, where a written letter will be sent through to every bidder that
responded to the bid. In terms of procedural fairness, the bidder will be given an opportunity to
respond, in writing, to the terms and conditions of the bid and the bid price. Such acceptance of the
terms and conditions of bid and bid price becomes legally binding in the procurement process. Any
bidder, that did not respond to the extension of the bid validity period, in writing, WILL NOT be
considered further for the bid upon expiry of the initial validity period.

9.3. Phase 2: mandatory requirement
9.3.1. The mandatory requirements will apply, and bidders must meet all requirements

Purpose
1.1. To appoint a suitable independent service provider to conduct an assessment of Government’s
progress in meeting its undertakings and commitments under the Amended Forest Sector Code
over a period of three (3) months.
is to be compiled by an independent person and is intended to assess Government’s progress
in meeting the undertakings and commitments as outlined in the Charter Code. Despite being a
legislative requirement since 2017, no such report has been submitted. It is against this
background that DFFE needs to appoint a service provider to conduct the work. The complete
report must determine a single combined completeness ratio based on Government’s
commitments; it must be aggregable to by the Forest Sector Charter Council working towards
the completeness ratio to be treated as if it is 0%.
2.4 The Amended Forest Sector Code also uses a joint scorecard that incorporates the main
government undertakings. This mechanism is intended to ensure mutual accountability between

11.3. Privacy and Protection of Personal Information Act
11.3.1 Protecting personal information is important to the Department of Forestry, Fisheries,
and the Environment. To do so, DFFE follows general principles by applicable privacy
laws and the Protection of Personal Information Act (POPIA).
11.3.2 DFFE’s role as the responsible party is amongst others to process personal information
for the intended purpose for which it was obtained and in line with legal agreements
with its respective/ prospective service providers and third parties.
11.3.3 DFFE will process personal information only with the knowledge and authorisation of
the bidder/ respondent and will treat the personal information which comes to its
knowledge as confidential and will not disclose it unless so required by law or subject
to the exception contained in the POPIA.
11.3.4 DFFE reserves all the rights afforded to it by the POPIA in the processing of any of its

8.4. Request for clarification of the tender document, questions, or queries, if necessary, must be

9.1. The evaluation for this bid will be carried out in the following phases:
9.2. Phase 1: pre-compliance
9.2.1. During this phase bid documents will be reviewed to determine compliance with SCM
returnable documents, tax matters, and whether proof of registration on the Central
Supplier Database (CSD) has been submitted with the bid documents at the closing
date and time of the bid.
9.2.2. The bid proposal will be screened for compliance with administrative requirements as
indicated below:
12.1. On appointment, the performance measures for the delivery of the project will be closely
monitored by the DFFE.
12.2. The service provider/s will have weekly progress meetings for the first two months from the start
of the project and then submit monthly progress reports to the Project Manager, within the
stipulated date after the end of each month for the duration of the project. Failure to submit the
required reports on time will result in penalties as outlined in the Memorandum of Agreement.
12.3. The Project Manager shall do the ongoing management of the Service Level Agreement.
12.4. Appointed service providers may be subjected to security vetting and screening.
12.5. The service provider/s must guarantee the presence of the senior in charge of fieldwork
throughout the duration of the contract.
12.6. Before the appointment of a replacement, the Project Manager must approve such appointment.
If the senior must leave the project, a period of at least one (01) month is required, in which the
senior must work parallel with the next person (senior consultant with similar expertise and equal
years of experience) appointed and able to transfer skills and knowledge.
12.7. All the conditions specified in the General Conditions of Contract (GCC) will apply and where
the conditions in the special conditions of contract contradict the conditions in the general
conditions of contract the special conditions of contract will prevail.
12.8. The service provider shall notify the DFFE in writing of all subcontracts awarded under this
contract if not already specified in the bid. Such notification, in the original bid or later, shall not
relieve the service provider from any liability or obligation under the contract.
12.9. The proposals should be submitted with all required information containing technical information.
12.10. DFFE reserves the right to reject proposals that are not submitted in the prescribed format or
where information presented is illegible or incomplete and will not be evaluated further
12.11. DFFE reserves the right to seek clarity, request additional information and verify documents
submitted by bidders. Bidders who fail to provide the requested information within the prescribed
time frame may be disqualified and not be evaluated further and/or forfeit points.
