of the Republic of South Africa to make Laws for the Gauteng province, Oversee the work of
the Provincial Executive, foster Cooperative Governance among all spheres of government in
Gauteng, and foster Public Participation into legislative oversight. The GPL operates two
offices, one in Johannesburg and another in Cape Town.
1.2 The GPL requires uninterrupted Internet Services to ensure seamless service continuity. The
successful bidder will be required to commence implementation activities approximately 120
calendar days before 1 March 2027 to allow for the installation, configuration, testing,
commissioning and acceptance of all required infrastructure and services. The implementation
period shall include a transition period of approximately one (1) month immediately preceding
1 March 2027 (i.e., 1st February 2027) to facilitate an orderly migration and verification of
services without disrupting the GPL's business operations.
1.3 The successful bidder must therefore demonstrate the capacity to mobilise resources and
achieve full operations during the transition period inclusive of the period 1 – 28 February 2027,
into the 1st of March 2027 up to the remainder of the contract duration.
2.1 The purpose of this Terms of Reference is to invite suitably qualified and experienced Internet
Service Providers to submit proposals for the provision, implementation, management,
monitoring, and support of a secure, resilient, high-performance managed Internet and wide
area network solution for the Gauteng Provincial Legislature (GPL).
3.1 The objectives of this assignment are to:
3.1.1 Appoint a competent service provider capable of providing Internet access, with a perimeter
protection that includes but not limited to an outsourced firewall, intrusion prevention solution,
webcasting, web filtering as well as anti-virus, maintenance of DNS Records and ensuring
that unwanted traffic is detected, blocked and connectivity to Azure cloud computing Services
is guaranteed.
4.1 The successful service provider will be required to perform, but not be limited to, the following:
4.1.1 Background Information: Location Requirements
The GPL has a complement of 600 users with high consumption of services hosted online
from Microsoft Office and Azure Services, including Mobility. Members and Staff, especially
of 32
members of the Legislature, as well as researchers and relevant personnel, must have
optimum access to the internet and email services to perform their duties in a timely and
professional manner.

4.2 Internet Access Requirements
4.2.1 Provide 400 Mbps secured Internet access through Double Fibre connectivity with traffic
going through the MPLS/SD-WAN/SASE cloud and use of advanced perimeter protection
services to filter internet and email traffic. (This link must be monitored by the service provider
on a 99.9% uptime SLA). This must also include a backup link of a similar size.
4.2.2 An additional 100 Mbps link will be required and reserved for Azure and O365 Connectivity.
(This link must be monitored by the service provider on a 99.9% uptime SLA).
4.2.3 An additional 100 Mbps link will be required for the Chamber link. (This link must be monitored
by the service provider on a 99.9% uptime SLA).
4.2.4 An additional 100 Mbps link will be required and reserved for Public WIFI. (This link must be
monitored by the service provider on a 99.9% uptime SLA).
4.2.5 The equipment and software must be continuously upgraded to the latest version for the
duration of the contract at no cost to GPL.
4.2.6 Cloud Security – Z- Scaler:
4.2.6.1 The GPL currently uses Z-Scaler as a cloud proxy solution to provide Internet connection for
all GPL sites through Z-Scaler Cloud-Based Proxy service with SLA 99.9% Up-time.
4.2.6.2 The Service provider must ensure every link provided to the GPL must terminate at the Z-
Scaler cloud proxy to ensure data is managed at a central point.
4.3 Mobile Data Solution
4.3.1 The service provider must be able to supply a mobile data sim solution with the following
capabilities:
4.3.1.1 Shared data bundle that supports MTN and Vodacom Sims (The Sim Card must have the
ability to automatically switch between Service Providers) – 3Tbyte.

