This is an open invitation to tender for the establishment of an enabling agreement with pre-qualified scrap dealers for the disposal of scrap KVA transformers and mini-subs at Eskom's Eastern Cape Operating Unit. The contract runs for 36 months on an 'as and when' required basis. Tender number E3345DISECOU.

Closing date: 24 August 2026 at 10h00.

Clarification meeting (non-compulsory): 20 August 2026, 10h00-11h00, via Microsoft Teams. Tenderers must confirm attendance with the Eskom Representative, stating the name, position and contact details of each attendee. If a meeting is compulsory, non-attendance leads to disqualification.

Disqualification risks:

Tax clearance: certified copy required for foreign scrap dealers with a SA footprint not on CSD and without a SARS PIN, and for local scrap dealers without a SARS e-filing PIN or CSD profile. Foreign dealers with no SA footprint must complete SBD 1 but need no tax proof.

Other returnables: offer to purchase form, B-BBEE affidavit or verification certificate, CSD registration proof, second-hand goods certificate from SAPS, CIPC registration documents, COID certificate, SHEQ requirements, and technical requirements (technical inventory list and method statement).

Evaluation uses the 80/20 preferential point system: pricing is scored out of 80 points and specific goals out of 20 points, in accordance with PPPFA 2022 regulations. Tenderers are ranked by adding the pricing and specific goals scores.

Specific goals: scored out of 20 points. If a tenderer fails to submit evidence for a claimed specific goal, it is not disqualified but receives 0 points for that goal.

Technical/functionality criteria: a technical inventory list and a method statement based on the scope of work are required for functionality scoring.

Pricing: final prices are determined through a reverse e-auction after evaluation. The rand rate per item is set via the e-auction pricing tool.

Contractual requirements (CSD registration, completed ITT, SHEQ) are not evaluation criteria; they are assessed after ranking and before award.

Scope: purchase, collection and removal of scrap KVA transformers and mini-subs (5 KVA to 1000 KVA) at Eskom's Eastern Cape Operating Unit, on an 'as and when' required basis for 36 months.

Contract operation:

• Work instructions/task orders are issued per site per batch; each is a standalone task order.
• The successful tenderer must pay upfront for each allocated batch and collect all units within 7 working days of the task order issue date.
• Payment must be in full for the units on each batch; re-batching or part payment is not allowed.
• Collection requests typically range from 15 to 150 transformers at a time.
• The contract covers both aluminium and copper core units, purchased according to Eskom's list.

Obligations of the successful tenderer:

• Sufficient capacity and resources to service the contract at any site at any time, as quantities are not known upfront.
• Clean the site after collection and rehabilitate any oil spills.
• Submit a safe disposal certificate on company letterhead.
• Nominate three company representatives for site access for the agreement term.
• Responsible for safe collection, handling, removal, loading and transportation of the scrap units, using qualified labour and certified plant, machinery, equipment and transport.
• Obtain an Eskom permit before starting work and notify the site agent for sign-off on completion.

Compliance and conduct:

• Non-compliance with contractual obligations results in a Non-Conformance Report (NCR).
• All work must comply with the OHSA Act; safety requirements and documentation must be available on site.
• Littering is prohibited; no rubble may be left on site. Facilities for waste disposal must be provided during dismantling.
• Portable firefighting equipment must be on site when using cutting equipment.
• No accommodation is allowed on site.
• The scrap units are sold 'voetstoots' and 'as is', with unknown oil quantity; any oil remaining becomes the property of the successful tenderer, who is responsible for any spillage.

The successful tenderer must provide a method statement based on the scope of work for functionality scoring, along with a technical inventory list.

Scope execution: purchase, collection and removal of scrap KVA transformers and mini-subs on an 'as and when' basis for 36 months. Work instructions/task orders are issued per site per batch; each must be actioned and completed within 7 working days. The tenderer must pay upfront for each batch and collect all units within 7 working days. The tenderer must have sufficient capacity and resources to service the contract at any site at any time. The tenderer is responsible for safe collection, handling, removal, loading and transportation, using qualified labour and certified plant, machinery, equipment and transport. The site must be cleaned after collection, and a safe disposal certificate must be submitted on company letterhead. Three company representatives must be nominated for site access.

Tenderers must provide particulars including company registration (CIPC), VAT number, CIDB registration and grading (if applicable), contact details, and postal and physical addresses. For joint ventures, details of each member are required. If subcontractors are used, provide their name, CIPC registration, VAT number, CIDB grade, proposed scope of work, contact details and addresses.

Vendor registration: provide Eskom vendor number if registered, and CSD registration number if registered. CSD registration is not mandatory at tender submission but is mandatory prior to award. Provide SARS e-filing PIN for tax verification, or confirm a tax clearance certificate will be furnished by contract award.

Sub-contracting details: confirm intention to sub-contract, percentage, sub-contractor's CSD registration, B-BBEE level, and designated group (e.g. EME/QSE, black-owned, youth, women, disabled, rural/township, cooperative).

