Necsa invitation to bid: goods/services supply with b-bbee preference points

The South African Nuclear Energy Corporation (Necsa) is a state-owned company. This bid is for the supply, delivery, installation, commissioning, maintenance/after-sales support and training on an FTIR spectrophotometer for the Fluorine Chemistry Group in Applied Chemistry, Research and Innovation. Bids must be submitted in two sealed envelopes, each containing two hard copies (one original and one copy) and one electronic copy (on disk or memory stick). Envelope One: Technical Proposal (no pricing information). Envelope Two: Pricing Proposal and all compulsory returnable documents. Evaluation follows a two-stage process. First, bidders must pass the Technical/Functional Evaluation with a minimum score of 80 out of 100; those scoring below 80 are deemed non-responsive and not evaluated further. Technical/Functional criteria and weights: Delivery Time (20 points) – more than 5 months scores 5, less than 4 months scores 10, less than 3 months scores 20. Installation, Commissioning and Training (30 points) – more than 2 weeks scores 10, less than 2 weeks scores 15, less than 1 week scores 30. Track Record (20 points) – fewer than 3 similar projects with at least 1 reference scores 10, minimum of 4 similar projects with at least 2 references scores 20. Support Turnaround Time during breakdown (30 points) – support within 1 week scores 30, within 2 weeks scores 15, more than 2 weeks scores 10. Bidders must submit a signed quotation/delivery schedule confirming lead times, a schedule of at least four similar projects with two signed reference letters, and a signed letter confirming local support turnaround times. Price and preference points are then evaluated under the 80/20 preference point system (for tenders valued R30,000 up to R50 million). Price scores out of 80 using the prescribed formula; specific goal (black ownership) scores out of 20. The contract is awarded to the bidder scoring the highest total points, subject to the price being market-related; Necsa may negotiate a market-related price or cancel the tender if not agreed.

The scope is the supply, delivery, installation, commissioning, maintenance/after-sales support and training on a Fourier Transform Infrared (FTIR) Spectrophotometer with a solid-state laser for the interferometer. Required features: ZnSe optics; spectral range at least 500–6000 cm-1; diamond ATR accessory; heated transmission accessory; dry nitrogen purge facility for the optical bench (interferometer, source and detector) and sample chamber; data station for the spectrophotometer; ability to display live spectrum; computer workstation; software; installation. The equipment must come with a warranty of at least 12 months, including replacement of all parts, consumables and labour. Training must be provided for 4 personnel on operation of the equipment. The bidder must guarantee local support in the form of maintenance. Detailed specifications are provided in Annexure A. The system will be installed in a radiological area (currently white contamination and radiation). The bidder must identify any obvious omissions from the scope essential to meeting the objectives and include them in the price.

Pricing must be submitted using the pricing schedule (SBD 3.1 – Firm Prices). The pricing proposal must include the following line items with quantities: FTIR spectrometer (1), Diamond ATR accessory (1), Heated transmission capability (1), Data workstation and software installation (1), At least 12 months warranty (1), Training of personnel (1). Prices must be shown excluding VAT and including VAT. The bid is subject to the 80/20 preference point system for goods/services valued between R30,000 and R50 million. No other financial requirements (bonds, guarantees, payment terms) are stated.

Bidders must hold a valid tax clearance certificate issued by SARS; no contract will be concluded with a bidder whose tax matters are not in order. The certificate must be an original submitted before award. NECSA may inspect and audit the bidder's performance and reports. If reports or deliverables fail to conform to NECSA requirements, the bidder must promptly correct the non-conformity at its own expense.

Subcontracting requires NECSA's written consent, and preference must be given to Black Empowerment Companies as subcontractors. The bidder must ensure employees privy to NECSA information are aware of Section 51 of the Nuclear Energy Act, 1999, and have signed confidentiality agreements.

The contract includes provisions on definitions, application, agency, assignment, subcontracting, indemnity and limitation of liability, insurance, confidentiality, termination for insolvency, non-solicitation of personnel, warranties, dispute resolution, and governing law. The bidder must give preference to Black Empowerment Companies as subcontractors and notify NECSA of all subcontracts. The bidder warrants goods are new, unused, and free from defects for 12 months after delivery or 18 months after shipment. The agreement is governed by South African law. Disputes are first referred to project managers, then to senior executives, before legal action. Either party may terminate if the other becomes insolvent or is placed under judicial management. Neither party may assign or subcontract without consent. The bidder indemnifies NECSA against third-party claims and must maintain sufficient insurance. Confidentiality obligations apply, including compliance with the Nuclear Energy Act. The bidder must not solicit NECSA personnel.

A Service Level Agreement (SLA) may be entered into as special conditions of contract to amplify or amend the Terms and Conditions. The SLA incorporates these Terms and Conditions by reference, and in case of conflict, the SLA supersedes the Terms and Conditions to the extent of the conflict.

Reports and deliverables are subject to a seven-day evaluation period after submission. If they fail to conform to NECSA requirements, the bidder must correct them at its own expense, and NECSA then has a further seven-day verification period.