4.3.1.2 Sims are locked to the Z-Scaler Cloud Point of Presence (POP) data centre limiting Internet
access to users with the Z-Scaler Client connector – 660 Sim cards (additional 60 Sim cards
are a contingency).
4.3.1.3 Unlimited Internet break out port to ensure fast Internet speeds.
4.3.1.4 Cost-effective in a bundle and out of bundle data rates.
4.3.1.5 Management Reports

4.4 Multi-Protocol Label Switching (MPLS), Cloud, and Service Level Agreement
(SLA)
4.4.1 To provide uninterrupted high-speed access to Microsoft Office 365 applications and Azure
connections
4.4.2 To provide 100 Mbps MPLS/SD-WAN/SASE connection for Cape Town offices terminating
at the GPL Main Building. (This link must be monitored by the service provider on a 99.9%
uptime SLA)
4.4.3 To provide 100 Mbps Internet access that should break out to Microsoft Office and Azure
platforms from the GPL Cape Town office. (This link must be monitored by the service
provider on a 99.9% uptime SLA)
4.4.4 The solution furthermore must cater for the infrastructure to allow for additional money-saving
and value-added services including Z-Scaler Private Access (Professional suite) (which will
branch off from the security system) and Video Conferencing.
4.4.5 The underlying MPLS/SD-WAN/SASE (Multi-Protocol Label Switching, Software Defined -
Wide Area Network, Secure Access Service Edge) technology, must allow
sophisticated/Advanced traffic management policies to be assigned to different traffic types
traversing the GPL Main network, ensuring total autonomy and security between separate
VPN (Virtual Network Private) layers.
4.4.6 QoS (Quality of Service) parameters must be applied to the different traffic types so that
Internet browsing is not interrupted.
4.4.7 These required services must be covered by a specific SLA with uptime, jitter, latency, and
packet loss guarantee.
4.4.8 The solution must be scalable and flexible in terms of rapid growth data consumption and
deployment and to the evolution of ICT industry Standards.
4.4.9 A properly defined SLA’s (Service Level Agreement) will assist the GPL in assessing service
delivery and reporting of the Line Uptimes.
4.4.10 The MPLS/SD-WAN/SASE network must allow seamless secure integration of 3rd parties,
through any 3rd party Virtual Routing and Forwarding (VRF) and Demilitarized Zone (DMZ).
4.4.11 The network deployed must be capable of running multimedia services such as voice and
video (for services such as MS Teams etc).
4.4.12 Detailed Firewall Reporting and Monitoring from Zscaler: The reporting structure must
provide high levels of transparency into the internet line utilization and the individuals
responsible for the utilization of specific internet protocols. (e.g., Web sites browsed, and
HTTP bandwidth used per user or for the organization as a whole).
4.4.13 The Service Provider will be required to provide once-off training and skills transfer to
designated Administrators that will have been appointed by GPL and any other training
deemed necessary.
4.4.14 The Service provider must be able to have a global footprint with the ability to route traffic
around the world.

4.4.15 The Service Provider must stipulate any other additional capabilities that their solution can
offer. Preference will be given for a single application with multiple features that will
complement the total solution and enhance the functionality of all communications, be it
video, voice, and data.
4.5 Zero Trust Remote Application Access from Z-scaler
4.5.1 The Service provider must be able to cater for the Z-Scaler Private Access (Professional
Suite) solution which terminates at the Z-Scaler Cloud Proxy solution with a base of 660
Users.
4.5.2 The Service provider must be able to provide the most optimal coverage of service to GPL
users throughout the Gauteng province.
4.5.3 Implementation of Public Wi-Fi. As the GPL increases its campaigns and public outreach,
the institution is having to cater for more public events. This comes with a need for the
institution to have Public Wi-Fi (i.e., access points provided must be Wi-Fi 6 capable) in the
following rooms:

5.1 The service provider must deliver the following outputs:
5.2.1 Submit draft project plan for consideration and approval by the GPL before implementation.
5.2.2 Install, maintain, and refresh all infrastructure as referred to in the Scope of Work (Main
Building, Cape Town, Chamber, Azure and Public WIFI) at their own cost through the contract
period.
5.2.3 Conclude the initial infrastructure rollout within a period of one hundred and twenty (120)
calendar days from the date of accepting the appointment letter from the GPL. The stated
number of days may be amended with the express approval of the GPL.
5.2.4 Provide confirmation of connectivity between the GPL (includes its satellite office) and its
data centre as well as maintain the required internet link uptime as per SLA requirements
throughout the contract duration.
5.2.5 Prepare and present the project closeout report for the initial infrastructure build period to the
GPL for consideration by end of January 2027.
5.2.6 Prepare and submit monthly firewall, firewall user-access, APN, cyber security, bandwidth
utilization reports the GPL ICT personal.
5.2.7 Attend and present reports and participate in monthly compliance meetings and quarterly
contract performance management and firewall review meetings.

transition to the next ISP.

