Disqualification risks:

Evaluation is in two phases:

• Phase One: Compliance and responsiveness to bid rules and conditions. Bids that fail any mandatory requirement are eliminated.
• Phase Two: Bidders passing Phase One are evaluated on PPPFA and PPR 2022 using the 80/20 preference point system.

Scoring:

• Price: 80 points
• Specific Goals: 20 points
• Total: 100 points
• The 80/20 system applies to tenders up to R50 million (inclusive of all applicable taxes).
• Price points are calculated using the formula: Ps = 80(1 - (Pt - Pmin)/Pmin), where Pt is the rand value of the tender under consideration and Pmin is the rand value of the lowest acceptable tender.
• The bid will be awarded to the highest point scorer as a whole, unless circumstances justify otherwise.
• The department may negotiate with bidders if an offer is not market related, but bidders may not increase their offers during negotiation.
• A contract may be awarded to a bidder that did not score the highest points if a risk assessment indicates the higher scorer lacks capacity.
• Preference points for joint ventures/consortia are allocated proportionately based on the attributes or qualifications for the relevant specific goals.
• All information will be verified through the CSD.

Scope: Term contract for the supply and delivery of general building material for defective work at Chris Hani District, for a period of 12 months.

Contract period: 12 months, commencing from the date of signing the contract. The contract expires if the contract value is depleted before the period ends.

Delivery requirements:

• Emergency maintenance defects: material must be delivered within 10 hours of reporting (defect resolved within 24 hours).
• Simple day-to-day maintenance defects: material must be delivered within 1 day (defect resolved within 3 days).
• Complex day-to-day maintenance defects: material must be delivered within 4 days (defect resolved within 7 days).
• Longer durations allowed for lead time or non-availability of material from manufacturers or suppliers.
• Delivery times: 08:30 to 15:00, Mondays to Fridays.
• The departmental project leader must be notified 24 hours prior to delivery, except in emergencies.
• Material will be checked and verified for quality, quantity and content against the pricing schedule at the point of delivery.

Quality standards:

• All material must meet SANS 10400, PW 371, and Occupational Health and Safety Act minimum standards.
• All material must be marked SANS/SABS approved.
• Material not meeting standards will be returned at the supplier's cost.
• The department has the final say on quality, in accordance with manufacturer's specifications.

Bill of quantities (rate-based, quantities of 1 each):

• Bill No. 1 – Building material: concrete stone, crusher dust, sand, cement, sub-base material, burnt clay masonry units, damp-proof courses, brickforce, concrete blocks, lintels.
• Bill No. 2 – Painting material: sanding rolls, masking tape, crack filler, undercoat, dampshield, primers, enamel, silicone, brushes, rollers, wall paint, ceiling paint, glazing putty, brick dressing paint, window pane, stoep paint, turpentine, mutton cloth, dust masks, sanding sealer, metal primers.
• Bill No. 3 – Carpentry material: roof sheeting, nails, membrane, barge boards, H-profile joiners, fascia boards, screws, hinges, door handles, locks, timber skirting, wood glue, wood filler, fibre cement boards, cornice, cover strips, SA pine, quadrant, rivets, doors, door frames, floor tiles, tile adhesive, grout, edge trim, tile spacers, mosaics, wire nails, veranda columns, aluminium window frames, drywall boards, studs, corner bead, skirting, head channel, insulation, tape, joint plaster, multipurpose plaster.
• Bill No. 4 – Plumbing material: compression couplers, bath spouts, holderbats, cistern mechanisms, ball valves, gate valves, tap washers, basin mixers, toilet cisterns, manhole covers, shut-off valves, compression elbows, stop ends, pipe couplings, sockets, bends, junctions, gulley traps, inspection pipes, rodding eyes, waste fittings, pipe clips, and related items.

Brand names: Where a brand name is specified, the department requires an item similar, equivalent, or better.

Quality standards: All material must meet SANS 10400, PW 371, and Occupational Health and Safety Act minimum standards.

• All material must be marked SANS/SABS approved.
• Material not meeting standards will be returned at the supplier's cost.
• The department has the final say on quality, in accordance with manufacturer's specifications.
• Material will be checked and verified for quality, quantity and content against the pricing schedule at the point of delivery.
• If specifications do not address any aspect of quality, bidders must clarify with the department five (5) days prior to submission of a quotation.

Pricing schedule: Rate-based contract. Rates must be fixed for the duration of the contract.

