Award

• The municipality is not obliged to appoint the lowest-priced bidder; the highest-scoring bidder against the set criteria is considered.
• The municipality reserves the right not to make any appointment and to award in part or in whole.
• The municipality may alter quantities based on the rates supplied.
• The municipality may request clarification of any aspect of a bid and may instruct a public accountant to report on the bidder's financial status; the bidder must assist with such an investigation.
• Bids are adjudicated under the municipality's SCM policy and the Preferential Procurement Regulations 2022.

Scope

• Supply and delivery of personal protective clothing and equipment for municipal workers of Dr Pixley Ka Isaka Seme Local Municipality, for a once-off period.
• Items are specified and quantified in the PPE and Uniform Specification for Once Off Period 2026 and the pricing schedule.
• All PPE and clothing supplied must be SABS/SANS approved; preference is given to locally produced or manufactured goods.
• Branding required on several items: DPKISLM silk screen print on the centre back of jackets (20 cm × 20 cm) and embroidered municipal logo above the left front pocket (7 cm × 7 cm).

Infrastructure / Community Services items and quantities

• D59 flame/acid resistant conti suits: 334 units. Navy, 100% cotton 300/320 GSM, 50 mm silver flame reflective tape, triple stitched with TKK zips, double-stitched three pockets on jackets, SABS approved. Waist sizes 28–50 and chest sizes 30–52.
• Canteen style dustcoats: 40 units. Polycotton, short sleeves, navy, logo silk screen printed on centre back (20 cm × 20 cm) and embroidered above left breast pocket (7 cm × 7 cm). Sizes M to 3XL.
• Two-piece heavy duty rain suits: 167 units. Heavy duty rubberised, premium quality virgin PVC nylon, concealed zip and press stud front with attached hood, elasticised waist trousers, navy blue. Sizes S to 3XL.
• Golf shirts: 334 units. 210 g pique knit golfer, 65/35 polycotton, navy/green/white, logo silk screen printed on front left breast (7 cm × 7 cm). Sizes XS to 3XL.
• Sun hats / beanies: 167 baseball-style caps. Adjustable back strap, embroidered municipal logo on front centre (3 cm × 3 cm), navy. Knitted woollen beanie, one size fits all, logo 3 cm × 3 cm, navy.
• Safety boots: 167 pairs. Wide fitting steel toe cap, ultra-flex and ultra-grip sole, oil and acid resistant, black. Sizes 3 to 11.
• Full face respirators with cartridge: 16 units. Fitted with Dromex unfit single cartridge filters, EN 141:2000 and EN 143:2000.
• Eye protection (safety spectacles): 100 units. Clear 100% polycarbonate lens, impact resistant, anti-scratch, anti-fog, anti-static and anti-UV.
• Hand protection: PVC knit wrist gloves 2 000; gripper gloves 2 000; PVC shoulder-length gloves 1 000; electrical wrist insulated rubber gloves 50.
• Reflective waistcoats (service delivery): 100 units. Construction reflective vest, multicolour with IDP pouch and zip, solid fabric, EN 471, lime green and orange. Sizes S to 3XL.
• Reflective vests (by-law enforcers): 2 units. Reflective waistcoat with ID pouch and zip, solid fabric, EN 471 silver flame reflective tape, navy. "By-Law Enforcers" embroidered on centre back (40 cm × 40 cm, white) and municipal logo embroidered above right front (70 cm × 70 cm). Size 2XL.
• Water waders with fitted gumboots: 16 units. Braces, buckles and attached gumboots, easy-adjusting suspenders, fully waterproof nylon, anti-slip PVC boots. Sizes 6 to 11.
• Gumboots: 167 pairs. Must comply with SABS 1320, oil and acid resistant, black. Sizes 4 to 12.
• Brush cutter helmets: 10 units. Adjustable head strap, full face fitted movable visor, fitted movable earmuffs.
• Brush cutter shin guards: 10 units. Double Velcro straps above ankle and below knee, shock-absorbing, strong ABS plastic.
• Disposable dust masks FFP2: 3 000 units.
• Life jackets: 5 units. Personal flotation device for offshore conditions, SABA and SAMA approved, conforming to SANS 12402-3, for use in water treatment works.

