Disqualification risks:

• Late delivery, incomplete or tippexed bids.
• Incomplete or fraudulent information (e.g., B-BBEE credentials, experience).

Bidders must indicate 'Comply', 'Not Comply', or 'Partial' for each bid condition; 'Partial' without supporting documentation is treated as 'Not Comply'.

C-BRTA reserves the right to award to one or more bidders, to cancel the bid at any time, not to accept any bids, and to contact bidders during evaluation for clarification only.

Appointment of a panel of forensic service providers to conduct investigations into allegations of fraud and corruption or any other matter.

Contract period: thirty-six (36) months.

Scope includes conducting investigations as required by C-BRTA.

Service documentation must be comprehensive, in English, and clearly describe the services offered; incomplete documentation will result in rejection.

Inspections, tests and analyses: pre-bidding testing for bidder's account; premises open for inspection at all reasonable hours; costs of inspections borne by purchaser if compliant, by supplier if not; non-compliant supplies may be rejected and replaced at supplier's cost.

Fees will be negotiated. Prices quoted must cover all work/items specified and all obligations under the resulting contract. Payment will be made within 30 days of receipt of correct original invoice.

Tax compliance: bidders must be tax compliant in accordance with the National Treasury Central Supplier Database (CSD); a CSD number must be provided.

Tax clearance: an original tax clearance certificate from SARS must be submitted prior to award.

B-BBEE: preference points claimed via SBD 6.1; fraudulent B-BBEE credentials will lead to disqualification.

CIPC: registration document required, indicating members with percentage interest, date of registration, and company registration number.

Contract duration: thirty-six (36) months, with C-BRTA reserving the right to review and extend.

Termination: C-BRTA may terminate with 30 days written notice, preceded by bona fide discussion; liability limited to amounts due up to cancellation date.

Termination for dishonesty or misrepresentation: C-BRTA may cancel forthwith and recover damages; payment may be withheld for 90 days for investigation.

Dispute resolution: negotiation (10 days), then mediation (15 days), then expedited arbitration under the Arbitration Foundation of Southern Africa; arbitration held in Sandton, South Africa, in English; South African law applies.

Payment terms: invoices paid within 30 days of receipt of correct original invoice, after C-BRTA acknowledges receipt.

General conditions include: performance security, inspections/tests, warranty (12 months after delivery or 18 months after shipment), penalties for delay (prime interest rate per day), termination for default, force majeure, limitation of liability (aggregate liability not exceeding total contract price), governing language English, applicable law South African.