6.1 The period of the assignment will be 5 years (60 Months) commencing from the day after the
completion of infrastructure installation. The service provider must note that the contract will
effectively begin on the 1st March 2027 as per the detailed scope and general conditions.
7.1 The service provider will report to ICT Manager (ICT Operations Business Unit).
7.2 Progress reports must be submitted monthly and quarterly.
7.3 All deliverables are subject to review and approval by the institution.

8.1 The Gauteng Provincial Legislature (GPL) reserves to establish a panel of service providers
instead of appointing a single service provider.
8.2 The GPL is not bound to accept the lowest-priced bid or any bid received.
8.3 Late submissions will not be accepted and will automatically be disqualified from further

8.4 The GPL reserves the right to verify all information provided by bidders, including references,

8.5 Any false, inaccurate, or misleading information provided by a bidder may result in immediate

9.1.2 The ISP must have either the Individual Electronic Communications Service (I-ECS) or
Individual Electronic Communications Network Service (I-ECNS) licence issued by the
Independent Communications Authority of South Africa (ICASA) or both.
9.1.3 The Service providers with Large Member or Backbone Member status from the Valid Internet
Service Provider Association will be advantaged.

3.11.8 Such clearance shall remain valid for a period not exceeding 12 months and shall only apply
for one project at a time.
3.12 Safeguarding of documents
3.12.1 All documents will be individually numbered on issue and records kept as to what documents
have been issued to whom.
3.12.2 All documents issued to sub-contractors or suppliers must be signed for, and such sub-
contractors and suppliers must also accept responsibility for the safeguarding of such
documents while they are in their possession.
3.12.3 All documentation shall be strictly handled as set out in the SSA Minimum Information
Security Standards (MISS), a copy of which shall be provided to the successful contractor at
the time of site hand over.
3.12.4 It will be the main contractor's responsibility to familiarise themselves with the MISS
document and make sure his personnel and sub-contractors are advised accordingly.
3.13 Bid cancellation
3.13.1 The GPL may amend or cancel this Bid before the award should it deem it necessary but not
limited to:
a) due to changed circumstances there is no longer need for the goods and services
specified in the invitation.
b) funds are no longer available to cover the total envisaged expenditure
c) no acceptable bid is received; or
d) there is a material irregularity in the bidding process

3.4 Joint ventures or consortium
3.4.1 A Copy of the Trust, Consortium or Joint Venture agreement duly signed must be attached.
3.4.2 A trust, consortium or joint venture will qualify for points for specific goals in accordance with
the applicable Preferential Procurement Policy, provided that the entity submits the required
consolidated documentation for purposes of evaluation and scoring of the specific goals.
3.5 Discounts
3.5.1 When calculating comparative prices, the GPL will consider any discounts which have been
offered unconditionally. A discount which has been offered conditionally will be implemented
when payment is effected despite not being considered for evaluation purposes.
3.6 General conditions
3.6.1 The GPL may request bidders to provide additional information with regards to the bid
proposal at any given stage during the evaluation process.
3.6.2 All proposals in response to this bid, whether successful or unsuccessful, will become the
property of the GPL.
3.6.3 Any costs incurred by the bidders in preparing and submitting their response will be the sole
responsibility of the bidder.
3.6.4 The GPL reserves the right to invite short-listed bidders to make a presentation to GPL’s bids
evaluation committee to further clarity or substantiate their submissions.
3.6.5 The GPL reserves the right, for purposes of promoting the values of competitiveness and
fairness, not to award the bid to the highest scoring bidder if such bidder has been awarded
a bid by GPL or has performed services for GPL during the last 12 months prior to the closing
date of the bid.
3.6.6 The GPL reserves the right to re-appoint or extend the service of the service provider where
there is a natural continuation of assignments.
3.6.7 The successful bidder/s will enter into a stipulated contract with GPL for the provision of the
required service.
3.6.8 The successful bidders, their employees and their sub-contractors must comply with GPL
security clearance requirements.
3.6.9 The successful bidders must be willing to sign confidentiality or non-disclosure agreement.
3.6.10 In the event where the order was wrongly printed, the service provider must be able to
exchange goods or cancel the order as per the GPL’s request.
3.6.11 The GPL may, at its discretion, require the removal and replacement of any of the bidder’s
personnel who do not perform adequately from its premises.
3.7 Central supplier database requirements
3.7.1 Bidders should register on the Central Supplier Database (CSD) to upload information namely,

3.8 Award of bid
3.8.1 The award of this bid by the Secretary to the GPL shall constitute a binding contract, and such
award shall be confirmed by means of an appointment/award letter. The successful bidder
must in return provide a written response on their letterhead of the acceptance of the award.

