Stage 1 – Administrative responsiveness: bid lodged on time, bid documents duly signed by authorised bidder. Must pass to proceed.

Stage 2 – Substantive responsiveness: bid contains a priced rental offer as prescribed in Section 4. Must pass to proceed.

Stage 3 – Minimum threshold: 66.67/100 for functionality/technical criteria. Bidders are evaluated on previous experience, track record, and Business Plan. Weighted criteria (total 100 points):

• Previous Experience (10 points): minimum 2 years' experience in proposed use, with supporting evidence (e.g., lease agreement, licence).
• Reference Letters (15 points): minimum 2 reference letters not older than 5 years, including customer/company name, address, contact details, project scope, and duration.
• Bank Rating (15 points): rating issued by a financial institution confirming the entity as a going concern, not older than 3 months.
• Business Plan – alignment with Port Development Framework Plan (10 points): must detail use of premises, prove use is Port related, and support Port business.
• Market Analysis (10 points): must be a Port-related commercial activity, addressing status quo, potential market, gap analysis, SWOT analysis, and economic spin-offs.
• Value to Port operations (10 points): vision and mission, strategic objectives, innovation, and proposed value to Port (short and medium term).

Stage 4 – Final weighted scoring:

• Rental Offer Price: weighted 80/90 points, scored using formula PS = 80(1 + (Pt - Pmax)/Pmax) or PS = 90(1 + (Pt - Pmax)/Pmax), where Pt is the price of the bid under consideration and Pmax is the price of the highest acceptable bid.
• Specific Goals (SBD 6.2): weighted 20/10 points.
• Total score: 100.

Stage 5 – Objective criteria: Transnet may award to a bidder other than the highest scorer based on rotation of bidders (to promote opportunities for new entrants), specialised operations, poor track record with TNPA, breach of Integrity Pact, probity check risks, negative impact on Transnet's Return on Investment, or bidder being under restriction, insolvent, lacking legal capacity, or unable to perform free of conflicts of interest.

Stage 6 – Post-tender negotiations (if applicable) with preferred bidder and, if needed, 2nd and 3rd ranked bidders.

Returnable documents: The EMP must be submitted for approval to TNPA 30 days prior to the commencement of the Lease Agreement.

An Environmental Management Plan approved by TNPA, submitted 30 days prior to the commencement of the Lease Agreement, is a precondition of the lease.

The EMP must outline the environmental impacts resulting from operations, proposed mitigation measures, and roles and responsibilities for implementation. It must also consider legal obligations related to operations.

EMP content should include:

• Name of the organisation/entity.
• Detailed description/scope of operations, including equipment and method statements.
• Location of business operations within port limits.
• A detailed list of positive and negative impacts with suitable controls and mitigation measures for natural resources (e.g., waste, water, land, air quality, plants, animals).

• Environmental monitoring programme.
• A list of environmental permits, licenses, and authorisations specific to operations within the port.

The EMP must outline environmental impacts, mitigation measures, and roles and responsibilities. It must address applicable legislative requirements at national, provincial, and local levels. Failure to meet legal environmental requirements could result in severe environmental degradation and penalties. The EMP should include a monitoring programme, a list of environmental permits and licences, and an incident management protocol.