Site conduct requirements:

• Adhere to conditions set by the Eskom site agent regarding site access.
• Littering is prohibited; facilities must be provided for waste disposal during dismantling, and no rubble may be left on site.
• Additional precautions when using cutting equipment; portable firefighting equipment must be available on site during all stages.
• All work must comply with the OHSA Act; safety requirements and documentation must be available on site.
• Any oil spills must be rehabilitated by the successful tenderer.
• The scrap units are sold 'voetstoots' and 'as is'; any oil remaining becomes the property of the successful tenderer, who is responsible for spillage.
• A bidder with an existing or expired Eskom contract who defaulted, or with an open non-conformance, will be disqualified.

The successful tenderer pays upfront for each allocated batch in full, without re-batching or part payment.

Tenderers must show their intention to participate in the e-auction by completing and submitting the E-Auction Training Acknowledgement Form.

Eskom reserves the right to negotiate with preferred bidders if tendered prices are not market related.

Eskom's standard payment terms apply as stipulated in the tender conditions.

Eligibility: tenderers must not be under any restriction to do business with Eskom or State-Owned Companies, must not have the nationality of a country on international sanctions lists, must not have a conflict of interest, and must not be restricted by National Treasury or on the Tender Defaulters list. JV/consortium agreements must state joint and several liability.

• Tax clearance: certified copy required for foreign scrap dealers with a South African footprint not on CSD and without a SARS PIN, and for local scrap dealers without a SARS e-filing PIN or CSD profile. Foreign dealers with no SA footprint must complete SBD 1 but need no tax proof.
• Second-hand goods certificate from SAPS (valid and current) for scrap dealers and recyclers.
• CIPC registration documents or declaration of shareholding/directorship.
• COID certificate of good standing.
• SHEQ requirements per scope: Health and Safety (Annexure E) and Environmental (Annexure F).

B-BBEE: submit a B-BBEE affidavit (on the DTI template) or a verification certificate from an accredited agency.

Safety requirements (Annexure E):

• SHE policy signed by CEO/MD, compliant with OHS Act Section 7 or ISO 45001/OHSAS 18001.
• Valid letter of good standing.
• SHE competency certificates (first aider, fire fighting, crane operator, risk assessment) — certified.
• Appointment letters for first aider, fire fighter, crane operator, risk assessor, aligned with certificates.
• Baseline Risk Assessment (BRA) relevant to the scope, covering SHE hazards and all collection activities.
• Occupational Health and Safety Plan (OHS Plan) relevant to scrap handling and collection.
• Registration with SAPS as a second-hand dealer and recycler.
• Minimum 2 valid medical fitness certificates (red ticket) from an Occupational Health Practitioner.
• Safe work procedures/task manuals for high-risk activities.
• Substance abuse policy and procedure.

Environmental requirements (Annexure F):

• Environmental policy signed by CEO/Director, version controlled, with environmental commitments.
• Company organogram showing environmental responsible persons.
• Environmental aspects and impacts register covering activities, products and services, with a methodology for rating significance.

Technical requirements (for functionality scoring):

• Technical inventory list.
• Method statement based on scope of work.

Safety requirements (Annexure E) include:

• SHE policy signed by CEO/MD, with next review date, compliant with OHS Act Section 7 or ISO 45001/OHSAS 18001.
• Valid letter of good standing.
• SHE competency training certificates (first aider, fire fighting, crane operator, risk assessment) — must be certified.
• Appointment letters for first aider, fire fighter, crane operator, risk assessor, aligned with the certificates.
• Baseline Risk Assessment (BRA) relevant to the scope, covering SHE hazards and all activities involved in collecting scraps.
• Occupational Health and Safety Plan (OHS Plan) relevant to scrap handling and collection.
• Registration with SAPS as a second-hand dealer and recycler.
• Minimum 2 valid medical fitness certificates (red ticket) from an Occupational Health Practitioner.
• Safe work procedures/task manuals for high-risk activities.
• Substance abuse policy and procedure.

Site rules: no accommodation on site; portable firefighting equipment must be available when using cutting equipment; all work must comply with the OHSA Act.

Environmental requirements (Annexure F) include:

• Environmental policy signed by CEO/Director, date and version controlled, expressing commitments to environmental protection, compliance, continual improvement and pollution reduction.
• Company organogram showing the Contractor Environmental Officer/Representative and other responsible persons.
• Environmental aspects and impacts register covering activities, products and services (e.g. excavation, storage of oil-containing equipment, transporting hazardous goods, disposal of batteries), with a methodology to rate significance (low, medium, high).

Operational obligations: any oil remaining in equipment becomes the property of the successful tenderer, who is responsible for any spillage and must rehabilitate oil spills. Littering is prohibited; no rubble may be left on site.

Contract duration is 36 months, fixed, with work instructions/task orders issued per site per batch. Each task order is standalone and must be completed within 7 working days. The successful tenderer must pay upfront for each batch and collect within 7 working days. Non-compliance results in a Non-Conformance Report (NCR).

Eligibility disqualifiers: nationality of a country on international sanctions lists, submitting more than one tender (except where the 900MB e-tendering limit applies), JV/consortium without joint and several liability, conflict of interest, tender signed by non-authorised person, restricted by National Treasury, on the Tender Defaulters list, or sub-contracting 100% of the scope.

Eskom is not responsible for damages or losses during removal. The successful tenderer must obtain an Eskom permit before work and notify the site agent for sign-off on completion. No accommodation is allowed on site.