• The total bid price must include all costs associated with the execution of the required goods, including delivery costs, profit, and all applicable taxes.
• The bid sum must be stated in both figures and words; if they differ, the amount in words governs. Failure to complete the amount in words invalidates the offer.
• No price escalation will be considered.
• VAT: The supplier will issue a tax invoice for all materials supplied, reflecting the exclusive cost with VAT added.
• The bill of quantities is divided into four bills: Building material, Painting material, Carpentry material, and Plumbing material. Each item has a quantity of 1, and bidders must price each item.
• Total amounts must be carried over to the final summary.
• The bid will be awarded as a whole; all items in the pricing schedule must be correctly priced.

Pricing format: Rate-based contract. Rates must be fixed for the duration of the contract.

• The total bid price must include all costs associated with the execution of the required goods, including delivery costs, profit, and all applicable taxes.
• The bid sum must be stated in both figures and words; if they differ, the amount in words governs. Failure to complete the amount in words invalidates the offer.
• No price escalation will be considered.
• VAT: The supplier will issue a tax invoice for all materials supplied, reflecting the exclusive cost with VAT added.

Financial surety: Bidders must submit with the bid either:

• A letter from a registered financial institution committing financial assistance to the service provider for the quoted amount, OR
• A letter as proof of own financial resources available to render the contract.

Penalty provisions: If the successful bidder withdraws, fails to fulfil the contract, or refuses to sign the agreement or provide surety, the bidder is liable for:

• All expenses incurred by the department to advertise for or invite and deliberate upon new bids, and
• The difference between the original accepted bid price and a less favourable alternative bid price or a new bid price.

Insurance: The service provider must insure personnel, plant, machinery and equipment involved in the contract, and indemnify the department against all risks and claims.

The department may require sureties to its satisfaction for due fulfilment of the contract.

CSD registration: Bidders must be registered on the National Treasury Central Supplier Database (CSD) prior to award. Proof of registration should be submitted with the proposal where possible. CSD number must be provided if no TCS is available.

Tax compliance: Bidders must be tax compliant at the time of award and throughout the contract. Tax status will be verified via CSD or tax compliance PIN. Non-compliant bidders will be given 7 days to rectify; failure to rectify leads to non-responsiveness. Bidders must submit their SARS TCS PIN or a printed TCS certificate. For consortia/joint ventures/sub-contractors, each party must submit a separate TCS certificate/PIN/CSD number.

B-BBEE: Specific goals points (20 points) are claimed by completing and signing SBD 6.1. Failure to do so results in no points for specific goals. No specific B-BBEE level thresholds are stated in the document.

Eligibility: Bidders must be a legal entity, partnership, joint venture, or consortium. Bidders must not be persons in the service of the state, or companies/close corporations with directors/members in the service of the state. Bidders must not be listed on the Register of Bid Defaulters.

Security screening: Bidders intending to render services will be subjected to security screening and vetting prior to award.

• The department shall not be liable for any claims, damages, accidents or injuries arising from the carrying out of the contract.
• The service provider must insure personnel, plant, machinery and equipment involved in the contract, and indemnify the department against all risks and claims.

Contract form: The General Conditions of Contract (GCC) and SBD 7.1 will be used. The successful bidder will be required to sign a written contract form (SBD 7).

• The formal acceptance of the bid by the department constitutes a binding contract.
• The department may require sureties to its satisfaction for due fulfilment of the contract.
• The contract period is 12 months, commencing from the date of signing. The contract expires if the contract value is depleted before the period ends.
• The department may accept or reject any offer, cancel the bid process, or reject all offers at any time before contract formation, with written reasons.
• The department reserves the right to accept the bid as a whole or in part.
• Failure to deliver required services: clauses 22 and 23 of the GCC apply.
• Disputes: dealt with in accordance with clause 27.2 of the GCC.
• Penalty provisions apply for withdrawal, failure to fulfil, or refusal to sign (see financial requirements).
• The department may terminate the contract if the awarded bidder fails to comply with the specification during payment for services rendered.
• The department may conduct supplier due diligence, including site visits/in loco inspection, prior to award or during the contract.
• The department may request presentations/demonstrations from short-listed bidders.
• The bidder indemnifies the department against costs or damages arising from a breach of bid conditions.
• The bidder participates at its own risk and cost; the department is not liable for costs incurred by bidders.
• South African law governs the bid; bidders submit to the exclusive jurisdiction of South African courts.
• The document prevails over any information provided during any briefing session, unless expressly amended in writing.
• All communication between bidders and the department must be in writing. Bidders must keep bid contents confidential.
• Bidders must notify the department in writing of any discrepancy, ambiguity, error or inconsistency in the bid document.
