Submission Guidelines
Source: ANNEXURE D Transnet General Bid Conditions.pdfSubmit bids in a sealed envelope with the bid number and subject marked on the front, and your return address on the reverse. Deliver before the closing date and time specified in the bid documents—late bids are disqualified. Complete all bid documents in full, legibly, in non-erasable ink. Use only official Transnet bid forms/formats; non-compliance may lead to rejection. Submit all mandatory returnable documents listed in the RFX—failure to do so results in disqualification. Missing non-mandatory documents may also disqualify. Alterations to bid prices must be initialled by the signer; uninitialled changes risk exclusion. Prices quoted subject to confirmation are not considered. Ensure all samples (if required) are marked with your name, address, bid number, and item number, and arrive by the closing date. Foreign currency payments require SARB approval; provide full remittance details if applicable. After submission, only communicate with the Acquisition Council Chairperson or Secretary during evaluation. Unauthorised communication may disqualify your bid. Attend compulsory site visits or briefing sessions if specified in the RFX—failure to attend may disqualify your bid.
Technical Specifications
Source: ANNEXURE D Transnet General Bid Conditions.pdfSupply new (unused, non-reconditioned) goods unless otherwise specified. Prices for local supplies (manufactured/produced/assembled in SA or imported stock in SA) must be quoted on a 'Delivered RSA named destination' basis. Prices for imported goods must be quoted on a 'Delivered Duty Paid (latest ICC Incoterms)' basis to the end destination in SA, unless stated otherwise. Lead times must include all non-working days, holidays, and typical operational downtimes. Delete items not tendered for or priced elsewhere in the bid. For drawings/specifications: submit required drawings before the closing date/time; non-submission may disqualify. If quoting foreign specifications (non-British/American), provide translated copies and detail any departures from the bid documents. Contract quantities are estimates; Transnet is not bound to purchase definitive amounts but expects supply against orders placed before contract expiry. Emergency demands may require short-notice delivery; failure to meet these may allow Transnet to source elsewhere without penalty. Goods must comply with quality standards as specified in the bid documents.
Financial Requirements
Source: ANNEXURE D Transnet General Bid Conditions.pdfAll monetary amounts must be in South African Rand (ZAR) unless the RFP explicitly permits otherwise. Prices must be firm and not subject to confirmation. VAT must be included in prices for local supplies (manufactured/produced/assembled in SA or imported stock in SA) and shown separately on tax invoices at the standard rate. For foreign services, local commission portions must show VAT separately. Payment terms are governed by the Terms and Conditions of Contract; alternative payment/financing proposals may be submitted but must include full terms and financial merits for evaluation. Conditional discounts (e.g., for early payment) are calculated from the date Transnet receives your correct month-end statement and tax invoice. Advance payments may require a guarantee. Transnet prefers Rand-based agreements; if foreign currency is involved, obtain forward exchange cover to mitigate currency risk. No price adjustments are recognised for increases after the delivery date. Transnet may request pro-forma/tax invoices to verify VAT compliance. Prices for imported goods must include all duties and delivery costs as per Incoterms.
Compliance Requirements
Source: ANNEXURE D Transnet General Bid Conditions.pdfSubmit all mandatory returnable schedules/documents—failure results in disqualification. Missing non-mandatory documents may also disqualify. If the bidder is a company, list all directors' full names. If a close corporation, list all members' full names. For partnerships or individuals trading under a name, provide full names of partners or the individual. Foreign bidders or their SA representatives must submit written proof of authorisation to act on the principal’s behalf; failure disqualifies the bid. Foreign bidders must state the name of their authorised SA representative empowered to sign contracts and act on their behalf. A Power of Attorney (complying with Rule 63 of the Uniform Rules of Court) must be furnished if required, signed under the same title as in the bid documents. The Power of Attorney must authorise the SA representative to choose the domicilium citandi et executandi. Bidders on the National Treasury’s Register of Tender Defaulters or List of Restricted Suppliers are ineligible. Successful bidders must provide security (e.g., Deed of Suretyship from an approved SA financial institution) within 30 days of acceptance; failure may lead to contract cancellation. Contracts are governed by South African law, and bidders must submit to SA court jurisdiction. Provide full details of foreign principals or manufacturers if remittance is required overseas.