Fire Fighter Uniform items and quantities

• Magnum combat shirts: 14 units. Flame resistant Magnum T53 field dress, 65/35 polycotton, two patch breast pockets with buttoned flaps, short sleeves, open glad neck collar, navy blue, reflective lime tape around biceps, Fire Service logo embroidered above right breast pocket (5 cm × 5 cm), "Fire and Rescue" printed on the back (1 cm × 1 cm, bold white). Sizes S to 3XL.
• Magnum combat trousers: 14 units. Flame resistant polycotton, double seat and double knees, stitched-down belt loops, two side pockets, one pleated map pocket on the right with Velcro closing, reflective lime tape below the map pocket, navy blue. Sizes 34 to 48.
• Fire fighting jumpsuits: 14 units. One-piece short-sleeved inherently flame-retardant flight suit, sewn-on arm patches below the shoulder line, buttoned epaulettes, navy blue with lime reflective tape, Fire logo embroidered above left breast pocket (5 cm × 5 cm), reflective "Fire & Rescue" on the back. Sizes 34 to 50.
• Operational caps (fire section): 7 units. Baseball style, Velcro adjustable strap at the back, navy blue, Fire Service logo embroidered on centre front (3 cm × 3 cm).
• Chelsea safety boots: 7 pairs. Lace-free unisex pull-up boots with elastic side gussets, steel toe cap, black. Sizes 5 to 11.
• Fire gloves: 7 pairs rescue gloves and 7 pairs fire gloves. Sizes S to XL.
• Bio guard socks (fire section): 14 pairs. Full length cushion foot, wool blend, navy blue.
• Mondi knit jerseys: 7 units. V-neck 100% high bulk acrylic, military wide rib, epaulettes and elbow patches, Fire Services logo embroidered above right breast (5 cm × 5 cm), navy. Sizes M to 3XL.
• Border belts (fire section): 7 units. Black leather border belt. Sizes M to 3XL.

Traffic Officer Uniform

• Short sleeve Magnum shirts: 35% viscose, 65% polyester heavy weight shirting, two pleated breast pockets with scalloped buttoned flaps, stitched-in permanent creases front and back.

Pricing

• Bidders must submit a total bid price excluding VAT, total bid price including VAT and the VAT amount.
• Pricing is on the official quote and the bill of quantities / pricing schedule; unbalanced rates are not permitted.
• The official quote must reflect the trade name, legal name, VAT registration number, postal address, physical address, banking details and sufficient technical description.
• Items not appearing on the official quote may be submitted on the bidder's official letterhead.
• Prices must be firm for the validity period and not linked to any exchange rate.
• The municipality may alter quantities based on the rates supplied.

Financial capacity

• The municipality may instruct a public accountant to report on the bidder's financial status; the bidder must render all reasonable assistance.

Contract security

• No bid security, performance bond, guarantee or retention percentage is stated in the document.

Registration and tax

• All bidders must be registered on the Central Supplier Database (CSD).
• An original and valid Tax Compliance Status PIN from SARS must be submitted with the bid, or a CSD number where no TCS is available.
• A printed TCS certificate may be submitted together with the bid.
• Consortia, joint ventures and subcontractors must each submit a separate TCS certificate, PIN or CSD number.
• Foreign suppliers must complete the pre-award questionnaire in Part B:3.

B-bbee

• A B-BBEE status level verification certificate or a sworn affidavit (for EMEs and QSEs) must be submitted to qualify for preference points.
• B-BBEE status carries 20 of the 100 preference points under the 80/20 system.

Municipal clearance

• The contractor must provide clearance from the municipality where it is based confirming that it is not in arrears on municipal services accounts.

