Submission is by hard copy only: one original, printed, completed and signed, deposited in the tender box at Khâi-Ma Local Municipality, 21 Nuwe Street, Pofadder, 8890, before 20 October 2026 at 09:00. The sealed envelope must be marked with the tender number KH01-26/27 and the tender title, and bear the tenderer's name and address. Electronic, e-mailed, faxed or telephonic submissions are not accepted; late tenders are not considered. Tenderers must initial each page and any alterations. Proof of authority to sign must be submitted; joint ventures must include a signed joint venture agreement. Returnable documents are classified as Eligibility (E), Material Responsiveness (M), Functionality Evidence (F), Preference Evidence (P), Administrative (A) or Post-Award (PA); failure to satisfy an E or M requirement renders the tender ineligible or non-responsive. Required forms include SBD 4 (Declaration of Interest), SBD 9 (Certificate of Independent Bid Determination), MBD 5 (Declaration for Procurement above R10 Million), and the signed Form of Offer and Acceptance (C1.1).

Evaluation follows three stages: eligibility and administrative responsiveness, functionality, then price and preference. Functionality is scored out of 100; a minimum of 75 points is required to proceed. Functionality is based on relevant company experience: at least 3 qualifying projects in the ten years preceding closing, each with a final contract value of not less than R30 million including VAT, and the portfolio must demonstrate experience in at least two of: wastewater treatment works or oxidation ponds; bulk earthworks and engineered pond embankments; reinforced concrete water- or liquid-retaining structures; or HDPE geomembrane-lined ponds or reservoirs. Scoring: 4 or more projects = 100 points, 3 projects = 75, 2 projects = 50, 1 project = 25, none = 0. Each project must be supported by an appointment or award letter, a Practical Completion or Final Completion Certificate, and a signed client reference confirming scope, final value and completion; unsupported projects are not counted. For joint ventures, experience is combined only where a member holds at least 25% participation, and recognised project value is the member's attributable share. Price is scored under the 80/20 or 90/10 preference system (the lowest acceptable tender determines which applies). Preference points are awarded for locality (within Khâi-Ma Local Municipality 10 points under 80/20, 5 under 90/10; Namakwa District 6/3; Northern Cape 4/2; outside 0) and for black ownership (100% Black Owned 10/5; 75-99% 8/4; 60-74% 6/3; 51-59% 3/2; 0-50% 0). Only the highest single locality receives points. The Employer may conduct a risk assessment of the financial offer, unit rates and capacity before award.

The Works comprise the construction, testing and commissioning of the Pella Wastewater Treatment Works, an oxidation-pond system serving Pella. Scope includes: site establishment and bulk earthworks; one inlet works with screening, grit handling, flow control and measurement, and a night-soil disposal area; two reinforced-concrete-lined anaerobic ponds; one primary facultative pond and two secondary maturation ponds lined with 2.0 mm HDPE geomembrane and protective geotextile; one treated-effluent storage pond and one evaporation pond with specified lining systems; interconnecting gravity pipelines, chambers, valves and fittings; sludge drying beds, underdrainage, filtrate return and a composting area; stormwater diversion and discharge measures including channels, berms, culverts and 200 mm light grouted stone pitching; gravel access roads and internal circulation; an operator's facility with office, store, change room and ablutions; solar-powered security/flood lighting; 1.8 m high concrete palisade fencing; two 5 000 litre water tanks on 3 m high support stands; project name board and signage; environmental protection, dust and erosion control, rehabilitation and final site clearance; and testing, commissioning, operator training, performance demonstration, as-built information, manuals and handover. Time for completion is eleven (11) calendar months from the Commencement Date. Defects liability period is 12 months after Completion. The contract is a re-measurement contract. Tenderers must comply with the Occupational Health and Safety Act, 1993 and the Construction Regulations, 2014, and submit a project-specific Health and Safety Plan.

Pricing is a re-measurement contract with a Bill of Quantities. The procurement is expected to exceed R10 million including VAT, so MBD 5 must be completed and signed by every tenderer. Tenderers must submit audited annual financial statements for the past three years (or since establishment). The successful tenderer must submit the performance guarantee, insurance policies and other securities required by the Contract Data within 14 days after the Acceptance Date and before access to the Site. The signed Occupational Health and Safety Agreement and a valid Compensation Fund Letter of Good Standing must also be submitted within 14 days after Acceptance Date. All prices and payments must be in South African Rand. Tendered rates must be balanced; materially unbalanced tenders may be rejected after clarification.

Eligibility: CIDB registration in grading 7CE or higher (or capable of being registered before evaluation); joint ventures must have every member CIDB-registered, the lead partner in the CE class, and a combined grading of 7CE or higher. Attendance at the compulsory clarification meeting is an eligibility requirement. Bidders must not be restricted from doing business with an organ of state. Tax compliance: must be tax compliant when verified through the CSD or SARS Tax Compliance Status system. Bidders and directors must not owe municipal rates and taxes or charges to Khâi-Ma Local Municipality or any other municipality in arrears for more than three months; supporting municipal accounts must be submitted. Bidders must not be listed on the National Treasury Database of Restricted Suppliers or the Register for Tender Defaulters, and must not be insolvent, under liquidation or business rescue. B-BBEE: to claim black-ownership preference points, submit a valid B-BBEE certificate from a SANAS-accredited agency or a sworn affidavit (where legally entitled), showing the black ownership percentage; a certificate showing only the level is insufficient. Locality evidence: municipal rates or services account (owned premises) or a valid lease agreement plus the lessor's rates account, issued not more than three months before closing. MBD 4 (Declaration of Interest) must be completed; false declarations may be verified against CSD, CIPC and other databases. UIF good standing must be provided when requested. The signed Occupational Health and Safety Agreement and Compensation Fund Letter of Good Standing are post-award submissions.