3.9 Subcontracting
3.9.1 The bidder awarded a contract may only enter into a subcontracting arrangement with the
approval of the GPL. The bidder may not subcontract more than 25% of the total contract
deliverables.
3.9.2 A bidder awarded a contract in relation to a designated sector, may not subcontract such that
the local production and content of the overall value of the contract is reduced to below the
stipulated minimum threshold.
3.10 Fronting
3.10.1 The GPL supports the spirit of broad based black economic empowerment and recognizes
that real empowerment can only be achieved through individuals and businesses conducting
themselves in accordance with the Constitution and in an honest, fair, equitable, transparent
and legally compliant manner. Against this background the GPL condemns any form of
fronting.
3.10.2 The GPL, in ensuring that bidders conduct themselves in an honest manner will, as part of
the bid evaluation processes, conduct or initiate the necessary enquiries/investigations to
determine the accuracy of the representation made in bid documents.
3.10.3 Should any of the fronting indicators as contained in the Guidelines on Complex Structures
and Transactions and Fronting, issued by the Department of Trade, Industry and Competition
(the dtic), be established during such enquiry / investigation, the onus will be on the bidder /
contractor to prove that fronting does not exist. Failure to do so within a period of 14 days
from date of notification may invalidate the bid/contract and may also result in the restriction
of the bidder /contractor to conduct business with the public sector for a period not exceeding
ten years, in addition to any other remedies the GPL may have against the bidder / contractor
concerned.

3.1 The objectives of this assignment are to:
3.1.1 Appoint a competent service provider capable of providing Internet access, with a perimeter
protection that includes but not limited to an outsourced firewall, intrusion prevention solution,
webcasting, web filtering as well as anti-virus, maintenance of DNS Records and ensuring
that unwanted traffic is detected, blocked and connectivity to Azure cloud computing Services
is guaranteed.
4.1 The successful service provider will be required to perform, but not be limited to, the following:
4.1.1 Background Information: Location Requirements
The GPL has a complement of 600 users with high consumption of services hosted online
from Microsoft Office and Azure Services, including Mobility. Members and Staff, especially

members of the Legislature, as well as researchers and relevant personnel, must have
optimum access to the internet and email services to perform their duties in a timely and
professional manner.
4.1.2 GPL is hosted in Two (2) physical locations and other platforms:

packet loss guarantee.
4.4.8 The solution must be scalable and flexible in terms of rapid growth data consumption and

4.4.10 The MPLS/SD-WAN/SASE network must allow seamless secure integration of 3rd parties,
through any 3rd party Virtual Routing and Forwarding (VRF) and Demilitarized Zone (DMZ).
4.4.11 The network deployed must be capable of running multimedia services such as voice and
video (for services such as MS Teams etc).
4.4.12 Detailed Firewall Reporting and Monitoring from Zscaler: The reporting structure must
provide high levels of transparency into the internet line utilization and the individuals
responsible for the utilization of specific internet protocols. (e.g., Web sites browsed, and
HTTP bandwidth used per user or for the organization as a whole).
4.4.13 The Service Provider will be required to provide once-off training and skills transfer to
designated Administrators that will have been appointed by GPL and any other training
deemed necessary.
4.4.14 The Service provider must be able to have a global footprint with the ability to route traffic
around the world.

4.4.15 The Service Provider must stipulate any other additional capabilities that their solution can
offer. Preference will be given for a single application with multiple features that will
complement the total solution and enhance the functionality of all communications, be it
video, voice, and data.
4.5 Zero Trust Remote Application Access from Z-scaler
4.5.1 The Service provider must be able to cater for the Z-Scaler Private Access (Professional
Suite) solution which terminates at the Z-Scaler Cloud Proxy solution with a base of 660
