Evaluation stages:

1. Administrative compliance: South African-owned company (certified ID copies of shareholders and directors); valid tax clearance or SARS e-Filing access PIN; valid B-BBEE certificate (not disqualifying, needed for ownership points); certified CIPC company registration.
2. Mandatory criteria (all must be met, else disqualification):

• Proof of trading in Copper Cathodes
• Current banking details on bank letterhead with stamp
• Certified copies of all shareholder certificates (detailed breakdown)
• Copy of shareholder agreement (if more than one shareholder)

3. Functional evaluation (Stage 1): Minimum qualifying score 70/100. Criteria:

• Experience (40%): 10+ years = 5 pts (40%); 8–9 years = 4 pts (32%); 6–7 years = 3 pts (24%); 3–5 years = 2 pts (16%); <2 years = 1 pt (8%)
• Technical and product capability (30%): Certificate of Analysis (COA) from intended mine = 5 pts (30%); no COA = 0 pts
• Reference letters (15%): 3 letters = 5 pts (15%); 2 letters = 3 pts (9%); 1 letter = 1 pt (3%); none = 0 pts. Letters must include contact person, title and contact numbers.
• Delivery (15%): Lead time 1–2 months = 5 pts (15%); 3–4 months = 3 pts (9%); >4 months = 1 pt (3%)

4. Price and preferential points (Stage 2): 80/20 system (estimated value ≤ R50 million). Price = 80 points; Black Women Owned >30% = 5; Black Ownership >51% = 5; Black Youth = 5; Black People Living with Disability = 5. Total must not exceed 100.

Only bidders scoring 70+ in functional evaluation proceed to Stage 2.

Scope: Supply and delivery of High Purity Copper Cathodes in accordance with Specification 1330020 Issue 3.

Quantity: Estimated consumption 200,000 kg per annum (not fixed; may change with demand).

Delivery: To be delivered to specification; delivery lead time to be specified.

Sub-contracting: Not allowed without prior approval.

OEM: To be specified.

Sample: A sample will be requested from the successful bidder for testing and acceptance.

Late delivery penalty: 1% of total order value per completed week of delay, capped at 10%; if delay exceeds 4 weeks, Denel may cancel the order and recover additional procurement costs from the supplier.

Functional evaluation requires bidder to demonstrate experience in trading in Copper Cathodes, with points awarded based on years of experience (10+ years = 5 points, 8–9 = 4, 6–7 = 3, 3–5 = 2, <2 = 1). Also requires submission of three reference letters from customers to whom Copper Cathodes were sold, including contact person, title, and contact numbers.

A sample will be requested from the successful bidder for testing and acceptance to ensure compliance with the specification.

Annexure A: Price Proposal — includes currency, prices subject to confirmation, disclaimers. Price points in evaluation: 80 points for price under 80/20 system.

Pricing format: Fixed price in South African Rand, all applicable taxes included. Prices subject to confirmation will not be considered.

Schedule of Rates (Annexure A) must be completed and submitted; failure to submit disqualifies.

Payment terms: As stipulated in the SLA/contract; payment only after acceptance at PMP.

No bid security, bonds, guarantees or retention specified.

Estimated value: Not stated, but the 80/20 preference point system applies (value ≤ R50 million).

CSD registration: Required; tax compliance verified through CSD.

Tax compliance: Must be tax compliant; submit SARS TCS PIN or printed TCS certificate. For consortia/JVs/sub-contractors, each party must submit separately.

B-BBEE: Valid B-BBEE certificate or sworn affidavit (for EMEs/QSEs) required to claim preference points; failure results in zero points for B-BBEE. EMEs (revenue ≤ R10 million) may submit a certificate from a registered independent auditor or accredited verification agency.

CIPC: Certified copy of company registration required.

South African ownership: Must be South African-owned; certified ID copies of shareholders and directors required.

State employees: Bids from persons in the service of the state, or companies with directors who are, will not be considered.

Joint ventures/consortia: Must submit signed JV/consortium agreement or written intention with percentage split and responsibilities; each party must be CSD registered and tax compliant.

Late delivery penalty: 1% of total order value per completed week of delay, max 10%; if delay exceeds 4 weeks, Denel may cancel the order and recover additional costs from the defaulting supplier.