Disqualification and eligibility

• No bids will be considered from persons in the service of the state, including municipal councillors, provincial legislature members, National Assembly or NCOP members, board members of municipal entities, municipal officials, national or provincial department employees, accounting authority members of public entities, and employees of Parliament or a provincial legislature.
• Failure to provide any of the required particulars may render the bid invalid.
• Bids received after the closing time will not be considered.
• Telegraphic, telephonic, telex, facsimile and email bids will not be accepted.
• A bidder may not submit more than one conforming bid.
• Unauthorised amendments or additions to the bid documents are disregarded.
• Failure to comply with any addendum issued renders the bid invalid.
• Bids from persons not competent to enter into an agreement will not be considered and any resulting contract is null and void.
• The municipality may repudiate a bid or declare a contract invalid where bribery, fraud, corruption, attempts to influence the award, collusive arrangements or disclosure of bid amounts to other parties occurred.

Contract terms

• The contract is for a once-off supply and delivery of municipal workers' PPE.
• Bids remain valid and open for acceptance for 90 days after the closing date; prices must be firm during this period and not linked to any exchange rate.
• The municipality is not bound to accept any bid or the lowest bid sum and reserves the right to award in part or in whole.
• The municipality may vary, amend or add to the bid documents, including the closing date and time, by issuing an addendum before the closing of bids. Addenda form part of the bid documents and non-compliance renders a bid invalid.
• Bidders may not make unauthorised amendments or additions to the bid documents; such changes are disregarded in evaluation.
• The bid must be signed in the presence of subscribing witnesses by the person named in the Authority of Signatory form.
• The bid documents are private and confidential and copyright remains with the municipality; they may be used only to prepare and submit a bid.
• The municipality will not pay any costs incurred by bidders in preparing a bid.
• The municipality may repudiate a bid or declare a contract invalid where bribery, fraud, corruption, attempts to influence the award, collusive arrangements or disclosure of bid amounts to other parties occurred.
• Each bidder must provide a physical address in South Africa for delivery of legal process and notices; a postal box, private bag or electronic address is not acceptable.
• The municipality may request clarification of any aspect of a bid and may instruct a public accountant to report on the bidder's financial status; the bidder must render all reasonable assistance.

Special conditions

• The successful bidder must complete and sign the written contract form (MBD 7).
• Prices must be firm for the validity period and not linked to any exchange rate.
• Any variation to the execution of the bid must be agreed by all parties and served by official written notice.
• The successful bidder must make good or reimburse the municipality for all damages or repairs arising from the execution of the award.
• The successful bidder must remove all equipment, restore systems to their original state at its own cost, and/or reimburse the municipality in full if it fails to deliver as proposed.
• The successful bidder must report to and obey the instructions of the municipality's representative.
• The municipality reserves the right to accept any cost proposal in whole or in part and is not obliged to accept the lowest bid price.
• The municipality reserves the right to alter quantities based on the supplied rates.
• The transaction is subject to any applicable Act, Ordinance or By-law.
• Disputes must be settled by mutual consultation, mediation (with or without legal representation) or, failing that, in a South African court of law on an attorney and client scale.
• The parties agree to the jurisdiction of the Magistrate's Court, with the municipality retaining the right to act in a higher court where the amount exceeds that court's jurisdiction.

Registration and tax

• All bidders must be registered on the Central Supplier Database (CSD).
• An original and valid Tax Compliance Status PIN from SARS must be submitted with the bid, or a CSD number where no TCS is available.
• A printed TCS certificate may be submitted together with the bid.
• Consortia, joint ventures and subcontractors must each submit a separate TCS certificate, PIN or CSD number.
• Foreign suppliers must complete the pre-award questionnaire in Part B:3; where the entity answers no to all residency, branch, establishment, income and taxation questions, registration for a SARS TCS PIN is not required.

B-bbee

• A B-BBEE status level verification certificate or a sworn affidavit (for EMEs and QSEs) must be submitted to qualify for preference points.
• B-BBEE status carries 20 of the 100 preference points under the 80/20 system.
