Saqa is appointing a panel of legal service providers to deliver litigation, corporate and commercial, intellectual property, constitutional and administrative, and labour law services on an as-and-when-required basis for 36 months. The panel will be selected through a four-stage evaluation (administrative, mandatory, functionality, and price/specific goals), with only the top three highest-scoring bidders appointed unless additional expertise is needed. Bidders must be registered with the legal practice council, have a lead attorney with at least five years' experience, and submit a ceiling price with hourly rates for evaluation. The most consequential consideration is the mandatory functionality threshold of 80 out of 100 points, which bidders must meet to proceed to the price and specific goals stage.
Closing: 09 November 2026 at 11:00, hand-delivered to SAQA Tender Box, Reception, Ground Floor, Lourie Place, 189 Lunnon Road, Hillcrest Office Park, Hillcrest 0083; the box locks at exactly 11:00 and late bids are rejected.
Mandatory briefing: none.
Enquiries: written only to [email protected] by 23 October 2026; SAQA responds by 26 October 2026 on its website and E-tender portal.
Returnables: SBD 1, SBD 3.1, SBD 4, SBD 6.1, proof of authority (company resolution), recent CSD report, valid B-BBEE certificate or sworn affidavit (EMEs), and compulsory CV templates for the Lead Attorney and three legal practitioners.
Mandatory criteria (disqualifying if unmet): firm registered with the Legal Practice Council (practice number); Lead Attorney with 5+ years' experience, legal qualifications, certified LPC good standing letter, and Fidelity Fund Certificate valid at submission; three team practitioners with CVs on the compulsory template and LPC good standing letters; at least five signed and dated reference letters (not older than 5 years, at least two from the public sector); and at least one summary of judgements or evidence of successful engagement per practice area.
Functionality threshold: minimum 80/100 points; scoring includes reference letters (up to 20 points), Lead Attorney experience (up to 20 points), five matter summaries of 500 words each (40 points), and a 500-word summary on the PSET legal framework (20 points).
Price and specific goals: 80/20 split; 15 points for at least 51% Black ownership and 5 points for at least 30% Black women ownership, evidenced by a SANAS-approved B-BBEE certificate, commissioned affidavit, or shareholding certificate.
Pricing: ceiling price including all taxes and expenses, plus hourly rates for Partner, Attorney, Other Professional, and Administrative roles for each of the three years; offer valid for 240 days from closing.
Service penalties: 20% deduction of the total invoice amount per incident for late or substandard delivery, capped at 20% per month; reaching the cap four times may trigger a service dispute and contract termination.
Bid validity: 240 days from closing date; bids must remain valid throughout this period.
