Two-stage evaluation:

1. Mandatory requirements (pass/fail):

• Firm of attorneys incorporated or registered with the Legal Practice Council (LPC)
• Firm and partners/directors in good standing with LPC, holding valid fidelity fund certificates and LPC certificates of good standing not older than 6 months
• Lead professional with minimum 10 years' post-admission experience as an attorney
• Demonstrated knowledge of labour/employment law litigation processes and procedures, especially at the Labour Court
• Adequate infrastructure and resources to render the services
• All returnable documents submitted

2. Preference points (80/20 system per PPPFA 2022):

• Price: 80 points
• Specific Goals: 20 points (allocated for black ownership, black women ownership, and ownership by persons living with disabilities as per SBD 6.1 table)

Bidders who do not meet mandatory requirements are disqualified. Failure to submit proof for specific goals means 0 points for that element.

Scope of work — Appointment of legal attorney for a review of an arbitration award at the Labour Court. The service provider must:

• Review the arbitration award within the prescribed statutory time frame
• Ensure an effective and efficient review process until finalisation of the case
• Provide custody of all pleadings and documents in the case
• Provide oral and written legal advice on labour law throughout the review process as and when required

Mandatory capability requirements:

• Knowledge of labour/employment law litigation processes and procedures in various forums, especially the Labour Court
• Firm of attorneys registered with the Legal Practice Council (LPC)
• Firm and partners/directors in good standing with LPC, holding valid fidelity fund certificates and LPC certificates of good standing not older than 6 months
• Lead professional with at least 10 years' post-admission experience as an attorney
• Adequate and appropriate infrastructure and resources to render the services

Pricing requirements:

• Bidders must submit proposed hourly rate(s)
• SABS rates will be negotiated with the preferred bidder prior to contract conclusion
• Quotation must be all-inclusive of VAT
• Include transportation costs (if applicable) and disbursements
• Fixed price; where foreign currencies are involved, bidders must make provision for forward cover
• No advance payment; payment only upon agreed delivery of services

Contractual terms:

• Quotation validity: 120 days from closing date; SABS may extend by a further 60 days by written notice without requiring bidder consent; bidders may not amend quotations during extension
• SABS reserves the right to discontinue the RFQ evaluation process at any time without liability for bidder losses
• This RFQ does not constitute a contract; no communication creates a contract
• SABS will not be bound by any legal or contractual terms included in the bidder's quotation
• Confidentiality: all information provided must be kept confidential; covered by the Non-Disclosure Agreement to be signed between SABS and the bidder
• Non-Disclosure Agreement obligations: maintain strict confidentiality of all information relayed; do not copy or disseminate without SABS prior written consent; obligations survive for 12 months from signature; SABS retains intellectual property rights on all material and processes relating to the service
• No advance payment; payment only upon agreed delivery of services
• SABS not responsible for bidder's preparation or submission costs

Bidders who do not claim specific goals with supporting proof receive 0 points for that element. SABS reserves the right to require substantiation of any claim.
